Thakker, J.\n<\/p>\n<p>1.\t\tLeave granted.\n<\/p>\n<p>2.\t\tThe present appeal is filed against the<br \/>\njudgment and order dated December 6, 2005 passed by a<br \/>\nSingle Judge of the High Court of Judicature for<br \/>\nRajasthan (Jaipur Bench) in S.B. Criminal Appeal No.<br \/>\n332 of 2005. By the said order, a Single Judge of the<br \/>\nHigh Court dismissed the appeal filed by the appellant<br \/>\nherein who had been convicted by the Additional<br \/>\nSessions Judge (Fast Track Court) No.1, Jaipur City,<br \/>\nJaipur in Session Case No. 27 of 2003.\n<\/p>\n<p>3.\t\tIt is not necessary to set out facts in detail<br \/>\nsince we have stated all the facts in Criminal Appeal No.<br \/>\n867 of 2006 (Suman Sood @ Kamal Jeet Kaur v. State of<br \/>\nRajasthan) and a cognate matter which we have decided<br \/>\ntoday. Suffice it to state that a complaint being First<br \/>\nInformation Report (FIR) No. 84 of 1995 was registered at<br \/>\nMalviya Nagar Police Station, Jaipur on February 26,<br \/>\n1995 against Daya Singh, appellant herein, Suman Sood<br \/>\n@ Kamal Jeet Kaur  (accused No.2) and one Harnek<br \/>\nSingh @ Surender Verma (absconding) for offences<br \/>\npunishable under Sections 353, 420, 468, 471, 472, 473,<br \/>\n474 read with Section 120B Indian Penal Code (&#8216;IPC&#8217; for<br \/>\nshort), for offences punishable under Sections 4 and 5 of<br \/>\nthe Explosive Substances Act, 1908, Sections 7 and 25 of<br \/>\nArms Act, 1959 and Section 18 of TADA etc.\n<\/p>\n<p>4.\t\tThe case of the prosecution was that the<br \/>\nappellant herein along with his wife Suman Sood @<br \/>\nKamal Jeet Kaur fabricated Registration Certificate for<br \/>\npurchasing several vehicles in order to carry out<br \/>\nconspiracy of kidnapping and abducting one Rajender<br \/>\nMirdha, son of Shri Ram Niwas Mirdha to exert pressure<br \/>\non the Government of India to release one Devendra<br \/>\nSingh Bhullar, an alleged Khalistani terrorist who was<br \/>\nbeing held in custody by the police. It was also alleged<br \/>\nthat the appellant was found to be in possession of<br \/>\nprohibited arms and ammunition allegedly recovered<br \/>\nfrom House No. B-117, Model Town, Ashok Nagar during<br \/>\npolice raid where the appellant was staying.\n<\/p>\n<p>5.\t\tInitially, prosecution was launched in the<br \/>\nDesignated Court at Ajmer since the provisions of TADA<br \/>\nwere also invoked. The appellant herein, however,<br \/>\nchallenged his prosecution under <a href=\"\/doc\/1421530\/\">TADA. In Daya Singh<br \/>\nLahoria v. Union of India &amp; Ors.,<\/a> (2001) 4 SCC 516, this<br \/>\nCourt upheld the challenge since the prosecution of the<br \/>\naccused could only be maintained in accordance with the<br \/>\nExtradition Treaty and the Decree of Extradition under<br \/>\nwhich the accused were extradited by the United States<br \/>\nof America to India.\n<\/p>\n<p>6.\t\tThereafter, the case was registered as Sessions<br \/>\nCase No. 27 of 2003 under the Indian Penal Code and<br \/>\nalso under the Explosive Substances Act, 1908. The trial<br \/>\nCourt, after considering the evidence on record, convicted<br \/>\naccused No.1 (appellant herein) as under:<br \/>\nUnder Section 420 IPC : to 7 years R.I. and<br \/>\na fine of Rs.500\/-, in default of payment of<br \/>\nfine, to further undergo 6 months S.I.\n<\/p>\n<p>Under Section 468 IPC : to 7 years R.I. and<br \/>\na fine of Rs.500\/-, in default of payment of<br \/>\nfine, to further undergo 6 months S.I.\n<\/p>\n<p>Under Section 471 IPC : to 2 years R.I.\n<\/p>\n<p>Under Section 4 of the Explosive<br \/>\nSubstances Act: to 7 years R.I. and a fine of<br \/>\nRs.500\/-, in default of payment of fine, to<br \/>\nfurther undergo 6 months S.I.\n<\/p>\n<p>7.\t\tSo far as accused No.2 (Suman Sood) is<br \/>\nconcerned, she was acquitted by the Court observing that<br \/>\nthe prosecution was unable to prove the case beyond<br \/>\ndoubt against her.\n<\/p>\n<p>8.\t\tThe appellant, being aggrieved by the order of<br \/>\nconviction and sentence, preferred an appeal in the High<br \/>\nCourt of Rajasthan. Likewise, the State of Rajasthan,<br \/>\nbeing aggrieved by an order of acquittal passed by the<br \/>\ntrial Court against Suman Sood instituted an application<br \/>\nfor leave to appeal against acquittal.\n<\/p>\n<p>9.\t\tA Single Judge of the High Court refused to<br \/>\ngrant leave against accused No.2 (Suman Sood) holding<br \/>\nthat the trial Court was right in recording an order of<br \/>\nacquittal against her and no case had been made out to<br \/>\ngrant leave. Leave was accordingly refused.\n<\/p>\n<p>10.\t\tSo far as the appellant is concerned, at the<br \/>\ntime of hearing of appeal, it was stated by the learned<br \/>\ncounsel for the appellant that maximum sentence<br \/>\nawarded to the appellant was of seven years and all<br \/>\nsentences were ordered to run concurrently. The<br \/>\nappellant had already remained in jail for seven years<br \/>\nand thus he had already undergone the sentence of<br \/>\nimprisonment. He, therefore, did not press the appeal.