Justice V.GIRI\n\n Dated :05\/11\/2008\n\n O R D E R\n                          V.GIRI, J.\n           -------------------------\n                 W.P.(C).No.10056 of 2007\n           -------------------------\n          Dated this the 5th day of November, 2008.\n\n\n                        JUDGMENT\n<\/pre>\n<p>          The petitioner is an association of Co-operative<\/p>\n<p>Hospitals in the State.      It is running a Co-operative<\/p>\n<p>Hospital at Thalassery. Till 2001, the College of Nursing<\/p>\n<p>being conducted in the said Co-operative Hospital was<\/p>\n<p>affiliated to the Calicut University.    It seems that the<\/p>\n<p>Calicut University felt that it cannot continue to let an<\/p>\n<p>institution being run within the limits of another University<\/p>\n<p>viz., Kannur University, being affiliated to the Calicut<\/p>\n<p>University.    Therefore, the affiliation by the Calicut<\/p>\n<p>University was stopped.\n<\/p>\n<p>          2. The petitioner entered into an understanding<\/p>\n<p>as evidenced by Ext.P1 Memorandum of Understanding,<\/p>\n<p>whereby it agreed to conduct B.Sc. Nursing and Bachelor<\/p>\n<p>Physiotherapy Course with a strength of 60 students each<\/p>\n<p>in collaboration with the first party.      The terms and<\/p>\n<p>conditions in relation to such collaboration are contained in<\/p>\n<p>Ext.P1 Memorandum of Understanding.          The College of<\/p>\n<p>W.P.(C).NO.10056\/07<\/p>\n<p>                              :: 2 ::\n<\/p>\n<p>\nNursing is, therefore, being conducted at Nettoor in<\/p>\n<p>Thalassery and the said institution was being run in terms<\/p>\n<p>of Ext.P1. The Indian Nursing Council, a competent body<\/p>\n<p>under the Indian Council Act, 1947 has, by Ext.P2 dated<\/p>\n<p>18.10.2006, certified that the course conducted by the<\/p>\n<p>institution is an approved course of study for admission to<\/p>\n<p>an approved examination for the said course. By Ext.P3<\/p>\n<p>order, the Government issued an No Objection Certificate<\/p>\n<p>to the petitioner, Kerala Co-operative Hospital Federation<\/p>\n<p>to conduct B.Sc. Nursing College at Thalassery with an<\/p>\n<p>intake of 50 students with the recognition of the Kannur<\/p>\n<p>University. Exts.P4 and P5 applications were made by the<\/p>\n<p>petitioners for affiliation in relation to B.Sc. Nursing Course<\/p>\n<p>and the Bachelor of Physiotherapy course on 30.12.2005.<\/p>\n<p>The extent of the land available with the institution for<\/p>\n<p>which affiliation was sought for, as shown in Ext.P5 is<\/p>\n<p>151.5 cents. It now turns out, that the property covered<\/p>\n<p>by Exts.R1(a) and R1(b) is situated in Thalassery.           It<\/p>\n<p>seems that during the currency of the said applications, the<\/p>\n<p>petitioner acquired an additional extent of 296.93 cents, as<\/p>\n<p>W.P.(C).NO.10056\/07<\/p>\n<p>                             :: 3 ::\n<\/p>\n<p>\npart of the same is in Mannayad, Thalassery and part in<\/p>\n<p>Andaloor in Dharmadom.         The details fo the same are<\/p>\n<p>given in Ext.P6.      Ext.P7 reminder was sent by the<\/p>\n<p>petitioner.   But by Exts.P8 and P9, the petitioner was<\/p>\n<p>informed that the applications for starting new colleges for<\/p>\n<p>the academic year 2006-07 were recommended by the<\/p>\n<p>Syndicate as there was no sufficient extent of land in the<\/p>\n<p>possession of the petitioner.       Permission was, therefore,<\/p>\n<p>granted to submit fresh applications during the academic<\/p>\n<p>year 2007-08 with all documents on or before 31.12.2006.<\/p>\n<p>I note that Exts.P8 and P9 were issued on 20.12.2006.<\/p>\n<p>          3. Exts.P8 and P9 were challenged in the writ<\/p>\n<p>petition as it was originally instituted. Thereafter, Exts.P10<\/p>\n<p>and P11 were issued by the University granting permission<\/p>\n<p>to submit applications after paying a fresh registration fee<\/p>\n<p>of Rs.20,000\/- and a late fee of Rs.5,000\/-. Exts.P8, P9,<\/p>\n<p>P10 and P11 are challenged in the writ petition.<\/p>\n<p>          4.    This court passed an interim order on<\/p>\n<p>3.4.2007 to the following effect:\n<\/p>\n<p>W.P.(C).NO.10056\/07<\/p>\n<p>                                  :: 4 ::\n<\/p>\n<p>\n             &#8220;There would be an interim direction to consider the<\/p>\n<p>      application of the petitioner for affiliation of courses applied<\/p>\n<p>      without insisting on payment of fee of Rs.25,000\/- each<\/p>\n<p>      again, since he had already paid earlier the fees.