Justice M.SASIDHARAN NAMBIAR\n\n Dated :13\/07\/2009\n\n O R D E R\n             M.Sasidharan Nambiar, J.\n            --------------------------\n             Tr.P.(Crl.)No.65 of 2009\n            --------------------------\n\n                       ORDER\n<\/pre>\n<p>    Petitioner is the defacto complainant in C.C.<\/p>\n<p>No.710\/2007 on the file of Judicial First Class<\/p>\n<p>Magistrate&#8217;s Court, Chittur.   First respondent is<\/p>\n<p>the accused and husband of the petitioner. The<\/p>\n<p>offences alleged against first respondent are under<\/p>\n<p>Sections 498A and 495 of Indian Penal Code. This<\/p>\n<p>petition is filed to transfer the case to Judicial<\/p>\n<p>First  Class   Magistrate&#8217;s   Court,   Kunnamangalam<\/p>\n<p>contending that petitioner and her mother and one<\/p>\n<p>more witness, who are to be examined in the case,<\/p>\n<p>are residents of Kozhikode and they are not in a<\/p>\n<p>position to travel to Chittur and therefore, the<\/p>\n<p>case is to be transferred to Kunnamangalam.   It is<\/p>\n<p>contended that original complaint was filed before<\/p>\n<p>Kunnamangalam Police and was transferred to Chittur<\/p>\n<p>and  a  final  report  was  submitted  therein  and<\/p>\n<p>considering the health condition of the petitioner<\/p>\n<p><span class=\"hidden_text\">TPCR 65\/09                2<\/span><\/p>\n<p>and also the mother of the petitioner, who is aged<\/p>\n<p>76, the case is to be transferred.\n<\/p>\n<p>     2.Learned counsel appearing for the petitioners<\/p>\n<p>and first respondent and learned Public Prosecutor<\/p>\n<p>were heard.\n<\/p>\n<p>     3. Learned counsel appearing for the petitioners<\/p>\n<p>submitted that there is nobody else, apart from the<\/p>\n<p>petitioner and her mother, to assist them and it is<\/p>\n<p>not possible for them to travel to Chittur and give<\/p>\n<p>evidence, especially due to the health condition of<\/p>\n<p>the petitioner and also the aged mother of the<\/p>\n<p>petitioner  and   therefore,  the  case  is   to  be<\/p>\n<p>transferred to Kunnamangalam.\n<\/p>\n<p>     4. Learned counsel appearing for the first<\/p>\n<p>respondent   submitted  that   first  respondent  is<\/p>\n<p>suffering from heart ailment and he cannot travel<\/p>\n<p>to Kunnamangalam and in such circumstances, the<\/p>\n<p>case may not be transferred to Kunnamangalam.<\/p>\n<p>     5. Learned Public Prosecutor submitted that one<\/p>\n<p>witness has already been examined by the Magistrate,<\/p>\n<p><span class=\"hidden_text\">TPCR 65\/09                3<\/span><\/p>\n<p>Chittur and the other witnesses, namely, petitioner<\/p>\n<p>and her mother and other witness did not appear.<\/p>\n<p>     6.    When first respondent\/accused also raises<\/p>\n<p>an objection on health ground, it is not possible<\/p>\n<p>to order transfer as sought for.    If the grievance<\/p>\n<p>of the petitioners is that they will be compelled<\/p>\n<p>to travel to Chittur on several occasions, it could<\/p>\n<p>be avoided by directing the Magistrate to examine<\/p>\n<p>the petitioner and her mother on a particular day<\/p>\n<p>fixed     for that  purpose.
