          This is a petition filed under Article 226 of the<\/p>\n
Constitution of India seeking to have all further<\/p>\n
proceedings in S.C. 780 of 2007                        pending before the<\/p>\n
Additional      Sessions                Court            (Abkari       Cases)<\/p>\n
Kottarakkara quashed and also to declare that until an<\/p>\n
Expert Committee is appointed under Section 56A(b) of<\/p>\n
the Kerala Abkari Act and norms are prescribed, no<\/p>\n
further proceedings shall be taken.\n<\/p>\n
          2. Petitioner is a doctor by profession and he<\/p>\n
is an Ayurvedic physician. He manufactures Ayurvedic<\/p>\n
medicines also. The manufacture is covered by Drugs<\/p>\n
and Cosmetics Act and the Rules. As per Rule 154 of the<\/p>\n
Rules, manufacture and sale of Ayurvedic medicines is<\/p>\n
permitted on the strength of Form 25-D licence issued by<\/p>\n
the Drugs Controller of Kerala. The petitioner holds a<\/p>\n
licence to that effect and it is marked as Ext.P1. The<\/p>\n

licence    prescribed  the     medicines     that   could   be<\/p>\n
manufactured by the petitioner.        The licence is being<\/p>\n
renewed from year to year and is in force even now. Apart<\/p>\n
from Ext.P1 licence, the petitioner is also in possession of L2<\/p>\n
licence under the Medicinal and Toilet Preparations (Excise<\/p>\n
Duties) Act.      He has been manufacturing Ayurvedic<\/p>\n
medicines strictly in accordance with law. On 8.12.2001 at<\/p>\n
about 12.15 in the noon, the second respondent suddenly<\/p>\n
conducted a search in one of the retail outlets of the<\/p>\n
petitioner and 350 ml of Kanakasavam kept for sale in a<\/p>\n
sealed bottled was seized and the sample taken was sent<\/p>\n
for   chemical   analysis.     The    report   disclosed  that<\/p>\n
Kanakasavam contained 12.40% volume of self generating<\/p>\n
ethyl alcohol and based on that certificate Crime No.60 of<\/p>\n
2002 was registered against the petitioner as the first<\/p>\n
accused and the retail outlet employee as the second<\/p>\n
accused.     The offence, which is alleged to have been<\/p>\n
committed, is one under Section 56A(b) of the Abkari Act.<\/p>\n
The occurrence report is produced as Ext.P2.<\/p>\n

           3. According to the petitioner, in order to attract<\/p>\n
Section 56A of the Abkari Act, the articles seized should be<\/p>\n
such preparation      other than a bona fide medicinal<\/p>\n
preparation. The said provision defines what is a medicinal<\/p>\n
preparation and prescribes certain conditions and norms. In<\/p>\n
fact going by the provision, namely 56A(2) Explanation (c)<\/p>\n
an Expert Committee to be constituted by the Government<\/p>\n
of Kerala has to prescribe the formula in a pharmacopoia<\/p>\n
regarding the medicinal preparation.        It is that Expert<\/p>\n
Committee which is competent to say whether the medicine<\/p>\n
prepared is a bona fide one or not. The Government of<\/p>\n
Kerala has not so far constituted any such Committee and<\/p>\n
therefore the whole proceedings is illegal.         No other<\/p>\n
authority as per the Act has the power and authority to<\/p>\n
determine whether the Ayurvedic medicine seized is a bona<\/p>\n
fide preparation or not. Petitioner relies on Note to Rule 3 of<\/p>\n
the Kerala Spirituous Preparations (Control) Rules, 1969, Act<\/p>\n
1 of 1077 also.\n<\/p>\n

           4. The short contention of the petitioner is that in<\/p>\n
order to launch a prosecution for the offence punishable<\/p>\n
under Section 56A(b) of the Abkari Act, it is necessary to<\/p>\n
obtain the opinion of the Expert Committee to be constituted<\/p>\n
regarding the medicinal preparation. That having not been<\/p>\n
done, the entire proceedings have to be quashed.<\/p>\n
           5. Inspite of several opportunities given to the<\/p>\n
Government and even inspite of direction to file a<\/p>\n
statement, nothing has been done in this matter.<\/p>\n
           6. When the matter was taken up for hearing,<\/p>\n
learned Government Pleader handed over a copy of the<\/p>\n
notification dated 19.11.2009, which reads as follows:<\/p>\n
     “S.R.O. No.963\/2009- In exercise of the powers<\/p>\n
     conferred by Section 68A of the Abkari Act; 1 of<\/p>\n
     1077 read with rule 3 of the Abkari (Expert<\/p>\n
     Committee) Rules, 1968 and in supersession of<\/p>\n
     the notification issued under G.O.(P) No.115\/87\/TD<\/p>\n
     dated 27th November, 1987 published as S.R.O.<\/p>\n
     No.1657\/87 in Part I of section iv of the Kerala<\/p>\n

