SHAH\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 11\/10\/2010 \n\n \n\nORAL\nORDER<\/pre>\n<p>1.\tBy<br \/>\nway of this petition under Article 227 of the Constitution of India,<br \/>\nthe petitioner has prayed for an appropriate writ,direction and order<br \/>\nquashing and setting aside the impugned judgment and award dated<br \/>\n15.11.2008 passed in BIR (T) Application No. 8 of 1996 in so far as<br \/>\nawarding 40% back wages only i.e. denying 60% back wages while<br \/>\npassing the order of reinstatement of the petitioner.\n<\/p>\n<p>2.\tShri<br \/>\nPandey, learned advocate for the petitioner has vehemently submitted<br \/>\nthat as admittedly the respondent did not appear before the Labour<br \/>\nCourt and did not even file their reply to the statement of claim and<br \/>\nthe case on behalf of the petitioner has never been disputed, once<br \/>\nthe termination was set aside, the Labour Court ought to have granted<br \/>\nfull back wages and other consequential benefits. It is submitted<br \/>\nthat as such the Labour Court has misread and misinterpreted the<br \/>\ndeposition of the petitioner and finding that nothing has been<br \/>\nmentioned by the petitioner in the deposition, is not correct.<br \/>\nTherefore,it is requested to admit\/ allow the present petition.\n<\/p>\n<p>3.\tHaving<br \/>\nheard Shri Pandey, learned advocate appearing on behalf of the<br \/>\npetitioner and considering the impugned judgment and award and even<br \/>\nconsidering the deposition of the petitioner, it cannot be said that<br \/>\nthe Labour Court has committed any illegality in awarding only 40%<br \/>\nback wages. Considering the deposition of the petitioner, it appears<br \/>\nthat except one statement that he tried to get job but he could not<br \/>\nsucceed, no further evidence \/ documentary evidence has been<br \/>\nproduced. It is his case that he tried to get job but has not<br \/>\nsubstantiated by producing the documentary evidence. Even otherwise,<br \/>\nconsidering the fact that he worked as a Recovery Inspector \/ Clerk<br \/>\nonly for one year and 10 months and even he did not produce any<br \/>\nevidence to show that he worked after 1.1.1995 to 1.7.1996 and<br \/>\n16.7.1996, Labour Court has rightly awarding only 40% back wages. It<br \/>\nis to be noted that alleged termination was of the year 1996 and if<br \/>\n100% back wages are awarded, he will be getting 12 years back wages<br \/>\nfor total length of service of one year and 10 months. Considering<br \/>\noverall aforesaid facts and circumstances, it cannot be said that the<br \/>\nLabour Court has committed any error and \/ or illegality in awarding<br \/>\nonly 40%  back wages, which calls for the interference of this Court<br \/>\nunder Article 227 of the Constitution of India.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above and for the reasons stated above, petition fails,<br \/>\nwhich deserves to be dismissed and is accordingly, dismissed.\n<\/p>\n<p>(M.R.SHAH,<br \/>\nJ.)<\/p>\n<p>kaushik<\/p>\n<p>\t\t   \u00a0\u00a0\u00a0<\/p>\n<p>\t\t   Top<\/p>\n","protected":false},"excerpt":{"rendered":"<p>Gujarat High Court Pramod vs Anyonya on 20 October, 2010 Author: M.R.
