DAVE\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 11\/07\/2011 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\tRule.\n<\/p>\n<p> The  learned Additional   Public  Prosecutor for the State waives<br \/>\nthe service of Rule for the respondent-State.\n<\/p>\n<p>\tHeard<br \/>\nlearned counsel for the parties.\n<\/p>\n<p>\tThis<br \/>\napplication is filed by the applicant under Section 439 of the Code<br \/>\nof Criminal Procedure for regular bail in connection with first<br \/>\ninformation report registered at Prohibition C.R.No.51 of 2010 with<br \/>\nDabhoda police station, Dist: Gandhinagar for the offences punishable<br \/>\nunder Sections 66B, 65(A)(E), 116(B) and 81 of the Bombay Prohibition<br \/>\nAct.\n<\/p>\n<p>\tHeard<br \/>\nlearned counsel for the parties and perused the record.\n<\/p>\n<p>\tConsidering<br \/>\nthe nature of offences and the punishment prescribed under the Code<br \/>\nand the Court in which it is triable, without discussing the evidence<br \/>\nin detail, prima facie, this Court is of the opinion that this is a<br \/>\nfit case to exercise the discretion to enlarge the applicant on bail.\n<\/p>\n<p>\tThe<br \/>\nparties do not press for further reasoned order.\n<\/p>\n<p>\tIn<br \/>\nthe facts and circumstances of the case, the application is allowed<br \/>\nand the applicant is ordered to be released on bail in connection<br \/>\nwith  first information report registered at Prohibition C.R.No.51 of<br \/>\n2010 with Dabhoda police station, Dist: Gandhinagar  on his executing<br \/>\na bond of Rs.5,000\/- (Rupees five thousand only) with one surety of<br \/>\nthe like amount to the satisfaction of the trial court and subject to<br \/>\nthe conditions that he shall<\/p>\n<p>i.\n<\/p>\n<p>not take undue advantage of his liberty or misuse his liberty;\n<\/p>\n<p>not<br \/>\n\tact in a manner injuries to the interest of the prosecution;\n<\/p>\n<p>surrender<br \/>\n\this passport, if any, to the lower court within a week;\n<\/p>\n<p>not<br \/>\n\tleave the State of Gujarat without prior permission of the Sessions<br \/>\n\tJudge concerned;\n<\/p>\n<p>mark<br \/>\n\this presence at the concerned police station on the first Sunday of<br \/>\n\tevery month between 10 a.m. and 3 p.m for three months only.\n<\/p>\n<p>furnish<br \/>\n\tthe present  addresses of his residence to the I.O. and also to the<br \/>\n\tCourt at the time of execution of the bond and shall not change the<br \/>\n\tresidence without prior permission of this Court;\n<\/p>\n<p>\tThe<br \/>\nAuthorities will release the applicant only if he is not required in<br \/>\nconnection with any other offence for the time being. If breach of<br \/>\nany of the above conditions is committed, the Sessions Judge<br \/>\nconcerned will be free to issue warrant or take appropriate action in<br \/>\nthe matter. Bail bond to be executed before the lower court having<br \/>\njurisdiction to try the case.\n<\/p>\n<p>\tRule<br \/>\nis made absolute to the aforesaid extent. D.S.
