Heard the learned counsel for the petitioner.<\/p>\n<p>                                 The     husband-petitioner            has     filed    this<\/p>\n<p>                       application under Article 227 of the Constitution of India<\/p>\n<p>                       for setting aside the order dated 05.07.2011 passed by<\/p>\n<p>                       Addl.    Principal   Judge,     Family      Court,       Patna     in<\/p>\n<p>                       Matrimonial Case No.657 of 2008 whereby the learned<\/p>\n<p>                       Court below allowed the application filed by the wife-<\/p>\n<p>                       respondent under Section 24 of the Hindu Marriage Act<\/p>\n<p>                       and directed the petitioner to pay Rs.4000\/- per month<\/p>\n<p>                       as maintenance and Rs.1,000\/- per month to her son<\/p>\n<p>                       from the date of filing of the application, i.e. from<\/p>\n<p>                       16.06.2009 and also directed to pay a lumsum of<\/p>\n<p>                       Rs.15,000\/- as litigation cost.\n<\/p>\n<p>                                 The     learned   counsel       for     the    petitioner<\/p>\n<p>                       submitted that 125 Cr.P.C. proceeding is also pending<\/p>\n<p>                       and any order in this Matrimonial suit will prejudice the<\/p>\n<p>                       parties in the proceeding under Section 125 Cr.P.C.<\/p>\n<p>                       The     learned   counsel     further    submitted        that   the<\/p>\n<p>                       petitioner is dependent on his parents and has no<\/p>\n<p>                       separate source of income.              The school which was<\/p>\n<p>                       running earlier by the wife has been closed now. The<\/p>\n<p>                       learned Court below without taking evidence directed<\/p>\n<p>                       the petitioner to pay interim maintenance and cost of<br \/>\n<span class=\"hidden_text\">                             -2-<\/span><\/p>\n<p>            litigation.\n<\/p>\n<p>                      From perusal of the impugned order, it appears<\/p>\n<p>            that the income tax return and other documents were<\/p>\n<p>            produced before the Court below.           According to the<\/p>\n<p>            learned Court below from the documents available on<\/p>\n<p>            record goes to show that petitioner has transferred<\/p>\n<p>            some land situated at Hazaribagh and the petitioners<\/p>\n<p>            has got income and the income tax return till 2007-08<\/p>\n<p>            has also been filed.    The petitioner also admitted that<\/p>\n<p>            he has got Rs.6000\/- to Rs.8000\/- income per month<\/p>\n<p>            whereas the case of the wife is that her husband earns<\/p>\n<p>            Rs.1 lakh per month.\n<\/p>\n<p>                      Considering the income tax return filed in the<\/p>\n<p>            Court below, the learned Court below held that the<\/p>\n<p>            petitioner has monthly income of Rs.15,000\/- and,<\/p>\n<p>            therefore, on the basis of that the impugned order has<\/p>\n<p>            been    passed.        Now,   therefore,      in   supervisory<\/p>\n<p>            jurisdiction, this Court cannot substitute its own finding<\/p>\n<p>            after considering the documentary evidence which have<\/p>\n<p>            been considered by the Court below. It is well settled<\/p>\n<p>            that in exercise of supervisory jurisdiction, this Court<\/p>\n<p>            cannot turn itself to an appellate Court.<\/p>\n<p>                      In view of the above facts and circumstances<\/p>\n<p>            of the case, I find no jurisdictional error in the<\/p>\n<p>            impugned      order.