&#8221;<\/p>\n<p>          5.       Another interim order was passed on<\/p>\n<p>17.08.2007.\n<\/p>\n<blockquote><p>             &#8220;In view of Ext.P13 being available, there is<\/p>\n<p>      apparently no reason to refer the case of the petitioner to the<\/p>\n<p>      Government for its view as has been done by the University,<\/p>\n<p>      as evidenced by Ext.P2.       Hence, it is directed that the<\/p>\n<p>      Syndicate of the University will take up Exts.P4 and P5<\/p>\n<p>      applications and consider the same on the basis that the<\/p>\n<p>      Government has stated its no objection in Ext.P13<\/p>\n<p>      Government Order.        Let a final decision be taken as<\/p>\n<p>      aforesaid within an outer limit of three weeks from now and<\/p>\n<p>      place before this court.&#8221;<\/p>\n<blockquote><p>          6.     Thereupon, the University considered the<\/p>\n<p>application for affiliation on merits and passed Ext.P14<\/p>\n<p>order declining to grant affiliation, for the following<\/p>\n<p>reasons:\n<\/p><\/blockquote>\n<blockquote><p>      &#8220;1.     The land requirement as per the University rules is<\/p>\n<p>              not met by the educational agency.<\/p>\n<\/blockquote>\n<blockquote><p>        2.    The courses now being conducted are that of the<\/p>\n<p>              University as per Memorandum of Undertaking and<\/p>\n<p>              this  does    not   constitute     the   affiliation  of<\/p>\n<p>              college\/course.&#8221;\n<\/p><\/blockquote>\n<\/blockquote>\n<blockquote><p>W.P.(C).NO.10056\/07<\/p>\n<p>                           :: 5 ::\n<\/p><\/blockquote>\n<blockquote><\/blockquote>\n<p>Ext.P14 has been challenged in the amended writ petition.<\/p>\n<p>          7.   A counter affidavit has been filed by the<\/p>\n<p>University supporting Ext.P14. The petitioner has filed a<\/p>\n<p>reply affidavit.\n<\/p>\n<p>          8.   I heard learned counsel for the petitioner<\/p>\n<p>Sri.Mohammed Nias and the learned standing counsel for<\/p>\n<p>the Kannur University.\n<\/p>\n<p>          9.   Learned counsel for the petitioner submits<\/p>\n<p>that the reasons given in Ext.P14 are not tenable. The first<\/p>\n<p>reason given in Ext.P14 is that the extent of the land in the<\/p>\n<p>possession of the petitioner is not sufficient to start the<\/p>\n<p>Nursing College. It is contended that it is not open to the<\/p>\n<p>University to cite the alleged inadequacy of the extent of<\/p>\n<p>the land as the reason for declining affiliation. Reference is<\/p>\n<p>made, in this regard, to the Regulations issued by the<\/p>\n<p>Indian Council of Nursing, which governs the action taken<\/p>\n<p>by the competent body of the Indian Council in dealing<\/p>\n<p>with the application for approval of a course being<\/p>\n<p>conducted by any institution and comprehended by the<\/p>\n<p>Indian Nursing Council Act. It is contended that the extent<\/p>\n<p>W.P.(C).NO.10056\/07<\/p>\n<p>                           :: 6 ::\n<\/p>\n<p>\nof land is one of the aspects taken note of by the Central<\/p>\n<p>Government and if therefore, the Indian Nursing Council,<\/p>\n<p>as is evident by Ext.P2, granted the requisite approval,<\/p>\n<p>then those parameters which fell for consideration by the<\/p>\n<p>Indian Nursing Council cannot again be considered by the<\/p>\n<p>University while dealing with an application for affiliation.<\/p>\n<p>Reference in this regard is made to the law laid down by<\/p>\n<p>the Full Bench in <a href=\"\/doc\/193325499\/\">Vikram Sarabhai Educational Trust<\/p>\n<p>and B.Ed College v. University of Calicut and<\/a> another<\/p>\n<p>{2008(2)KHC 647}.\n<\/p>\n<p>         10. It is further pointed out that, at any rate, the<\/p>\n<p>suitable land required for the conduct of an institution<\/p>\n<p>offering B.Sc Nursing course is only 3 acres and since the<\/p>\n<p>petitioner had acquied an additional 2.96 acres, over and<\/p>\n<p>above the 3 acres, even the requirement insofar as the<\/p>\n<p>extent of land is concerned, was satisfied by the petitioner.<\/p>\n<p>The fact that the land subsequently acquired is not<\/p>\n<p>adjacent to the existing land is not a matter of concern,<\/p>\n<p>contends the learned counsel for the petitioner. There is<\/p>\n<p>no such requirement spelt out either by the Indian Nursing<\/p>\n<p>W.P.