KRISHNAN, J.\n                   ...........................................\n                   M.A.C.A.No.2067 OF 2007\n                   .............................................\n           Dated this the 19th day of January, 2010\n\n                          J U D G M E N T\n<\/pre>\n<p>       Here is     a case where the claimant had sustained<\/p>\n<p>injuries in a road accident while travelling as the pillion<\/p>\n<p>rider.   The Tribunal found that the accident took place on<\/p>\n<p>account of the negligence               of the rider and           granted    a<\/p>\n<p>compensation of Rs.24,600\/= to the claimant. It also found<\/p>\n<p>that the pillion rider is not covered but ultimately directed<\/p>\n<p>the insurance company to pay the amount and recover it<\/p>\n<p>from the owner. It is against that decision, the insurance<\/p>\n<p>company has come up in appeal.\n<\/p>\n<p>      2. Heard the learned counsel.                     The short point that<\/p>\n<p>arises for determination is             regarding           the liability of the<\/p>\n<p>insurance company. By virtue of the decision of the Supreme<\/p>\n<p>Court in <a href=\"\/doc\/423517\/\">United India Insurance Co. Ltd. v. Tilak Singh<\/a><\/p>\n<p>(2006(2)KLT 884), status of a pillion rider is that of a<\/p>\n<p>gratuitous passenger not covered by the policy. But it has<\/p>\n<p>been also held that         when there is               a     comprehensive or<\/p>\n<p>package policy, the terms and conditions of the policy will<\/p>\n<p>cover the risk of the pillion rider. But, admittedly, in this<\/p>\n<p><span class=\"hidden_text\">                              : 2 :<\/span><br \/>\nM.A.C.A.No.2067 OF 2007<\/p>\n<p>case the vehicle is    covered only by    an   act only policy.<\/p>\n<p>Therefore, the decision of the Apex Court in <a href=\"\/doc\/423517\/\">United India<\/p>\n<p>Insurance Co. Ltd. v. Tilak Singh<\/a> (2006(2)KLT 884) will<\/p>\n<p>apply in all force to the facts of this case. When the policy<\/p>\n<p>does not cover a pillion rider, insurance company cannot be<\/p>\n<p>saddled with the liability.      Ordinary recovery clause is<\/p>\n<p>granted when the company is liable, but there are breach of<\/p>\n<p>policy conditions which enables the company to get<\/p>\n<p>reimbursement from the insured.         As far as this case is<\/p>\n<p>concerned, there is no coverage at all and therefore, the<\/p>\n<p>insurance policy cannot cover the risk of a pillion rider.<\/p>\n<p>      3. Therefore, the award of the Tribunal directing the<\/p>\n<p>insurance company to pay the amount and get it recovered<\/p>\n<p>from the owner is unsustainable in law and liable to be set<\/p>\n<p>aside and I do so.\n<\/p>\n<p>     4. In the result, the MACA is allowed. The insurance<\/p>\n<p>company is totally exonerated from the liability and the<\/p>\n<p>claimant is given an opportunity to proceed against<\/p>\n<p>respondents 1 and 2 jointly and severally for the realisation<\/p>\n<p>of the amount.\n<\/p>\n<p>     Disposed of accordingly.\n<\/p>\n<p>                                 M.N.
