Leave granted.\n<\/p>\n<\/p>\n<p>          2.   This appeal is directed against an order dated 27th<\/p>\n<p>               of August, 2007 passed by the High Court of Delhi<\/p>\n<p>               at New Delhi in C.M.No.11168 of 2007 arising out<\/p>\n<p>               of CM (Main) No.1718 of 2004 whereby the High<\/p>\n<p>               Court had disposed of C.M.No.11168 of 2007 filed<\/p>\n<p>               by the appellant for producing additional evidence<\/p>\n<p>               with the directions to the appellant to pay<\/p>\n<p>               maintenance to the respondent at the rate of<br \/>\n<span class=\"hidden_text\">                                                2<\/span><\/p>\n<p>     Rs.35,000\/- per month and clear the arrears<\/p>\n<p>     within two weeks.\n<\/p>\n<\/p>\n<p>3.   We have heard the learned counsel for the parties<\/p>\n<p>     and examined the impugned order. In our view,<\/p>\n<p>     the High Court was not justified, while dealing<\/p>\n<p>     with the application for acceptance of additional<\/p>\n<p>     evidence to direct the husband-appellant to pay<\/p>\n<p>     maintenance to the wife-respondent at the rate of<\/p>\n<p>     Rs.35,000\/- per month and to clear the arrears<\/p>\n<p>     within two weeks from the date of passing of the<\/p>\n<p>     impugned order.\n<\/p>\n<\/p>\n<p>4.   For the reasons aforesaid, the impugned order is<\/p>\n<p>     set aside and the application for acceptance of<\/p>\n<p>     additional evidence is restored and the High Court<\/p>\n<p>     is requested to dispose of the same on merits in<\/p>\n<p>     accordance with law. In the event, the respondent<\/p>\n<p>     seeks to file any application for payment of<\/p>\n<p>     maintenance and also for arrears of maintenance,<br \/>\n<span class=\"hidden_text\">                                                      3<\/span><\/p>\n<p>     it would be open for her to make such application<\/p>\n<p>     independent of the application for acceptance of<\/p>\n<p>     additional evidence. Both the applications if filed,<\/p>\n<p>     shall be decided in accordance with law.<\/p>\n<p>5.   We are informed that the main matter namely<\/p>\n<p>     C.M. No.1718 of 2004 is pending for a long time.<\/p>\n<p>     We request the High Court to dispose of the main<\/p>\n<p>     matter namely C.M.(Main) No.1718 of 2004 at an<\/p>\n<p>     early date preferably within three months from the<\/p>\n<p>     date of communication of this order to the High<\/p>\n<p>     Court. The impugned order is thus set aside and<\/p>\n<p>     the appeal is allowed to the extent indicated<\/p>\n<p>     above.
