Radhakrishnan, J.\n<\/p>\n<\/p>\n<p>     The petitioner says that he is in the process of establishing<\/p>\n<p>a hotel. He seeks police protection on the premise that<\/p>\n<p>obstruction is being caused for unloading goods for the purpose<\/p>\n<p>of the hotel. The 5th respondent has filed counter affidavit. In<\/p>\n<p>spite of the order dated 1.2.2011, there is no application for<\/p>\n<p>impleadment of the Kerala Head Load Workers Welfare Fund<\/p>\n<p>Board.   The provisions of the Kerala           Head Load Workers<\/p>\n<p>Welfare Fund Act provide preference for workers registered<\/p>\n<p>under the Scheme in terms of that Act in areas which are<\/p>\n<p>covered by the Schemes. The uncontroverted version of the 5th<\/p>\n<p>respondent is that the area in question is covered by the<\/p>\n<p>Scheme. Therefore, any activity referable to the schedule to<\/p>\n<p>that Act has necessarily to be carried out through the registered<\/p>\n<p>workers unless the petitioner has permanent workers,          who<\/p>\n<p>have obtained registration under the            Head Load Workers<\/p>\n<p><span class=\"hidden_text\">W.P.(C) No.2418\/2011            2<\/span><\/p>\n<p>Welfare Act and Scheme.        The question of excluding any<\/p>\n<p>particular activity relatable to exclusion of sophisticated and<\/p>\n<p>delicate materials has to be decided on a case to case basis and<\/p>\n<p>such exemption has necessarily to be regulated by the Local<\/p>\n<p>Labour Officer, who has jurisdiction over the area. It cannot be<\/p>\n<p>decided by the High Court, at any rate, on a disputed question of<\/p>\n<p>facts. Hence, leaving open the petitioner&#8217;s remedy to seek relief<\/p>\n<p>in that regard from the competent authority having jurisdiction<\/p>\n<p>over the area for the purpose of enforcement of the provisions of<\/p>\n<p>the Kerala Head Load Workers Act and Scheme thereunder, this<\/p>\n<p>Writ Petition is ordered directing that in the event of such<\/p>\n<p>decision being taken by the authority the police officers will<\/p>\n<p>ensure that it is honoured.\n<\/p>\n<\/p>\n<p>     Writ Petition ordered accordingly.\n<\/p>\n<\/p>\n<p>                (THOTTATHIL B.
