    Petitioner is the accused and second respondent<\/p>\n
the complainant in C.C.222\/1997 on the file of<\/p>\n
Judicial First Class Magistrate,Paravoor.    Second<\/p>\n
respondent lodged the complaint contending that on<\/p>\n
30.11.1996  petitioner  borrowed  Rs.35,000\/-   and<\/p>\n
towards its repayment issued Ext.P1 cheque drawn in<\/p>\n
his  account  maintained   in  Paravur  branch   of<\/p>\n
S.N.V.R.C. Bank and when the cheque was presented<\/p>\n
for encashment, it was dishonoured    under Ext.P2<\/p>\n
for want of sufficient funds and second respondent<\/p>\n
sent Ext.P4 notice in the correct address of the<\/p>\n
petitioner demanding the amount but it was not<\/p>\n
received    by  the  petitioner  and  was  returned<\/p>\n
unclaimed and petitioner did not pay the amount and<\/p>\n
thereby committed   offence under section 138 of<\/p>\n
Negotiable Instruments Act.     Learned Magistrate<\/p>\n
took  cognizance  of   the  offence.     Petitioner<\/p>\n
CRRP 984\/2008               2<\/span><\/p>\n
appeared before the Magistrate and pleaded not<\/p>\n
guilty.     Second respondent was examined as PW1 and<\/p>\n
manager of the bank was examined as PW2 and Exts.P1<\/p>\n
to P6 were marked.      Petitioner did not adduce any<\/p>\n
evidence.     Learned Magistrate on the evidence found<\/p>\n
the   petitioner   guilty.     He  was  convicted  and<\/p>\n
sentenced to simple imprisonment for three months<\/p>\n
and a compensation of Rs.35,000\/- under section 357<\/p>\n
(3) of the Code of Criminal Procedure.      Petitioner<\/p>\n
challenged     the  conviction  and  sentence   before<\/p>\n
Sessions Court, Kollam in Crl.A.239\/2000.      Learned<\/p>\n
Sessions     Judge  on   reappreciation  of   evidence<\/p>\n
confirmed the conviction and sentence and dismissed<\/p>\n
the appeal. It is challenged in this revision.<\/p>\n
     2.     Learned counsel appearing for petitioner<\/p>\n
was heard and the records called for         from the<\/p>\n
learned Magistrate were perused.\n<\/p>\n
     3.     The  argument  of   the  learned   counsel<\/p>\n
appearing for petitioner is that Ext.P1 cheque was<\/p>\n
not issued in the         account maintained by the<\/p>\n
petitioner and therefore no offence under section<\/p>\n
CRRP 984\/2008              3<\/span><\/p>\n
138 of N.I. Act was committed.        Learned counsel<\/p>\n
argued that evidence of PW2 establish that the<\/p>\n
account was not opened by the petitioner and there<\/p>\n
is a correction in the account number in Ext.P1 and<\/p>\n
therefore        courts  below   should  have   found<\/p>\n
petitioner not guilty.    Learned counsel also argued<\/p>\n
that petitioner is only a driver and there is no<\/p>\n
evidence to prove that Ext.P1 cheque was issued<\/p>\n
towards     repayment of any legally recoverable debt<\/p>\n
and therefore the conviction is not sustainable.<\/p>\n
Learned counsel finally submitted that in any case<\/p>\n
the   sentence   awarded  is  excessive  and  may  be<\/p>\n
modified.\n<\/p>\n
     4.     Though learned counsel vehemently argued<\/p>\n
that Ext.P1 cheque was not issued in the account<\/p>\n
maintained by petitioner, on going through the<\/p>\n
records including the evidence of PW2 relied upon<\/p>\n
by the learned counsel, I cannot agree with the<\/p>\n
submission.     Ext.P6 is the ledger extract of the<\/p>\n
account No.11166.     Ext.P6 establishes that  cheque<\/p>\n
leaf    6221   was   encashed  in  that   account  on<\/p>\n

29.11.1994.      Ext.P1 cheque relates to the same<\/p>\n
cheque book its number being 6226.     Though it was<\/p>\n
argued that there is correction in the account<\/p>\n
number seen in Ext.P1 what is relied upon is the<\/p>\n
third figure 1 which is seen darkened.         Ext.P1<\/p>\n
shows that the cheque relates to account No.11166,<\/p>\n
which is the account evidenced by Ext.P6.      Though<\/p>\n
learned counsel argued that petitioner did not<\/p>\n
maintain that    account, it is seen that when second<\/p>\n
respondent was examined as PW1 there was no case<\/p>\n
for the petitioner that he is not having an account<\/p>\n
in that Bank or that Ext.P1 cheque does not relate<\/p>\n
to his account.       On the other hand, what was<\/p>\n
suggested     to  PW1  was  that   he  had   borrowed<\/p>\n
Rs.20,000\/- and towards its security he issued      a<\/p>\n
blank cheque and second respondent    converted that<\/p>\n
cheque to Ext.P1 cheque for Rs.35,000\/- and he had<\/p>\n
repaid     Rs.15,000\/-.    There  is  absolutely   no<\/p>\n
evidence to prove the alleged    discharge as claimed<\/p>\n
by the petitioner or that the amount borrowed was<\/p>\n
not    Rs.35,000\/-    but   Rs.20,000\/-.      Learned<\/p>\n
CRRP 984\/2008              5<\/span><\/p>\n
Magistrate and learned Sessions Judge appreciated<\/p>\n
the evidence in the proper perspective and found<\/p>\n
that Ext.P1 cheque was issued towards    repayment of<\/p>\n
Rs.35,000\/- which was borrowed by the petitioner<\/p>\n
from second respondent.      Evidence also establish<\/p>\n
that    Ext.P1   cheque was  drawn  in  the   account<\/p>\n
maintained by the petitioner and it was dishonoured<\/p>\n
for want of sufficient funds.      Ext.P4 notice was<\/p>\n
sent to the correct address of the petitioner.    It<\/p>\n
was   returned unclaimed after serving intimation .<\/p>\n
In such circumstance,    findings of the courts below<\/p>\n
that petitioner committed the offence under section<\/p>\n
138 of Negotiable Instruments Act is perfectly<\/p>\n
legal.\n<\/p>\n
     5.     Then the only question is with regard to<\/p>\n
the sentence.      So long as the sentence is not<\/p>\n
varied or modified as against the interest of the<\/p>\n
second respondent, it is not necessary to issue<\/p>\n
notice     to  second respondent.    Considering  the<\/p>\n
nature of the offence and the facts as disclosed in<\/p>\n
the evidence, interest of justice will be met if<\/p>\n

the   sentence is  modified  to  imprisonment  till<\/p>\n
rising of the court and fine.\n<\/p>\n
     Revision is allowed in part.   Conviction for<\/p>\n
the   offence  under  section  138   of  Negotiable<\/p>\n
Instruments Act is confirmed.     The sentence is<\/p>\n
modified to imprisonment till rising of the court<\/p>\n
and a fine of Rs.36,000\/- and in default simple<\/p>\n
imprisonment for two months.  On realisation of the<\/p>\n
fine, Rs.35,000\/- to be paid to second respondent<\/p>\n
as compensation under section 357(1) of the Code of<\/p>\n
Criminal Procedure.    Petitioner is directed to<\/p>\n
appear before the learned Magistrate on 31.12.2008.<\/p>\n
