SHAH\n\t\t\n\t\n\n \n\nDate\n: 05\/09\/2005 \n\n \n\n \nORAL\nORDER<\/pre>\n<p>\t\tIn<br \/>\nthis petition under Article 226\/227 of the Constitution of India the<br \/>\npetitioner has challenged the legality and validity of the judgment<br \/>\nand order passed by the Secretary (Appeals), Revenue Department,<br \/>\nState of Gujarat dated 20\/29th September 2004 in Revision<br \/>\nApplication No. 29\/03\/High Court Remand Case No. 13\/04 in dismissing<br \/>\nthe same and confirming the order passed by the Collector,<br \/>\nSurendranagar dated 6.8.2003.\n<\/p>\n<p>2.\t\tThe<br \/>\nland in question was originally owned by one Ayubbhah Nanjibhai<br \/>\nGanchi  and the petitioner claims that he has purchased 10 acres and<br \/>\n1 guntha of land out of Survey No. 88-2 Paiki situate at Halvad by<br \/>\nregistered Sale Deed dated 19th May 2001.  It appears from<br \/>\nthe record that the said sale transaction and the name of the<br \/>\npetiitoner was mutated on the Record of Rights vide Entry No. 7268<br \/>\ndated 20th May 2001 and the same came to be certified by<br \/>\nthe competent authority on 22.6.2001.  It appears from the record,<br \/>\nthat respondent No.2 herein had preferred appeal before the Deputy<br \/>\nCollector, Dhrangadhra, being RRT Appeal No. 1\/2002 challenging the<br \/>\nsaid Entry and accepting the submission on behalf of respondent No.2<br \/>\nthat he had also purchased the land in question the Deputy Collector<br \/>\ncancelled the Entry No. 7268.  Being aggrieved and dissatisfied with<br \/>\nthe order passed by the Deputy Collector, Dhrangadhra, dated<br \/>\n28.2.2003 in Appeal No. 1\/2002 the petitioner preferred Revision<br \/>\nApplication before the Collector and the Collector, Surendranagar, by<br \/>\norder dated 6.8.2003 dismissed the said revision application holding<br \/>\nthat the said Entry would be subject to decision that may be taken by<br \/>\nthe Civil Court in the pending suit.  Being aggrieved and<br \/>\ndissatisfied with the order passed by the Collector, Surendranagar,<br \/>\ndated 6.8.2003 the petitioner preferred Revision Application No.<br \/>\n13\/2004 before the Secretary (Appeals), Revenue Department, State of<br \/>\nGujarat, which came to be dismissed, against which the petitioner has<br \/>\npreferred the present Special Civil Application.\n<\/p>\n<p>3.\t\tShri<br \/>\nPS Champaneri, learned advocate appearing for the petitioner has<br \/>\nvehemently submited that the authorities below has materially erred<br \/>\nin cancelling the Entry No. 7268 which was in favour of the<br \/>\npetitioner on the basis of the Registered Sale Deed and considering<br \/>\nthe provisions of Section 135 of the Bombay Land Revenue Code read<br \/>\nwith Rule 108 of the Rules the authorities could not have ignored the<br \/>\nregistered Sale Deed and could have passed the order that the said<br \/>\nEntry would be subject to the ultimate outcome of the civil suit<br \/>\npending between the parties.\n<\/p>\n<p>4.\t\tShri<br \/>\nBD Karia, learned advocate appearing for respondent No.4 has<br \/>\nsubmitted that in fact the Collector has already passed the order on<br \/>\n6.8.2003 while rejecting the revision application that the Kachha<br \/>\nentry would be subject to the ultimate outcome of the civil suit<br \/>\npending between the parties and therefore it is submitted that no<br \/>\nclarification is required in view of the order passed by the<br \/>\nCollector, Surendranagar dated 6.8.2003.\n<\/p>\n<p>5.\t\tHeard<br \/>\nthe learned advocates appearing on behalf of the parties.  It is<br \/>\nrequired to be noted that the petitioner has purchased the land in<br \/>\nquestion by registered Sale Deed dated 19th May 2001 and<br \/>\nthe Revenue authority could not have ignored the same.  If there is<br \/>\nany dispute with regard to title then the parties are to be relegated<br \/>\nto approach the Civil Court and it can be observed that the said<br \/>\nEntry would be subject to ultimate outcome of the proceedings before<br \/>\nthe Civil Court while making Entry on the basis of the Sale Deed but<br \/>\nthe Revenue authority cannot ignore and\/or refuse to make an entry on<br \/>\nthe basis of the registered Sale Deed.  As observed by the learned<br \/>\nSingle judge of this Court in the judgment and order rendered in<br \/>\nSpecial Civil Application No. 12547 of 2004, if there is any dispute<br \/>\nthan an additional entry can be made while making an entry on the<br \/>\nbasis of the registered Sale Deed  that the said entry would be<br \/>\nsubject to the ultimate outcome of the civil suit pending between the<br \/>\nparties.  It is true, that the Collector in his order dated 6.8.2003<br \/>\nhas observed that the same would be subject to the ultimate outcome<br \/>\nof the civil suit. However, it appears that certification of the<br \/>\nentry in question came to be set aside which the Collector could not<br \/>\nhave done.  Under the circumstances, the orders passed by the<br \/>\nauthorities below cancelling the Entry No. 7268 dated 20th<br \/>\nMay 2001 which came to be certified on 22nd June 2001  are<br \/>\nhereby quashed and set aside and the Entry No. 7268 with respect to<br \/>\nthe land in question is hereby restored.  However, it is directed<br \/>\nthat the concerned authorities shall make an additional entry along<br \/>\nwith the said Entry that such  entry will be subject to the ultimate<br \/>\noutcome of the suit pending between the parties being Civil Suit No.<br \/>\n54 of 2002 and necessary Entry will be made on the basis of the<br \/>\njudgment and decree that may be passed by the competent Civil Court<br \/>\nin Civil Suit No. 54 of 2002.\n<\/p>\n<p>6.\t\tWith<br \/>\nthese observations and direction the present Special Civil<br \/>\nApplication is disposed of.\n<\/p>\n<p>\t\t\t\t\t\t\t[<br \/>\nM.R.
