SHAH\n\t\t\n\t\n\n \n\nDate\n: 21\/07\/2010 \n\n \n\nORAL\nJUDGMENT<\/pre>\n<p>1.\tWith<br \/>\nthe consent of learned advocates appearing for respective parties,<br \/>\nthe applicant is permitted to amend the petition challenging the<br \/>\norder passed by the Collector, Surat dated 11.08.2008, which has been<br \/>\nimpugned before the Secretary (Appeals), Revenue Department, State of<br \/>\nGujarat in Revision Application No.20\/2008.  Petitioner to carry out<br \/>\nthe amendment by 23rd July 2010.\n<\/p>\n<p>2.\tBy<br \/>\nway of this petition under Articles 226 and 227 of the Constitution<br \/>\nof India, initially petitioner had challenged the order dated<br \/>\n11.09.2009 passed by the Revisional Authority i.e. Secretary<br \/>\n(Appeals), Revenue Department, State of Gujarat in Revision<br \/>\nApplication No.20\/2008 rejecting the stay application submitted by<br \/>\nthe petitioner to stay further implementation and operation of the<br \/>\norder passed by the Collector, Surat dated 11.08.2008 regularizing<br \/>\nthe construction put up by the private respondents herein, in an<br \/>\napplication submitted by the private respondents.  However, as there<br \/>\nis broad consensus between learned advocates appearing for the<br \/>\nrespective parties that as the order passed by the Collector, Surat<br \/>\ndated 11.08.2008 has been passed without giving any opportunity to<br \/>\nthe petitioner, the same be quashed and set aside and the matter be<br \/>\nremitted to the Collector, Surat for deciding the application<br \/>\nsubmitted by the private respondents herein for regularization of the<br \/>\nconstruction put up on the land in question etc., petitioner has been<br \/>\npermitted to amend the petition and now the petitioner is challenging<br \/>\nthe order passed by the Collector, Surat dated 11.08.2008.\n<\/p>\n<p>3.\tLearned<br \/>\nadvocates appearing for respective parties, more particularly, Shri<br \/>\nShital Patel, learned advocate appearing on behalf of the private<br \/>\nrespondents has stated at the Bar that concerned private respondents<br \/>\nhave no objection if the order dated 11.08.2008 passed by the<br \/>\nCollector, Surat which has been impugned in the Revision Application<br \/>\nno.20\/2008 pending before the Secretary (Appeals), Revenue<br \/>\nDepartment, State of Gujarat is quashed and set aside and the matter<br \/>\nis remitted to the District Collector for deciding the application<br \/>\nsubmitted by the private respondents for regularization of the<br \/>\nconstruction on the land in question etc. afresh and after giving an<br \/>\nopportunity to the petitioner as well as private respondents and\/or<br \/>\nany other concerned persons.  He does not invite any further reasoned<br \/>\norder in quashing and setting aside the order passed by the Collector<br \/>\ndated 11.08.2008.  In view of the above, this Court does not assign<br \/>\nany further reasoned order while quashing and setting aside the order<br \/>\npassed by the Collector, Surat dated 11.08.2008 and remitting the<br \/>\nmatter to the Collector, Surat for deciding the same afresh.\n<\/p>\n<p>4.\tIn<br \/>\nview of the above broad consensus between learned advocates appearing<br \/>\non behalf of respective parties, under the instructions from the<br \/>\nrespective clients, present petition is allowed and the order passed<br \/>\nby the Collector, Surat dated 11.08.2008 passed on application<br \/>\nsubmitted by the private respondents herein in regularizing the<br \/>\nconstruction on the land in question etc. which has been impugned<br \/>\nbefore the Secretary (Appeals), Revenue Department, State of Gujarat<br \/>\nby way of Revision Application No.20\/2008, is hereby quashed and set<br \/>\naside and the matter is remitted to the Collector, Surat for passing<br \/>\nappropriate order in accordance with law and on merits and after<br \/>\ngiving opportunity to all concerned inclusive of the petitioner as<br \/>\nwell as the private respondents herein.   The aforesaid exercise<br \/>\nshall be completed within a period of three months from the date of<br \/>\nreceipt of present order.  The Collector, Surat to pass appropriate<br \/>\norder in accordance with law and on merits without in anyway being<br \/>\ninfluenced by the present order as the order passed by the Collector<br \/>\nhas been set aside without giving any opportunity to the petitioner.<br \/>\nAll contentions \/ defences which are available to the respective<br \/>\nparties under the law inclusive of the contentions on behalf of the<br \/>\npetitioner that once the earlier application submitted by the<br \/>\noriginal owners was rejected, such a second application is not<br \/>\nmaintainable, are kept open and the learned Collector, Surat to<br \/>\nconsider the same and pass appropriate order in accordance with law<br \/>\nand on merits.\n<\/p>\n<p>5.\tIn<br \/>\nview of the above, Secretary (Appeals), Revenue Department, State of<br \/>\nGujarat is not required to pass any further order as the order<br \/>\nimpugned in the Revision Application is set aside by this Court by<br \/>\nthis order and petitioner to submit an appropriate application before<br \/>\nthe Revisional Authority to dispose of the aforesaid Revision<br \/>\nApplication in light of the order passed by this Court and the<br \/>\nRevisional Authority to pass a formal order either with respect to<br \/>\nwithdrawal and\/or disposal of the said Revision Application as having<br \/>\nbecome infructuous.  Rule is made absolute to the aforesaid extent.<br \/>\nNo costs.
