2. The.._c”ase :_4f3\u00abrosecution is that the deceased<\/p>\n
vRathna:jnala had”\u00bbrriarried the accused four months prior to<\/p>\n
  \ufb02After the marriage, the deceased and the<\/p>\n
accuse_d.lAWer’e.,\u00bbv_residing along with the parents and brothers<\/p>\n
V ll of thel'””acc~used:: at Ravagodlu Village. 20 days prior to the<\/p>\n
  complaint the uncle of the deceased namely<\/p>\n
  had died. At that time, the deceased had gone to<\/p>\n
“-\u00abtheuizillage. She informed her parents that her husband is<\/p>\n
having illicit relationship with another woman and<\/p>\n
therefore he was beating and abusing her every day and<\/p>\n
asking her to go to her Village. The said fact was <\/p>\n
to the complainant–PW.2 and PW.1. They  .<\/p>\n
deceased and sent her back to her. .niat1\u00b0irno11.ia1. 0″<\/p>\n
Four days prior to 13.10.2003, one <\/p>\n

from the house and asked” then1–‘-to”p’:t.ra~ce  ‘andfto bring
\nher back to the Village.  searched, on
\n14.10.2003 at about and others
\nwent to the   the dead body
\nof the   st.o’r1’e’;Nalled well situated in
\nfront of the  iofyaccused. Thereafter, the<\/p>\n
complainant believed’y–.th’-atlthe accused were responsible for<\/p>\n
lithe,   his br0t’he’i””s daughter. It is also alleged that<\/p>\n
  and physically ill–treating the<\/p>\n
  deceased  of the illicit relationship of the<\/p>\n
“si;f\u00ab\u00abaccused ”  another lady and therefore, she has<\/p>\n
it  suicide. On the above facts. the complaint<\/p>\n
 was registered as per Crime i\\lo..’305\/2003 of<\/p>\n
Vdd””l’Vhalaghattapura Police Station. The Police thereafter<\/p>\n
conducted investigation and filed charge sheet against the<\/p>\n

\/\/’M<\/p>\n
accused for offences punishable under Sections 498-A,<\/p>\n
304–B IPC and Section 4 of Dowry Prohibition Actv…VV_fAlfter<\/p>\n
securing the accused before the Court, the <\/p>\n
the charge against the accused for _the__offen”ce” A”<\/p>\n
under Section 498~\u00bbA, .’304~B of IPC <\/p>\n
the Dowry Prohibition Act.\n<\/p>\n
3. In order to prgmuqn the prosecution has
\nexamined, in all 9   got marked
\nExs.P.1 to   After hearing<\/p>\n
the prosecution  the learned Sessions<\/p>\n
Judge held  has not proved the case<\/p>\n
beyond  acquitted the accused of all<\/p>\n
the said ‘Voffencespharged against him. Aggrieved by the<\/p>\n
in  State is in appeal before this Court.<\/p>\n
  is the mother of the deceased.\n<\/p>\n
 She has statehdfthat prior to the marriage there was no talks<\/p>\n
 A ‘  giving of anything to her daughter. However. she has<\/p>\n
 _ ‘given one gold vole. jumki and the marriage of her daughter<\/p>\n
  conducted in Anjaneyaswarny temple. After the<\/p>\n
marriage her daughter was sent to her husband’s house in<\/p>\n

Rvagodlu Village and they were staying in a shed along<\/p>\n
with the parents and brother of the accused. For ahou-t:d2:3<\/p>\n
months they were residing happily. When <\/p>\n
came to her parental home for Gowry…festiva1″,”site’;informed it”<\/p>\n
her parents that the accused had ~relationshiu”tjwith:<\/p>\n
some other woman and that she had seen v.Vthern…b:eing’~V’<\/p>\n
together and therefore, he is  further
\nstates that the deceaseddd\u00e9dvidsitecthe-rd\u00e9jtialfentai home at the
\ntime of death of   she informed
\nher mother  dashing for a sum of
\nRs.20,00(}\/ “digging a bore well and in
\norder to coerce  money, he was assaulting<\/p>\n
her. It is further Stated_PW.1 that about 20 days later<\/p>\n
‘she   son to”see–\u00abt’he welfare of her daughter. At that<\/p>\n
 : T_theT*-father4in–1aw and the mother\u00bbiI1~\u00bb1aw of her<\/p>\n
i   daughter in.forr;ned her son that they will not send her with<\/p>\n
~  Th’e.r_eafter they came to know that her daughter was<\/p>\n
  from her matrimonial home. Later when they<\/p>\n
 the house of the accused they found that her<\/p>\n
daughter’s body was \ufb02oating in the well in front of the<\/p>\n
house of the accused. Thereafter the Tahsildar came there<\/p>\n
and removed the dead body from the well and she has<\/p>\n
further stated that the ornaments given by her wereVVt*o’urid<\/p>\n
on the body of her daughter and the same  .<\/p>\n
before the Court.\n<\/p>\n
5. PW.2–Govindaraju is the <\/p>\n
deceased and PW.3–Ramesh isthe brother of t’h’e’..’jdeg:ea’sed, <\/p>\n
who have reiterated the evideIrce__if1- ..t_erms of the evidence of<\/p>\n

 has opiriedrthat the death was due to asphyxia as a result<\/p>\n

guiltvhhof  and acquitted him. The State has \ufb01led<\/p>\n

13. We have gone through the evidence of all the<\/p>\n
witnesses carefully. From the perusal of the evidencel_iofthe<\/p>\n
witnesses it is clear that prior to the marriage3V_:lthere*—-.was_”‘ .<\/p>\n
neither demand for any dowry __nor there’-dwas tariy ll”<\/p>\n
discussion regarding payment of ~’amoun_t’ oli-:7-goiidi<\/p>\n
jewels. It is only after the marriage the acc_us.ed\u00a7_is–~all–eged = L’<\/p>\n
to have demanded a sum of RsV7y2.(l,A’00O[A– for “theHpA1.irpose of<\/p>\n
digging of bore well.  the<\/p>\n
prosecution has vnotv.projr’edV’trie   Section 4 of
\nthe Dowry  <\/p>\n
l4.’.In so lfa:ja_s”‘th’c._cr.1ie–l.ty is concerned, it is in the<\/p>\n
evidence the  four months after the<\/p>\n
_Vn1arriage,’V the deceased came to know that the accused was<\/p>\n
.A”l”1al.\\A\/’l11g.:1lli_t)i:T.. relationship with some woman and in spite of<\/p>\n
inyestligationv\u00bbcondttcted by PW.9 who is the Inspector of<\/p>\n
 V Police Cell, in CO1). no material is brought to<\/p>\n
 there was in fact any lady in the life of the<\/p>\n
  with whom he was in friendly terms or had illicit<\/p>\n
 llrlelationship. None of the Witnesses have either disclosed<\/p>\n
the name of such lady nor her identity. Therefore,<\/p>\n
suspicion of the deceased regarding the accused having any
\nillicit relationship is imaginary which has not beer_1\u00bbprov’ed<\/p>\n
by any cogent evidence.\n<\/p>\n
15. Under these circunistancesithe’alleged <\/p>\n
a result of illicit relationship Vofgthe ‘accused <\/p>\n
woman has not been proved  _reasona’ole  In
\nthis View of the   not been
\nsuccessful in proving  498–A or
\n304-8 IPC and  ‘lthewolpinion that that
\nthe judgment   considered and is
\nbased   evidence on record and<\/p>\n
does not require inter’feren’ce at our hands.<\/p>\n
