JUSTICE R.M.DOSHIT)<\/p>\n<p>\tThe<br \/>\nmatter at issue is forthcoming election of the Gujarat Secondary &amp;<br \/>\nHigher Secondary Education Board. The polling is scheduled on 20th<br \/>\nJanuary 2010 i.e. tomorrow. The petitioner has submitted his<br \/>\nnomination from the constituency of Parents&#8217; Association &#8216;C&#8217;<br \/>\nDivision. The petitioner challenges the voters&#8217; list published on 5th<br \/>\nDecember 2009. It is the grievance of the petitioner that contrary to<br \/>\nthe notification dated 13th November 2009 issued by the<br \/>\nrespondent Board, the voters&#8217; list includes names of the voters whose<br \/>\nphotographs and other particulars are not available.\n<\/p>\n<p>\tLearned<br \/>\nadvocate Mr. B.S.Patel has appeared for the petitioner. He has<br \/>\nsubmitted that of almost 45% of the voters, photographs or<br \/>\nparticulars are not available. He has submitted that those voters<br \/>\nwhose photographs and\/or particulars are not available on the voters&#8217;<br \/>\nlist, should not be allowed to cast their votes in the forthcoming<br \/>\nelection.\n<\/p>\n<p>\tWe<br \/>\ndo agree that the petitioner&#8217;s grievance may be genuine, but we do<br \/>\nnot intend to interfere. It may be noted that the impugned voters&#8217;<br \/>\nlist was published as early as on 5th December 2009. More<br \/>\nthan a month thereafter, the petitioner has raised the grievance<br \/>\nbefore this Court just a day prior to the election date. We do not<br \/>\nintend to entertain the belated grievance.
