Mishra, Counsel for the petitioners.\n      Shri Samdarshi Tiwari, G.A. for the respondents.<\/pre>\n<p>      This petition is directed against an order dated<br \/>\n22.11.2010 by which the II Civil Judge Class II, Mauganj<br \/>\ndistrict Rewa in civil Suit No.446-A\/09 rejected the application<br \/>\nfiled by the petitioners for summoning original khasra entries<br \/>\nfrom the office of the Collector under Order 13 Rule 10 C.P.C.\n<\/p>\n<p>      Learned counsel for the petitioners submitted that vide<br \/>\norder Annexure P-3 dated 25.9.2008, the Collector notified<br \/>\nthat the Khatoni of 1958-59 is in dilapidated condition and no<br \/>\ncertified copy shall be provided. However, if the documents<br \/>\nare required by the Court, the same shall be produced before<br \/>\nthe Court after the permission of the Collector.            The<br \/>\npetitioners could not get the certified copy of the Khatoni<br \/>\n1958-59 so petitioners moved an application before the trial<br \/>\nCourt for summoning the records but the trial Court rejected<br \/>\nthe same saying that there is no justification for summoning<br \/>\nof the records. It is submitted that without production of the<br \/>\nrelevant entries, petitioners cannot prove their case before<br \/>\nthe trial Court and the production of the aforesaid document<br \/>\nis necessary for the just decision of the case.\n<\/p>\n<p>      Considering the peculiar facts of the case, we direct the<br \/>\nlearned Govt. Advocate to seek instructions from the<br \/>\nCollector, Rewa in the matter and to apprise this Court why<br \/>\nthe documents of 1958-59 cannot be converted into<br \/>\nelectronic records so that the transportation of the records<br \/>\nmay be avoided and on demand the requisite copies may be\n<\/p>\n<p>                                                              2&#8230;..\n<\/p>\n<p>                 W.P.17223 of 2010<\/p>\n<p>06.12.2010.\n<\/p>\n<p>provided from the electronic records.\n<\/p>\n<p>      Shri Tiwari prays for a short time to seek instructions in<br \/>\nthis regard.\n<\/p>\n<p>      Issue show cause notice to the respondents.
