Bais, learned counsel for the petitioner.\n     Shri   B.N.    Mishra,   learned   Govt.   Advocate   for\nrespondent State.<\/pre>\n<p>     The petitioner resident of village Dhaudar, tahsil<br \/>\nDeosar, district Singrauli on the allegation that though his<br \/>\nland bearing Khasra No. 556\/2 admeasuring 0.30 hectare<br \/>\nincluding the house and trees thereon has been acquired<br \/>\nfor establishing respondent No. 4 Mahan Aluminum and<br \/>\nCaptive Thermal Power Plant, yet the petitioner has been<br \/>\ndeprived of the benefit of provision of Madhya Pradesh Ki<br \/>\nAdarsh Punarvas Niti Varsh 2002; in view whereof the<br \/>\npetitioner by way of present petition filed under Article 226<br \/>\nof Constitution of India seeks the directions to respondents<br \/>\nto fully comply with the rehabilitation policy and give<br \/>\nbenefits to the petitioner and to pay compensation to the<br \/>\npetitioner as per market rate and as per guideline.\n<\/p>\n<p>     The aforesaid reliefs have also been sought on the<br \/>\nanvil that in an agreement dated 15.5.2009 entered into<br \/>\nbetween the respondent No. 2 and 4, i.e., Collector, District<br \/>\nSingrauli and the Chief Executive Officer, M\/s. Mahan<br \/>\nAluminum and Captive Thermal Power Plant (Hindalco)<br \/>\nLimited Bargawa, District Singrauli.        It is agreed by<br \/>\nrespondent No. 4 to extend the benefit as is available under<br \/>\nthe Rehabilitation Policy of 2002.\n<\/p>\n<p>     During course of hearing, it is submitted by learned<br \/>\ncounsel for the petitioner that in a similar petition this<br \/>\nCourt has directed the Collector, District Singrouli, one of<br \/>\nthe party to the agreement dated 15.5.2009 to dwell upon<br \/>\n<span class=\"hidden_text\">                                                2<\/span><\/p>\n<p>                 the issue as to extension of benefit as stipulated in the<br \/>\n                 policy of 2002, it is urged that similar direction may be<br \/>\n                 issued in the present petition.\n<\/p>\n<p>                      Learned Govt. Advocate appears for the State has no<br \/>\n                 objection for considering the claim as put-forth by the<br \/>\n                 petitioner qua the policy of 2002.\n<\/p>\n<p>                      In view of above and without entering into the merit of<br \/>\n                 the case, the petition is disposed of with liberty to the<br \/>\n                 petitioner to file a representation before the respondent No.<br \/>\n                 2 Collector, district Singrouli.     The respondent No. 2 on<br \/>\n                 receiving such representation shall dwell upon the same in<br \/>\n                 accordance with the policy of the State Government and<br \/>\n                 pass a cogent and reasoned order within a period of two<br \/>\n                 months from the date of communication of this order.
