The          Divisional          Commissioner,\n                       Munger..........................Respondents\n                                      -----------\n<\/pre>\n<p>2   04.03.2011              Heard     learned   counsel      for    the<\/p>\n<p>                   petitioner as well as learned counsel<\/p>\n<p>                   for the State.\n<\/p>\n<p>                            From Annexure-13 it appears that<\/p>\n<p>                   the     petitioner     has    represented        the<\/p>\n<p>                   Commissioner against the order of the<\/p>\n<p>                   District      Programme         Officer         dated<\/p>\n<p>                   11.04.2009       rejecting   her    complaint     in<\/p>\n<p>                   terms of the orders of this Court passed<\/p>\n<p>                   in CWJC No. 10307 of 2008. In the order<\/p>\n<p>                   of the District Programme Officer itself<\/p>\n<p>                   it was mentioned that petitioner could<\/p>\n<p>                   file    an   appeal    before      the   competent<\/p>\n<p>                   authority against the said order. Thus,<br \/>\n<span class=\"hidden_text\">                      2<\/span><\/p>\n<p>in sum and substance, representation of<\/p>\n<p>the petitioner before the Commissioner<\/p>\n<p>was an appeal.\n<\/p>\n<p>         Learned                counsel            for         the<\/p>\n<p>petitioner submits that the same has not<\/p>\n<p>been considered by the Commissioner till<\/p>\n<p>today      and           on     being           asked     about<\/p>\n<p>consideration            of     the      said     application<\/p>\n<p>under the Right to Information Act, she<\/p>\n<p>was    informed          that       the     same    has       been<\/p>\n<p>referred        to        the       District        Programme<\/p>\n<p>Officer, Munger for necessary action in<\/p>\n<p>accordance with law.\n<\/p>\n<p>         This             is          completely              non-\n<\/p>\n<p>application of mind by the Commissioner.<\/p>\n<p>The    representation               of    the     petitioner,<\/p>\n<p>which     was       in        sum     and       substance       an<\/p>\n<p>appeal,       was    against          the       order    of    the<\/p>\n<p>District Programme Officer itself and,<\/p>\n<p>therefore,           the        same        could       not    be<\/p>\n<p>referred        to        the       District        Programme<\/p>\n<p>Officer for any action in the matter.<\/p>\n<p>The      Commissioner                 ought         to        have<\/p>\n<p>registered the said application as an<\/p>\n<p>appeal    and       ought       to       have    decided       the<\/p>\n<p>same     in     accordance               with      law    after<br \/>\n<span class=\"hidden_text\">                           3<\/span><\/p>\n<p>     hearing       the    parties          which   he    has   not<\/p>\n<p>     done.\n<\/p>\n<p>              The             writ         application          is,<\/p>\n<p>     therefore, disposed of with a direction<\/p>\n<p>     to the    Commissioner to get registered<\/p>\n<p>     the     said             representation            of      the<\/p>\n<p>     petitioner dated 19.08.2009 before him,<\/p>\n<p>     thereafter          hear    the       parties      and    pass<\/p>\n<p>     final orders on the same in accordance<\/p>\n<p>     with    law    within           the   time    limit      fixed<\/p>\n<p>     under    the        Guidelines         for    hearing      the<\/p>\n<p>     appeal in such matters.\n<\/p>\n<\/p>\n<p>                               (J.