(C).NO.10056\/07<\/p>\n<p>                             :: 7 ::\n<\/p>\n<p>\nCouncil Act or for that matter, the University Act or the<\/p>\n<p>University First Statute.\n<\/p>\n<p>          11. Insofar as the second aspect mentioned in<\/p>\n<p>Ext.P14 is concerned, it is pointed out that the facilities<\/p>\n<p>available with the petitioner including the facilities available<\/p>\n<p>for the hospital have been found to be adequate and<\/p>\n<p>satisfactory by the Kannur University, when it entered into<\/p>\n<p>the Memorandum of Undertaking referred to in Ext.P5. If<\/p>\n<p>that be so, it is open to the petitioner to seek an affiliation<\/p>\n<p>on its own. Ext.P1 Memorandum of Undertaking will not<\/p>\n<p>derogate from the right of the owner of the land where a<\/p>\n<p>hospital has been established and the institution which<\/p>\n<p>runs a hospital as such, where the courses are being<\/p>\n<p>offered, it is contended.\n<\/p>\n<p>          12. I find force in the submission made by the<\/p>\n<p>learned counsel for the petitioner.      The major objection<\/p>\n<p>taken to deny affiliation, as is discernible from Ext.P14, and<\/p>\n<p>the extremely unsatisfactory counter affidavit filed by the<\/p>\n<p>University is that the extent of the land is not sufficient. I<\/p>\n<p>take note of the fact that firstly the Nursing Council did not<\/p>\n<p>W.P.(C).NO.10056\/07<\/p>\n<p>                            :: 8 ::\n<\/p>\n<p>\nconsider whether the extent of land available with the<\/p>\n<p>petitioner is either inadequate or insufficient to run the<\/p>\n<p>institution. If the Nursing Council, the competent authority<\/p>\n<p>under the Central Indian Nursing Council Act, considers the<\/p>\n<p>extent of the land available with the petitioner as<\/p>\n<p>adequate, to enable it to run the course B.Sc Nursing, then<\/p>\n<p>the self-same matters cannot be taken note of by the<\/p>\n<p>Kannur University to deny affiliation, unless it is a case<\/p>\n<p>where the order of approval granted by the Central Body is<\/p>\n<p>found to be vitiated by fraud or having been obtained by<\/p>\n<p>fraudulent means or it is a case where the particulars<\/p>\n<p>noted by the Central Body is palpably erroneous as to<\/p>\n<p>make the order vitiated by a fraudulent exercise of power.<\/p>\n<p>It is not open to the University, which is called upon to<\/p>\n<p>grant affiliation, to deny affiliation for a reason, which<\/p>\n<p>otherwise must be deemed to have been taken note of and<\/p>\n<p>found to be satisfactory by the Central Body. This is the<\/p>\n<p>law that has been laid down by the Supreme Court and this<\/p>\n<p>court, on several occasions and the law has been reiterated<\/p>\n<p>by the Full Bench of this court in Vikram Sarabhai<\/p>\n<p>W.P.(C).NO.10056\/07<\/p>\n<p>                           :: 9 ::\n<\/p>\n<p>\n<a href=\"\/doc\/1275434\/\">Educational Trust and B.Ed College v. University of<\/p>\n<p>Calicut and<\/a> another {2008(2)KHC 647}. It is not a<\/p>\n<p>case where Ext.P3 order of approval issued by the Indian<\/p>\n<p>Nursing Council is vitiated by fraud or that it has been<\/p>\n<p>obtained by fraudulent means. I also take note of Ext.P3<\/p>\n<p>No Objection Certificate issued by the Government and I<\/p>\n<p>find that there is no reason to disbelieve that the<\/p>\n<p>Government must have looked into all these aspects before<\/p>\n<p>it issued Ext.P3 No Objection Certificate.<\/p>\n<p>          13. Insofar as the second aspect is concerned,<\/p>\n<p>apart from the cryptic reasons stated in Ext.P14, I do not<\/p>\n<p>find any specific reference to this aspect in the counter<\/p>\n<p>affidavit.   I consider it appropriate to hold any such<\/p>\n<p>objection has been given up by the University or not<\/p>\n<p>seriously pursued. At any rate, the fact that the facilities<\/p>\n<p>available with the petitioner were considered to be<\/p>\n<p>sufficient by the Calicut University in the first instance for<\/p>\n<p>running the B.Sc Nursing course and thereafter by the<\/p>\n<p>respondent University from the year 2005 is noteworthy.<\/p>\n<p>W.P.(C).NO.10056\/07<\/p>\n<p>                               :: 10 ::\n<\/p>\n<p>\n          For all these reasons, I am of the view that<\/p>\n<p>Ext.P14 is unsustainable.         The writ petition is allowed.<\/p>\n<p>Ext.P14 is set aside. It is declared that the petitioner is<\/p>\n<p>entitled to get affiliation from Kannur University, to enable<\/p>\n<p>it to offer courses in B.Sc Nursing and Bachelor of<\/p>\n<p>Physiotherapy.
