NO.3647 &amp; 3898\n                      OF 2008\n            ===========================\n\n      Dated this the 4th day of December,2008\n\n                       ORDER\n<\/pre>\n<p>    Accused 1 and 6 in C.C.371\/2001 on the file of<\/p>\n<p>Judicial First Class Magistrate Court-I, Alappuzha<\/p>\n<p>are the revision petitioners in Crl.R.P.3647\/2008.<\/p>\n<p>Accused 2 to 5 therein are the revision petitioners<\/p>\n<p>in Crl.R.P.3898\/2008.    Revision petitioners were<\/p>\n<p>convicted and sentenced for the offences under<\/p>\n<p>sections 143,147,447,427,506(ii)and 435 read with<\/p>\n<p>section  149  of  IPC.    Revision  petitioners  in<\/p>\n<p>Crl.R.P.3647\/2008 challenged the conviction before<\/p>\n<p>Sessions Court, Alappuzha in Crl.A.413\/2007 and the<\/p>\n<p>other  revision   petitioners  in   Crl.A.391\/2007.<\/p>\n<p>Learned Sessions Judge as per common judgment dated<\/p>\n<p>7.8.2008 confirmed the conviction but modified the<\/p>\n<p>sentence.  Revision petitions are filed challenging<\/p>\n<p>the conviction and sentence.\n<\/p>\n<p>    2.   Revision petitioners along with PW2, de<\/p>\n<p>facto  complainant   in   Crl.R.P.3647\/2008   filed<\/p>\n<p>CRRP3647 &amp; 3898 of2008         2<\/p>\n<p>Crl.M.A.11986\/2008 seeking permission to compound<\/p>\n<p>the offence under section 320 of        Code of Criminal<\/p>\n<p>Procedure     stating that the matter has been settled<\/p>\n<p>between them and the de facto complainant has no<\/p>\n<p>further        grievance      against    the     revision<\/p>\n<p>petitioners.Crl.M.A.11976\/2008           is    filed   in<\/p>\n<p>Crl.R.P.3898\/2008 under section 320 of           Code of<\/p>\n<p>Criminal Procedure seeking permission to compound<\/p>\n<p>the offence reiterating the same submission.           An<\/p>\n<p>offence under sections 447 and 427 of IPC are<\/p>\n<p>compoundable        under sub section (1) of Section 320<\/p>\n<p>of Code of Criminal Procedure. Even leave of the<\/p>\n<p>court    is   not     necessary.    Hence  petitions  are<\/p>\n<p>allowed to the limited extent of permitting to<\/p>\n<p>compound the offence under section 447 and 427 of<\/p>\n<p>the Indian Penal Code.\n<\/p>\n<pre>    3.         The     question  is  whether   the   non-\n\ncompoundable         offences under sections 143,147,435\n\nand  506(ii)       of   IPC  could be   permitted  to  be\n\n<\/pre>\n<p>compounded in view of the settlement arrived at<\/p>\n<p>between the parties.        Learned counsel appearing for<\/p>\n<p>CRRP3647 &amp; 3898 of2008        3<\/p>\n<p>the revision petitioners and the learned counsel<\/p>\n<p>appearing for de facto complainant submitted that<\/p>\n<p>the dispute was purely personal between the de<\/p>\n<p>facto complainant and the revision petitioners and<\/p>\n<p>that too in respect of the way claimed by the<\/p>\n<p>revision petitioners through the property of the de<\/p>\n<p>facto complainant       and    prosecution case is that<\/p>\n<p>revision petitioners committed damage to the fence<\/p>\n<p>as well as        improvements in the property   to the<\/p>\n<p>tune of Rs.10,000\/- and when revision petitioners<\/p>\n<p>have already compensated that damages to the         de<\/p>\n<p>facto complainant, this court is to permit the<\/p>\n<p>parties to compound the non compoundable       offences<\/p>\n<p>also, eventhough as provided under section 320 of<\/p>\n<p>Criminal     Procedure,   they   are  not compoundable.