Learned AGP<br \/>\nwaives service of notice of Rule for the respondents.\n<\/p>\n<p>1.\t\tBy<br \/>\nway of this petition, the present petitioner has<br \/>\nchallenged the  impugned order passed by Dy.Collector, Stamp Duty<br \/>\nValuation Department, Rajkot dated  22.4.2008.\n<\/p>\n<p>\t\tHeard the<br \/>\nlearned advocate for the petitioner and  the learned AGP for the<br \/>\nrespondents.\n<\/p>\n<p>2.\t\tIt is<br \/>\nsubmitted by the learned advocate for the petitioner that without<br \/>\ngiving any details regarding determination of market value, in<br \/>\nprinted form, order was passed by the Dy. Collector, Stamp Duty<br \/>\nValuation, Rajkot in a casual manner. It is submitted by him that<br \/>\nafter taking into consideration certain  principles regarding<br \/>\ndetermining the  market value of the property, he has  passed the<br \/>\nimpugned order on the basis of which he has valued the property in<br \/>\nquestion at an excessively exorbitant rate and therefore, deficit<br \/>\nStamp Duty of Rs.86,760\/-  and fine of Rs.250\/- was required to be<br \/>\npaid to the authorities.    It is submitted by him that the<br \/>\nrespondent authority has not considered the fact that the petitioner<br \/>\nhas purchased the property in question by paying the  market value<br \/>\nwhich was prevailing at the relevant time.  It is also submitted by<br \/>\nthe learned advocate that as the petitioners were not served the<br \/>\nfinal order of the respondent No.1, there was delay  in preferring<br \/>\nthe appeal. However, the application preferred by the petitioner was<br \/>\nrejected on the ground that the appeal is not within the limitation<br \/>\nperiod.\n<\/p>\n<p>Therefore,<br \/>\nit is prayed that the decision of the respondent- Authorities are<br \/>\nrequired to be quashed and set aside.\n<\/p>\n<p>3.\t\tIn<br \/>\nsupport of his submission, the learned Advocate has placed reliance<br \/>\non \u00fd  (i) (2006) 12 GHJ 533 (Vinaybhai P. Patel Vs. State of<br \/>\nGujarat), (ii) (2006) 12 GHJ 646 (Manubhai Vaghijibhai Dabhi Vs.<br \/>\nState of Gujarat and Anr.), (iii) 2006 (12) GHJ 538 (A.P.M.C., Patan<br \/>\nVs. State of Gujarat and Anr.) and (iv) 2006 (2) GLR 1735 (New<br \/>\nKalindi Karnavati Co.Op. Housing Society Ltd. Vs. State of Gujarat<br \/>\nand Ors.).\n<\/p>\n<p>4.\t\tIt<br \/>\ncan be seen from the aforesaid authorities, this Court has time and<br \/>\nagain rendered decisions for quashing and setting aside the<br \/>\ncyclostyled type order and non speaking orders by holding that it is<br \/>\nthe duty vested in the respondent authorities to justify its say for<br \/>\nhigher market value for the  property \/ land in question.  In the<br \/>\ninstance case, it is clear that the impugned order does not even<br \/>\nrecite the basis or calculation for arriving at the market value, and<br \/>\ntherefore, the impugned order cannot be sustained in the eye of law.<br \/>\nReference in this connection may also be had to the decision rendered<br \/>\nin the case of Bal Nalkantha Khedoor Mandal Vs. State of Gujarat<br \/>\ndecided on 26th July, 1999 in Special Civil<br \/>\nApplication No.1731 of 1999 (Coram: Hon&#8217;ble the Chief Justice Mr.<br \/>\nK.G. Balkrishnan and Hon&#8217;ble Mr. Justice S.D. Dave).\n<\/p>\n<p>5.\t\tHaving<br \/>\nconsidered the aforesaid authorities and for the reasons as discussed<br \/>\nabove, in my considered opinion, the impugned order is passed in<br \/>\nbreach of the provisions of the Act, 1958 and the Rules, 1984 as it<br \/>\nis thoroughly non speaking order and no reasons have been assigned.<br \/>\nIn that view of the matter, the petition is allowed.  The impugned<br \/>\norders dated 22.4.2008 and 26.3.2003   passed by respondent No.1 are<br \/>\nquashed and set aside.  The matter is remanded to respondent No.1 for<br \/>\ntaking fresh decision and for passing a speaking order as per the<br \/>\nAct, 1958 read with the Rules, 1984, after giving an opportunity of<br \/>\nhearing to the petitioner.