     Gazette No.49 dated 15th December, 1987, the<\/p>\n
     Government of Kerala hereby appoint an Expert<\/p>\n
     Committee with following members, namely.-<\/p>\n<\/blockquote>\n
          1.The      Drugs      Controller,      Kerala,\n\n            Thiruvananthapurm.\n\n<\/pre>\n
          2. The Chief Chemical Examiner, Kerala,<\/p>\n
            Thiruvananthapuram.\n<\/p><\/blockquote>\n
          3. The Director of Health Services, Kerala,<\/p>\n
            Thiruvananthapuram     (Official- Allopathic<\/p>\n
            System of Medicines)<\/p>\n<\/blockquote>\n
          4.   The Ayurvedic Drugs Controller, Kerala<\/p>\n
            Thiruvananthapuram (Official-Indian System<\/p>\n
            of Medicines).\n<\/p><\/blockquote>\n
          5.   Dr.V.G. Udayakumar, ‘Arabhi’, Areekkal,<\/p>\n
            Edaricode P.O., Malappuram (Non-Official<\/p>\n
            Indian System of Medicines).\n<\/p><\/blockquote>\n
          6.   The Director of Homoeopathy, Kerala,<\/p>\n
            Thiruvananthapuram                 (Official-<\/p>\n
            Homoeopathic System of Medicines).<\/p>\n<\/blockquote>\n
          7. The Joint Commissioner of Excise (Internal<\/p>\n
            Audit   Wing),   Excise  Commissionerate,<\/p>\n
            Thiruvananthapuram.”<\/p><\/blockquote>\n

           7. It must be said that there is considerable force<\/p>\n
in the contentions raised by the petitioner. Section 56A of<\/p>\n
the Abkari Act reads as follows:\n<\/p>\n
           “56A.   For     allowing consumption of<\/p>\n
     certain preparations in business premises,<\/p>\n
     for the manufacture and stocking of such<\/p>\n
     preparations, etc:-\n<\/p>\n<\/p>\n
           (1)   Whoever being a chemist, druggist ,<\/p>\n
     apothecary    or   keeper     f  a  dispensary   or<\/p>\n
     Vaidyasala-\n<\/p>\n
           (a) allows any preparation containing liquor<\/p>\n
     or intoxicating drug     to be consumed in his<\/p>\n
     business premises otherwise than for the bona<\/p>\n
     fide treatment, mitigation or prevention of any<\/p>\n
     disease; or<\/p>\n
           (b) manufactures or stocks or causes to be<\/p>\n
     manufactured or stocked any such preparation,<\/p>\n
     other than a bona fide medicinal preparation,<\/p>\n
     within the premises under his control;<\/p>\n
           shall, on conviction before a competent<\/p>\n
     court, be punished with imprisonment for a term<\/p>\n
     which may extend to five years, and with fine<\/p>\n
     which shall not less than fifty thousand rupees.<\/p>\n

           (2)  Whoever consumes any preparation<\/p>\n
     containing liquor or intoxicating  drug, which is<\/p>\n
     not a bona fide medicinal preparation, in any<\/p>\n
     premises referred to in sub-section (1) shall, on<\/p>\n
     conviction before a Magistrate be punished with<\/p>\n
     fine which may extend to five thousand rupees.<\/p>\n
           Explanation:-   For the purposes of this<\/p>\n
     section, “Bona fide medicinal preparation” shall<\/p>\n
     mean any medicinal preparation-\n<\/p>\n
           (a) manufactured according to a formula<\/p>\n
     prescribed in a pharmacopoeia approved by the<\/p>\n
     Government of India or the Government of Kerala,<\/p>\n
     or<\/p>\n
           (b)  manufactured according to a formula<\/p>\n
     approved by the Government of Kerala in respect<\/p>\n
     of patent and proprietory medicinal preparations;<\/p>\n
     or<\/p>\n
           (c) approved as a bona fide medicinal<\/p>\n
     preparation by the Expert Committee appointed<\/p>\n
     under Section 68A.”\n<\/p>\n
Section 68A deals with the constitution of the Exert<\/p>\n
Committee.\n<\/p>\n

           8. A reading of Section 56A will clearly show that<\/p>\n
the authority to determine whether a particular medicinal<\/p>\n
preparation is in conformity with the norms is the Expert<\/p>\n
Committee to be appointed under Section 68A.              The<\/p>\n
Explanation to the said provision defines what is a bona fide<\/p>\n
medicinal preparation. It should be confirm to a formula<\/p>\n
prescribed in a pharmacopoeia approved by the Government<\/p>\n
of India or the Government of Kerala. In the case on hand,<\/p>\n
the issue, even as accepted by the learned Government<\/p>\n
Pleader, falls within the scope of Explanation (c). The Expert<\/p>\n
Committee has been constituted only on 19.11.2009.<\/p>\n
           9.  The prosecution in the case on hand was<\/p>\n
launched much before that.        It was infact launched on<\/p>\n
8.12.2001. Obviously, it is not in accordance with the<\/p>\n
provisions of the Act. On that sole ground the petition has to<\/p>\n
succeed.\n<\/p>\n
           In the result, this petition is allowed, and all<\/p>\n
further proceedings in respect of C.R. No.60\/2002 of<\/p>\n
Pathanapuram Range Punalur Circle initiated by the Excise<\/p>\n
WPC.35218\/2009.              9<\/span><\/p>\n
Range Office shall stand quashed.      So also, all further<\/p>\n
proceedings in S.C. 780 of 2007 on the file of the Additional<\/p>\n
Sessions Court (Abkari) Cases, Kottarakkara shall stand<\/p>\n
quashed and the petitioner shall stand discharged.<\/p>\n
