Justice KURIAN JOSEPH\n\n Dated :17\/10\/2006\n\n O R D E R\n                          KURIAN JOSEPH, J.\n                           -------------------------\n                        O.P.No.12906 OF 2003\n                          --------------------------\n                  Dated this the 17th October, 2006\n\n                            J U D G M E N T\n<\/pre>\n<p>      The writ petition is filed with the following prayers:-\n<\/p>\n<p>      i)      To call for the entire records pertaining to the<br \/>\n      issuance of Exts.P2 and P5 impugned orders, and issue<br \/>\n      a writ of certiorari, any other order, writ or direction,<br \/>\n      to quash the same.\n<\/p>\n<p>      ii)     Issue a writ of mandamus, any other order, writ<br \/>\n      or   direction,   directing   the   respondents   herein   to<br \/>\n      regularise   the   alleged   unlawful   construction   of   this<br \/>\n      petitioner, in accordance with the Kerala Municipality<br \/>\n      Act &amp; Rules.\n<\/p>\n<p>      iii)    Issue   a   writ   of   prohibition,   prohibiting   the<br \/>\n      respondents,   from   initiating   any   action   to   demolish<br \/>\n      any part or portion of petitioner&#8217;s residential building.\n<\/p>\n<p>      There is already an interim order in C.M.P.No.21936\/2003.\n<\/p>\n<p>It is seen from the impugned Ext.P5 order that the petitioner is<\/p>\n<p>willing to demolish the alleged unauthorised construction as and<\/p>\n<p>when steps are taken for widening of the road.   It is also seen<\/p>\n<p>from   the   impugned   proceedings   that   she   is   living   with   his<\/p>\n<p>mentally   ill   son.     There   is   no   counter   affidavit.     Petitioner<\/p>\n<p>undertakes that as and when the space is required for widening<\/p>\n<p>the   road,   the   disputed   unauthorised   construction   will   be<\/p>\n<p>unconditionally demolished by her. This writ petition is disposed<\/p>\n<p><span class=\"hidden_text\">O.P.No.12906\/2003                  2<\/span><\/p>\n<p>of making it clear that as and when steps are taken for widening<\/p>\n<p>the   road,   in   case   the   petitioner   does   not   demolish   the<\/p>\n<p>unauthorised construction, it will be open to the respondents to<\/p>\n<p>demolish the same.
