APP for Opponent(s) :\n1, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE Z.K.SAIYED\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 20\/10\/2010 \n\n \n\n \n \nORAL\nJUDGMENT<\/pre>\n<p>1.\tThe<br \/>\npresent appellant has preferred this appeal under sec. 374(2) of the<br \/>\nCode of Criminal Procedure, against the judgment and order of<br \/>\nconviction and sentence  dated 3.11.2007 passed by the learned Addl.<br \/>\nSessions Judge, Fast Track Court No. 10, Vadodara in Sessions Case<br \/>\nNo. 3\/2006, whereby, the learned Judge has convicted the appellant<br \/>\nunder sec. 392 of IPC and sentenced to undergo R\/I for 5 years and to<br \/>\npay a fine of Rs. 250\/-,in default, to undergo further S\/I for 8<br \/>\ndays. The appellant is also convicted under sec. 397 of IPC and<br \/>\nsentenced to undergo R\/I for a period of 7 years and to pay a fine of<br \/>\nRs 250\/-, in default, to undergo further S\/I for eight days, which is<br \/>\nimpugned in this appeal.\n<\/p>\n<p>2.\tThe<br \/>\nbrief facts of the prosecution case is as under:\n<\/p>\n<p>3.\tThat<br \/>\non 19.11.2004, when the complainant and other passengers travelling<br \/>\nin Arnakulam   Okha train, one Ajaykumar @ Ajaysing came with knife<br \/>\nand threatened him  and looted golden jewellary and cash money, total<br \/>\nworth Rs. 13,500\/-. Thereafter, he has given the jewellary and cash<br \/>\nto accused no. 2 for sale.\n<\/p>\n<p>4.\tTherefore<br \/>\na complaint came to be filed by the complainant at Vadodara Railway<br \/>\nPolice Station. The police started investigation and during the<br \/>\ninvestigation, the  accused no. 1 &#8211; present appellant and accused no.<br \/>\n2 were arrested and on completion of the investigation, charge-sheet<br \/>\nwas filed in the Court of learned Judicial Magistrate Firs Class,<br \/>\nTraffic Court, Vadodara. Thereafter, as the case was exclusively<br \/>\ntriable by the Court of Sessions, the learned Magistrate has<br \/>\ncommitted the case to the Court of Sessions, which was given number<br \/>\nas Sessions Case No. 3\/2006.\n<\/p>\n<p>5.\tThereafter,<br \/>\nthe charge was framed at Ex. 3 against the appellant. The appellant<br \/>\naccused has pleaded not guilty and claimed to be tried.\n<\/p>\n<p>6.\tIn<br \/>\norder to bring the home the charge levelled against the appellant-<br \/>\naccused, the prosecution has examined the witnesses and also produced<br \/>\ndocumentary evidence before the trial Court.\n<\/p>\n<p>7.\tThereafter,<br \/>\nafter examining the witnesses, further statement of the<br \/>\nappellant-accused under sec. 313 of CrPC was recorded in which the<br \/>\nappellant-accused has denied the case of the prosecution.\n<\/p>\n<p>8.\tAfter<br \/>\nconsidering the oral as well as documentary evidence and after<br \/>\nhearing the parties, learned Judge vide impugned judgment and order<br \/>\ndated 3.11.2007 held the appellant   accused guilty to the charge<br \/>\nlevelled against him under sec. 392 and 397 of IPC and convicted and<br \/>\nsentenced the appellant accused, as stated above.\n<\/p>\n<p>9.\tBeing<br \/>\naggrieved by and dissatisfied with the impugned judgment and order of<br \/>\nconviction and sentence passed by the learned Addl. Sessions Judge,<br \/>\nFast Track Court no. 10, Vadodara, the present appellant has<br \/>\npreferred this appeal.\n<\/p>\n<p>10.\tHeard<br \/>\nMs Bharati Rana learned advocate for the appellant and Mr HLJani<br \/>\nlearned APP for the respondent-State.\n<\/p>\n<p>11.\tMs.\n<\/p>\n<p>Rana learned advocate for the appellant has argued that the learned<br \/>\nJudge has not considered the defence of the appellant and therefore,<br \/>\nthe impugned judgment and order of conviction and sentence is bad in<br \/>\neye of law. Ms Rana further contended that the learned Judge has<br \/>\ncommitted grave error while conficting and sentencing the appellant.<br \/>\nMs rana has also read the oral evidence of the witnesses and argued<br \/>\nthat the judgment and order of conviction and sentence is very harsh<br \/>\nin nature. She has also read the panchnama and argued that the<br \/>\nrecovery is not proved beyond reasonable doubt and the case of the<br \/>\ndefence is also required to be considered in favour of the appellant.<br \/>\nShe has also contended from the oral evidence of I.O. that it is<br \/>\nproved before the learned Judge that the I.O. was bias and only just<br \/>\nto get some credit, the present appellant is booked in the offence.\n<\/p>\n<p>12.\tMr<br \/>\nHL Jani learned APP for the State has read the charge as well as<br \/>\nimpugned judgment and order of conviction and sentence and argued<br \/>\nthat the present appellant is a habitual offender and in past also,<br \/>\nhe was convicted for three other offences and was sentenced to<br \/>\nundergo imprisonment for 10 years. Mr Jani has also read the recovery<br \/>\npanchnama and argued that the prosecution has proved its case beyond<br \/>\nreasonable doubt. Mr Jani has also read the oral evidence of<br \/>\nExecutive Magistrate and panch of Identification Parade and argued<br \/>\nthat even in the presence of the independent panch witness, the<br \/>\nidentification of the appellant is already proved before the<br \/>\nExecutive Magistrate. He has also argued that now a days, none is<br \/>\nsafe in the society due to such type of offence and everyday the<br \/>\noffenders are committing such type of offences and, therefore, the<br \/>\nimpugned judgment and order of conviction and sentence requires to be<br \/>\nconfirmed.\n<\/p>\n<p>13.\tI<br \/>\nhave gone through the oral as well as documentary evidence produced<br \/>\non the record. I have read the oral evidence of prosecution<br \/>\nwitness-complainant and also perused the charge framed against the<br \/>\nappellant. First of all, so far as TI parade is concerned, I have<br \/>\nperused the oral evidence of the Executive Magistrate as well as<br \/>\npanch witness, the identification of the present appellant is proved<br \/>\nbeyond reasonable doubt by the prosecution and even the recovery is<br \/>\nalso  proved beyond reasonable doubt. Considering the oral as well as<br \/>\ndocumentary evidence on record, it appears that the learned Judge has<br \/>\nnot committed any error while convicting and sentencing the present<br \/>\nappellant. In that view of the matter, I am of the opinion that there<br \/>\nis no substance in the present appeal and the same requires to be<br \/>\ndismissed.\n<\/p>\n<p>14.\tIn<br \/>\nthe result, this appeal is dismissed. The impugned judgment and order<br \/>\ndated 3.11.2007 passed by the learned Addl. Sessions Judge, Fast<br \/>\nTrack Court No. 10, Vadodara in Sessions Case No. 3 of 2006 is hereby<br \/>\nconfirmed.