<br \/>\nThe High Court disposed of the appeal and observed;\n<\/p>\n<p> &#8220;At the very outset, the learned counsel<br \/>\nMr. G.S. Fauzdar for the accused appellant<br \/>\nDaya Singh contended that maximum<br \/>\nsentence in the present case was seven years<br \/>\nand all the sentences were ordered to run<br \/>\nconcurrently and appellant has already<br \/>\ncompleted his sentence of imprisonment of<br \/>\nseven years, therefore, in these circumstances,<br \/>\nhe does not press the appeal filed on behalf of<br \/>\nDaya Singh, challenging his order of conviction<br \/>\nand sentence passed by the trial Court as<br \/>\nmentioned above. In view of the above<br \/>\nstatement of the learned counsel for the<br \/>\nappellant Daya Singh @ Vinay Kumar, the SB<br \/>\nCr. Appeal No. 332\/05 filed by Daya Singh is<br \/>\nhereby dismissed as not pressed&#8221;.\n<\/p>\n<p>11.\t\tMs. Kamini Jaiswal, appearing for the<br \/>\nappellant, challenged the order of conviction and<br \/>\nsentence. When her attention was invited by the Court to<br \/>\nthe above paragraph, she submitted that she did not<br \/>\ndispute that such a statement was made on behalf of the<br \/>\naccused in the High Court, but submitted that, she be<br \/>\npermitted to argue the appeal, particularly when in other<br \/>\nSpecial Leave Petitions, leave was granted and appeals<br \/>\nwere heard on merits. She also submitted that the<br \/>\nimpugned judgment and order of conviction and sentence<br \/>\nare ex facie, illegal, unlawful and liable to be set aside.<br \/>\nShe also submitted that considering the Extradition<br \/>\nTreaty of 1931 between United States of America and<br \/>\nGreat Britain and the Extradition Order passed by the<br \/>\nAmerican Court on June 11, 1997, the appellant could<br \/>\nnot have been prosecuted in Indian Court and the trial of<br \/>\nthe appellant was without authority of law. On merits<br \/>\nalso, no case had been made out by the prosecution. The<br \/>\nother accused (Suman Sood) was acquitted on the same<br \/>\nevidence and leave to appeal against an order of acquittal<br \/>\nwas refused by the High Court. The conviction recorded<br \/>\nby the trial Court against the appellant on the same<br \/>\nevidence is also vitiated and deserves to be set aside.\n<\/p>\n<p>12.\t\tWe would have considered the prayer of the<br \/>\nlearned counsel particularly when the case relates to<br \/>\nadministration of criminal justice and other matters were<br \/>\npending. In the facts and circumstances, however, we are<br \/>\nof the considered opinion that no useful purpose would<br \/>\nbe served in entering into the merits of the matter.\n<\/p>\n<p>13.\t\tSo far as extradition of the appellant is<br \/>\nconcerned, we have already dealt with all contentions<br \/>\nrelating to Extradition Treaty as well as Extradition Order<br \/>\nexhaustively in the other matter. There we have noted<br \/>\nthat extradition of the appellant was also allowed for trial<br \/>\nof offences punishable under the Explosive Substances<br \/>\nAct, 1908.\n<\/p>\n<p>14.\t\tIn our opinion, therefore, prosecution,<br \/>\nconviction and sentence of the appellant for offences<br \/>\npunishable under Explosive Substances Act, 1908<br \/>\ncannot be said to be without jurisdiction or in excess of<br \/>\nauthority of law. The said contention, therefore, has no<br \/>\nforce and must be negatived.\n<\/p>\n<p>15.\t\tSo far as the other contention is concerned, we<br \/>\nhave dismissed the appeal filed by the appellant against<br \/>\nhis conviction for an offence punishable under Section<br \/>\n364A IPC wherein the appellant-accused has been<br \/>\nordered to undergo imprisonment for life. No useful<br \/>\npurpose, therefore, will be served by entering into the<br \/>\nmerits of the matter as the maximum punishment<br \/>\nawarded by the trial Court and confirmed by the High<br \/>\nCourt in the present appeal was of seven years for the<br \/>\noffences said to have been committed by the appellant<br \/>\nand the appellant had already undergone the said<br \/>\nsentence. The counsel appearing for the appellant in the<br \/>\nHigh Court appears to have kept in view the above<br \/>\nposition and did not press the appeal. In the light of the<br \/>\nfinding recorded by us in the cognate matter, this appeal<br \/>\nis, more or less, academic and has become infructuous in<br \/>\nview of the following circumstances;\n<\/p>\n<p>(i)    the appellant has been convicted for an<br \/>\noffence punishable under Section 364A,<br \/>\nIPC and has been ordered to undergo<br \/>\nsentence of imprisonment for life and we<br \/>\nhave upheld the said order; and\n<\/p>\n<p>(ii)\tin the present appeal, the appellant has<br \/>\nchallenged his conviction and sentence<br \/>\nwhereby he has been ordered to undergo<br \/>\nimprisonment for seven years. The<br \/>\nappellant has remained in jail for seven<br \/>\nyears and the said period is over.\n<\/p>\n<p>16.\t\tFor the foregoing reasons, the appeal deserves<br \/>\nto be disposed of and is accordingly disposed of without<br \/>\nentering into merits of the case.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Supreme Court of India Daya Singh Lahoriya @ Rajeev Sudan &#8230; vs State Of Rajasthan on 14 May, 2007 Author: H C Thakker Bench: C.K.
