State of Rajasthan through Public Prosecutor\n\nDate of Order :::  07.07.2010\n\nHon'ble Mr. Justice Mohammad Rafiq\n\nShri\tShyam Bihari Gauttam, Counsel for petitioner\nShri\tAmit Punia, Public Prosecutor\n####\n\nBy the Court:-<\/pre>\n<p>Heard learned counsel for petitioner as well as learned Public Prosecutor and perused the material made available to me during the arguments of the case.\n<\/p>\n<p>Contention of learned counsel for petitioner is that the petitioner has been falsely implicated in the case of rape whereas he is an innocent person; he is in jail for last about one and a half year.\n<\/p>\n<p>On the other hand, learned Public Prosecutor opposed the bail application and submitted that the bail application of other co-accused has been rejected by this Court repeatedly and the statements of the prosecution witnesses have already been recorded and trial of the case is about to complete.\n<\/p>\n<p>Learned counsel for the petitioner sought to refer to various statements of the prosecution witnesses, however, at this stage when the trial is at the verge of completion, I do not deem it appropriate to enlarge the petitioner on bail pending the trial.
