He<br \/>\nfurther submitted that applicant is a Government servant and not a<br \/>\nsingle complaint is filed against him. He further submitted that<br \/>\ndemand made is only of Rs.1000\/- and therefore, the  applicant  may<br \/>\nbe released on bail.\n<\/p>\n<p>3.\tLearned<br \/>\nAPP Mr.Pandya  has read over the police papers and submitted that<br \/>\nlooking to the seriousness of offence, present application may not be<br \/>\nentertained.\n<\/p>\n<p>4.\tHaving<br \/>\nheard learned Counsel for the parties and perusing the record of the<br \/>\ncase and taking into consideration the facts of the case, nature of<br \/>\nallegations, role attributed to the applicant, by imposing suitable<br \/>\nconditions, I deem it just  and proper to enlarge the applicant on<br \/>\nbail.\n<\/p>\n<p>5.\tLearned<br \/>\nCounsel for the parties do not press for further reasoned order.\n<\/p>\n<p>6.\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be released on bail in connection<br \/>\nwith First Information Report registered as I-C.R.No.5 of 2011 with<br \/>\nSurat Rural ACB   Police Station on executing a bond of Rs.10,000\/-<br \/>\n(Rupees Ten Thousand Only) with one surety of the like amount to the<br \/>\nsatisfaction of the Trial Court and subject to the conditions that he<br \/>\nshall;\n<\/p>\n<p>a)<br \/>\n\tnot take undue advantage of liberty or misuse liberty;\n<\/p>\n<p>b)<br \/>\n  not act in a manner injurious to the interest of the prosecution;\n<\/p>\n<p>c)<br \/>\n\tsurrender his passport, if any, to the lower court within a week;\n<\/p>\n<p>d)\tnot<br \/>\nleave the State of Gujarat without prior permission of the Sessions<br \/>\nJudge concerned;\n<\/p>\n<p>e)\tmark<br \/>\npresence at the concerned Police Station on the first Sunday of every<br \/>\nmonth between 10.00 a.m. and 3.00 p.m. for three months only;\n<\/p>\n<p>f)<br \/>\n\tfurnish the present address of his residence to the Investigating<br \/>\nOfficer and also to the Court at the time of execution of the bond<br \/>\nand shall not change the residence without prior permission of this<br \/>\nCourt;\n<\/p>\n<p>7.\tThe<br \/>\nauthorities will release the applicant only if not required in<br \/>\nconnection with any other offence for the time being.\n<\/p>\n<p>8.\tIf<br \/>\nbreach of any of the above conditions is committed, the Sessions<br \/>\nJudge concerned will be free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>9.\tBail<br \/>\nbond to be executed before the lower court having jurisdiction to try<br \/>\nthe case.\n<\/p>\n<p>10.\tAt<br \/>\nthe trial, the Trial Court shall not be influenced by the<br \/>\nobservations of preliminary nature, qua the evidence at this stage,<br \/>\nmade by this Court while enlarging the applicants on bail.\n<\/p>\n<p>11.\tRule<br \/>\nis made absolute accordingly.