<\/p>\n<p>Learned counsel relied on the decisions of the Apex<\/p>\n<p>Court in <a href=\"\/doc\/943700\/\">Sujeetha Thomson v. M.P.Devassy<\/a> (2003(2)<\/p>\n<p>KLT 162), <a href=\"\/doc\/1442974\/\">Madan Mohan Abbot v. State of Punjab<\/a><\/p>\n<p>(2008(3) KLT 19) Nikhil Merchant v. Central Bureau<\/p>\n<p>of Investigation (2008(3) KLT 769 and Manoj Sharma<\/p>\n<p>CRRP3647 &amp; 3898 of2008        4<\/p>\n<p>v. State (2008(4) KLT 417) and argued that when the<\/p>\n<p>dispute is purely personal as in this case and the<\/p>\n<p>case has been settled between the parties, in the<\/p>\n<p>interest of justice, permission is to be granted to<\/p>\n<p>compound the offence.\n<\/p>\n<p>    4.     On hearing the learned     counsel and going<\/p>\n<p>through the decisions of the Apex Court, I cannot<\/p>\n<p>agree with the submission that in view of the said<\/p>\n<p>decisions an offence which is not compoundable<\/p>\n<p>under section 320 of Code of Criminal Procedure<\/p>\n<p>could be allowed to be compounded in revision. In<\/p>\n<p>all those decisions Apex Court was considering the<\/p>\n<p>power of the court under section 482 of Code of<\/p>\n<p>Criminal      Procedure    to  quash  the   proceedings.<\/p>\n<p>Finding that when the matter has been settled<\/p>\n<p>between the parties and the dispute is purely<\/p>\n<p>personal in nature and the trial is yet to be<\/p>\n<p>started and        no purpose will be served by spending<\/p>\n<p>the valuable time of the court when ultimately<\/p>\n<p>there is no possibility of a conviction due to the<\/p>\n<p>settlement of the dispute between the parties,        it<\/p>\n<p>CRRP3647 &amp; 3898 of2008        5<\/p>\n<p>was held that the valuable time of the court could<\/p>\n<p>be saved so that it could be devoted for taking up<\/p>\n<p>other    matters      which deserves the   time  of  the<\/p>\n<p>court and so the cases could be quashed.            That<\/p>\n<p>principle cannot be applied          in respect of an<\/p>\n<p>application for permission to compound an offence<\/p>\n<p>which is not compoundable under section 320 and<\/p>\n<p>that too in revision. It cannot be said that there<\/p>\n<p>is no possibility for conviction,       when two courts<\/p>\n<p>concurrently        found    the   accused  guilty   and<\/p>\n<p>convicted the revision petitioner.<\/p>\n<p>    5.     But the question whether on the facts and<\/p>\n<p>circumstances of the case,           conviction of the<\/p>\n<p>petitioners        for   the offences   under   sections<\/p>\n<p>143,147,435 and 506(ii) of IPC is sustainable.<\/p>\n<p>While considering this aspect it is to be born in<\/p>\n<p>mind that the very prosecution case is that the<\/p>\n<p>revision     petitioners      in  furtherance  of  their<\/p>\n<p>common object trespassed into the property of PW2,<\/p>\n<p>the de facto complainant and destroyed the fence<\/p>\n<p>and also the improvements. The offences alleged are<\/p>\n<p>CRRP3647 &amp; 3898 of2008        6<\/p>\n<p>consequent      to    the  trespass and  mischief.   The<\/p>\n<p>offences were         settled and were compounded.    In<\/p>\n<p>such circumstance, interest of justice warrants<\/p>\n<p>that the accused are not to be convicted for the<\/p>\n<p>remaining offences also.         Hence in the peculiar<\/p>\n<p>facts and circumstances of the case, the conviction<\/p>\n<p>of the petitioners for the offences under section<\/p>\n<p>143,147,435 and 506(ii) read with section 149 of<\/p>\n<p>IPC are set aside.
