Justice S.S.SATHEESACHANDRAN\n\n Dated :18\/01\/2010\n\n O R D E R\n                  S.S.SATHEESACHANDRAN, J.\n                 ----------------------------------------\n                    W.P.(C).No.1049 OF 2010\n                     --------------------------------\n          Dated this the 18th day of January 2010\n         ----------------------------------------------------------\n\n                              JUDGMENT\n<\/pre>\n<p>     The writ petition is filed seeking the following reliefs.<\/p>\n<p>     i) Call for the records pertaining to this case leading to<br \/>\nExt.P3 and quash the same issuing a Writ of Certiorari.<\/p>\n<p>     ii)  Call for the records leading to Ext.P3 and quash<br \/>\nExt.P3 and issue a Writ of Mandamus, or                        any other<br \/>\nappropriate Writ, order or direction, directing the Additional<br \/>\nMunsiff Court, Cherthala to hear the matter afresh in<br \/>\naccordance with law after considering the legal aspects put<br \/>\nbefore it within a time frame fixed by this Hon&#8217;ble Court.<\/p>\n<p>     iii)  Pass such other orders or directions that this<br \/>\nHon&#8217;ble    Court     may      deem       fit   and     proper      in the<br \/>\ncircumstances.\n<\/p>\n<p>     2. Petitioner is the 5th defendant in O.S No. 852 of 2006<\/p>\n<p>on the file of Additional Munsiff Court, Cherthala. Suit is for<\/p>\n<p>declaration, recovery of possession and injunction, and the<\/p>\n<p>1st respondent is the plaintiff. Resisting the suit claim, the<\/p>\n<p>petitioner\/5th defendant in her written statement has<\/p>\n<p>contended that she is entitled to the benefits under Section<\/p>\n<p>106 of the Kerala Land Reforms Act and a reference be<\/p>\n<p>W.P.(C).No. 1049 OF 2010         Page numbers<\/p>\n<p>made to Land Tribunal for consideration of her claim<\/p>\n<p>thereunder. The learned Munsiff after hearing both sides<\/p>\n<p>relying on &#8220;Govinda Panicker v Sreedhara Panicker&#8221;<\/p>\n<p>(2001(1) KLT 631) held that the claim raised by the<\/p>\n<p>petitioner under Section 106 of the Kerala Land Reforms Act<\/p>\n<p>need not be referred to the Land Tribunal as it can be<\/p>\n<p>considered with other issues by the court itself. Challenge is<\/p>\n<p>raised      against     that order  invoking  the supervisory<\/p>\n<p>jurisdiction vested with this court under Article 227 of the<\/p>\n<p>Constitution of India.\n<\/p>\n<p>             3. I heard the learned counsel for the petitioner.<\/p>\n<p>Having regard to the submissions made and taking note of<\/p>\n<p>the facts and circumstances presented, I find no notice to<\/p>\n<p>the respondents is necessary and hence it is dispensed<\/p>\n<p>with . This court has held in &#8220;Govinda Panicker v Sreedhara<\/p>\n<p>Panicker&#8221;(2001(1) KLT 631) a reference to the Land Tribunal<\/p>\n<p>as mandated under Section 125(3) of the Kerala Land<\/p>\n<p>Reforms Act emerge for consideration only where rights of a<\/p>\n<p>tenant or a kudikidappukaran arise for consideration. The<\/p>\n<p>rights of a tenant requiring reference arise only where it is<\/p>\n<p>shown that the person who seeks such reference has the<\/p>\n<p>W.P.(C).No. 1049 OF 2010         Page numbers<\/p>\n<p>status of a cultivating tenant as defined under Section 2(57)<\/p>\n<p>and Section 13 of the Kerala Land Reforms Act. So far as a<\/p>\n<p>claim under Section 106 of the Kerala Land Reforms Act is<\/p>\n<p>concerned, he is entitled only to a protection from eviction<\/p>\n<p>subject to liability to pay rent on satisfaction of the<\/p>\n<p>conditions prescribed under that Section entitling such<\/p>\n<p>protection from eviction. Such a person seeking protection<\/p>\n<p>from eviction by virtue of Section 106 of the Kerala Land<\/p>\n<p>Reforms Act cannot claim the status of a cultivating tenant<\/p>\n<p>entitled to fixity of tenure. It was in that backdrop, this court<\/p>\n<p>held that in adjudication of a claim raised under Section 106<\/p>\n<p>of the Kerala Land Reforms Act, no reference to the Land<\/p>\n<p>Tribunal is called for and such claim can be considered by<\/p>\n<p>the civil court. Challenge raised against the impugned order<\/p>\n<p>is found to be meritless.
