In pursuance of the said impugned order, the petitioner<br \/>\nis detained in Porbandar Jail, Porbandar.\n<\/p>\n<p>3.\tFrom<br \/>\nthe grounds of detention, it appears that three offences being I-CR<br \/>\nNos.474 of 2005, 333 of 2007 and 960 of 2007 have been registered<br \/>\nagainst the detenu at Satellite Police Station, under the provisions<br \/>\nof Sections 380 and 454 of IPC, wherein theft of articles like Gold<br \/>\nand Silver ornaments, watches, cash etc. were found from the<br \/>\npossession of the detenue. On the basis of registration of these<br \/>\ncases, the detaining authority held that the present detenue was<br \/>\ncarrying on activities of theft which is harmful to the health of the<br \/>\npublic. It is held by the detaining authority that as the detenue is<br \/>\nindulged in illegal activities, it is required to restrain the<br \/>\ndetenue from carrying out further such illegal activities. The<br \/>\ndetaining authority has placed reliance on the above registered<br \/>\noffences and statements of unnamed witnesses.  In the opinion of this<br \/>\nCourt, the activities of the detenue can, by no stretch of<br \/>\nimagination, be said to be disturbing the ?Spublic order.?? In<br \/>\nfact, a perusal of the order passed by the detaining authority shows<br \/>\nthat the grounds which  are mentioned in the order are in reference<br \/>\nto the situation of ?Slaw and order?? and not ?Spublic order??.<br \/>\nTherefore, on this ground, the subjective satisfaction arrived at by<br \/>\nthe detaining authority is vitiated on account of non-application of<br \/>\nmind and the impugned order, therefore, deserves to be quashed and<br \/>\nset aside.\n<\/p>\n<p>4.\tExcept<br \/>\nthe statements of some anonymous witnesses, there is no material on<br \/>\nrecord which shows that the petitioner-detenue is carrying on<br \/>\nactivities of theft which is harmful to the health of the public. In<br \/>\nthe case of Ashokbhai Jivraj @ <a href=\"\/doc\/687998\/\">Jivabhai Solanki v. Police<br \/>\nCommissioner, Surat<\/a> [(2001)(1)GLH 393)], having considered the<br \/>\ndecision of the Hon&#8217;ble Apex Court in the case of Ram Manohar<br \/>\nLohia v. State of Bihar (AIR 1966 SC 740), this Court held that<br \/>\nthe cases wherein the detention order passed on the basis of the<br \/>\nstatements of the witnesses falls under the maintenance of ?Slaw and<br \/>\norder?? and not ?Spublic order??.\n<\/p>\n<p>5.\tApplying<br \/>\nthe ratio of the above decisions, it is clear that before passing an<br \/>\norder of detention  of a detenue, the detaining authority must come<br \/>\nto a definite finding that there is threat to the ?Spublic  order??<br \/>\nand it is very clear that the present would not fall within the<br \/>\ncategory of threat to ?Spublic order??. In that view of the matter,<br \/>\nwhen the order of detention has been passed by the detaining<br \/>\nauthority without having adequate grounds for passing the said order,<br \/>\ncannot be sustained and, therefore, it deserves to be quashed and set<br \/>\naside.\n<\/p>\n<p>6.\tIn<br \/>\nthe result, this Special Civil<br \/>\nApplication is allowed. The impugned order of detention dated<br \/>\n13.12.2007 passed by the detaining authority is hereby quashed and<br \/>\nset aside. The detenue is ordered to be set at liberty forthwith, if<br \/>\nnot required in any other case.
