MAHTO, S\/O RAM CHANDRA\n                   MAHATO,    R\/O    VILLAGE    RAJE,    P.S\n                   MANIGACHHI, DISTRICT DARBHANGA.\n                                          .....................PETITIONER.\n\n                                     VERSUS\n                   THE STATE OF BIHAR.\n                                    ...........................OPPOSITE PARTY.\n                           -----------\n<\/pre>\n<p>03\/   24.10.2011         No one appears for the petitioner.<\/p>\n<p>                           The petitioner has been made accused<\/p>\n<p>                   for the offences punishable under Section<\/p>\n<p>                   47-(a)(f) of Excise Act and is in custody<\/p>\n<p>                   since, 11.08.2011.\n<\/p>\n<p>                           In the bail application it has been<\/p>\n<p>                   mentioned that the petitioner has got no<\/p>\n<p>                   criminal    antecedent      and   that   he    had   no<\/p>\n<p>                   concern     with    Shambhu   Chaupal    and       Suraj<\/p>\n<p>                   Mandal, who are said to be the main persons<\/p>\n<p>                   responsible for the alleged act of storage<\/p>\n<p>                   of 100 litres of spirit and 500 sachets of<\/p>\n<p>                   400 ml contained in four bags apart from<\/p>\n<p>                   200 litres of country made liquor etc.<\/p>\n<p>                           This Court taking into account that<\/p>\n<p>                   the petitioner is the first offender for<\/p>\n<p>                   the offences punishable under Section 47 of<\/p>\n<p>                   the Excise Act and has remained in custody<\/p>\n<p>                   for a period of almost three months, this<\/p>\n<p>                   Court     would    direct   for   release     of     the<br \/>\n<span class=\"hidden_text\">                                2<\/span><\/p>\n<p>         petitioner, namely, Santosh Kumar Mahto on<\/p>\n<p>         bail    on     furnishing           of   bail   bond    of    Rs.<\/p>\n<p>         10,000\/- (ten thousand) with two sureties<\/p>\n<p>         of the like amount each to the satisfaction<\/p>\n<p>         of the Chief Judicial Magistrate, Darbhanga<\/p>\n<p>         at     Laheriasarai            in    connection        with   O.<\/p>\n<p>         (Excise) Case No. 41 of 2011 subject to the<\/p>\n<p>         following three conditions:-<\/p>\n<pre>                i)    The      two       bail       bonds   will       be\n\n         furnished,       one      by    the      Government     servant\n\n<\/pre>\n<p>         and the other by a close family relative.<\/p>\n<p>                (ii) The petitioner will remain present<\/p>\n<p>         in course of trial on each and every day<\/p>\n<p>         and his absence even for a single day would<\/p>\n<p>         automatically          entail        the   consequences       of<\/p>\n<p>         cancellation of his bail.\n<\/p>\n<p>                (iii)    The       petitioner       in   case    is    now<\/p>\n<p>         made accused in any other criminal case,<\/p>\n<p>         that would itself lead to cancellation of<\/p>\n<p>         his bail.\n<\/p>\n<\/p>\n<pre>Ranjan                                       (Mihir Kumar Jha, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Santosh Kr.
