Justice KURIAN JOSEPH\n\n Dated :24\/09\/2008\n\n O R D E R\n                        KURIAN JOSEPH, J.\n               ---------------------------------------\n                  W.P.(C) No.14771 OF 2006\n               ---------------------------------------\n         Dated this the 24th day of September, 2008.\n\n\n                          J U D G M E N T\n<\/pre>\n<p>      Exhibit P1 order passed by the fourth respondent is under<\/p>\n<p>challenge. According to the petitioner-panchayath, the dispute<\/p>\n<p>essentially is of a civil nature. The fourth respondent, without<\/p>\n<p>properly understanding the factual and legal position, has issued<\/p>\n<p>a direction to the petitioner-panchayath to demolish the fish<\/p>\n<p>market under dispute on the ground that the same is constructed<\/p>\n<p>trespassing into the property of the fifth respondent. Apparently,<\/p>\n<p>the dispute does not come under Sections 271F and 271J of the<\/p>\n<p>Kerala Panchayath Raj Act. There is an express bar also under<\/p>\n<p>Section 271M of the Act.\n<\/p>\n<p>      2. Therefore, Exhibit P1 is quashed without prejudice to the<\/p>\n<p>liberty to the fifth respondent to approach the Civil Court for<\/p>\n<p>redressal of his grievances.
