Petitioner and private respondents 4 to 6 and 8 are involved in a tussle for running the affairs of &#8220;Vision Education Society&#8221;. It appears that the society was set up and Registered in 1996 to run a Management Institute which could not take off because of infighting between its members: Both sides are blaming each other for this and are making claims and counter claims. In the present petition, petitioner is claiming to be the President of the Society and is wanting private respondents to be restrained from interfering in the affairs of the society and for handing over the charges and for direction to R-3 (Bank) to allow petitioner to operate the account of the society.\n<\/p>\n<p>2. Private respondents are disputing and resisting all this and pray for dismissal of this petition for its non-maintainability because of pendency of Civil Suit No. 210\/2002 pending between the parties on the subject-matter. Apart from this one Writ Petition CW No. 6591\/89 is also pending.\n<\/p>\n<p>3. While this matter was being considered, both sides realised the futility of on-going litigation between them and prayed for disposal of this petition by the following consent order : &#8211;\n<\/p>\n<p>  &#8220;Registrar of the Societies shall first convene a meeting of the founder members of the Vision Education Society within six weeks from receipt of this order and after noticing them, for taking steps to resolve the inter se disputes. He may also call the General Body Meeting of the existing valid members as per his records, in case of need for seeking resolution of any outstanding disputes between the two sides. He is directed to supervise both meetings and play a reconciliatory role to facilitate a settlement between rival parties. Should these efforts fails, it shall be open to him under law to take steps for winding up of the society and pass appropriate consequential orders. In case of settlement, however, concerned parties shall take steps to end the pending litigation between them and hold fresh elections for new office bearers to revive the society. Meanwhile both sides are restrained from alienating the assets of the society till any settlement is arrived at between them.\n<\/p>\n<p>4.
