    Petitioners are accused in C.C.907\/2006 on<\/p>\n
the file of Judicial First Class Magistrate’s<\/p>\n
Court,  Chalakkudy  taken  cognizance  for  the<\/p>\n
offences under sections 419, 420, 463, 464,<\/p>\n
467, 468, 471, 472, 474, 475, 120B read with<\/p>\n
section 34 of Indian Penal Code on Annexure A2<\/p>\n
final report submitted by the Sub Inspector of<\/p>\n
Police,   Chalakkudy   in   Crime   No.444\/2006<\/p>\n
registered on Annexure A1 complaint filed by<\/p>\n
third respondent before  learned Magistrate who<\/p>\n
sent it for investigation under section 156(3)<\/p>\n
of the Code of Criminal Procedure.  Prosecution<\/p>\n
case  is  that  petitioners    forged    salary<\/p>\n
certificates and agreements and used them as<\/p>\n
genuine and obtained a loan of Rs.1,00,000\/-<\/p>\n
from the bank and misappropriated the same and<\/p>\n
Crl.M.C.3017\/2009            2<\/span><\/p>\n
thereby committed the offences.       This petition is<\/p>\n
filed under section 482 of the Code of Criminal<\/p>\n
Procedure contending that     entire amount due to the<\/p>\n
third respondent bank was subsequently paid and as<\/p>\n
there is no subsisting liability      it is not in the<\/p>\n
interest of justice to continue the prosecution.<\/p>\n
      2.    Third respondent appeared through a counsel<\/p>\n
and filed a statement disclosing that after filing<\/p>\n
of the private complaint, the principal borrower<\/p>\n
T.R.Dasan died and his family members approached<\/p>\n
the bank and considering the pathetic situation of<\/p>\n
the     family     the  bank  agreed  to   settle  the<\/p>\n
transaction in the Adalat for Rs.60,000\/- and the<\/p>\n
bank     received the   entire amount and the bank has<\/p>\n
no subsisting grievance against the petitioners and<\/p>\n
therefore there is no objection for quashing the<\/p>\n
proceedings.\n<\/p>\n
      3.         Learned counsel  appearing   for   the<\/p>\n
petitioners, third respondent and learned Public<\/p>\n
Prosecutor were heard.\n<\/p>\n

      4.       The final report establishes that the<\/p>\n
prosecution case is that petitioners forged     salary<\/p>\n
certificates and agreements and making use of such<\/p>\n
forged documents availed loan of Rs.1,00,000\/- from<\/p>\n
the bank and misappropriated the same and thereby<\/p>\n
committed the offences.     As held by the Apex Court<\/p>\n
in Manoj Sharma v. State (2008(4) KLT 417 (SC) when<\/p>\n
the offences alleged are personal in nature and<\/p>\n
the disputes were amicably settled between the<\/p>\n
third respondent and the petitioners, it is not in<\/p>\n
the      interest    of  justice   to   continue   the<\/p>\n
prosecution.\n<\/p>\n
      Petition is allowed.    C.C.907\/2006 on the file<\/p>\n
of    Judicial     First  Class  Magistrate’s   Court,<\/p>\n
Chalakkudy is quashed.\n<\/p>\n<\/p>\n
