Singh, Advocate<br \/>\n              for the petitioner.\n<\/p>\n<p>              Mr. Harish Rathee, Sr. DAG, Haryana.\n<\/p>\n<p>\nAJAY TEWARI J.\n<\/p>\n<p>              The husband of the petitioner was murdered while on duty on<\/p>\n<p>23.06.1998.    She applied for compassionate appointment of her son on<\/p>\n<p>08.09.1998 as per the Government instructions under ex-gratia schemes on<\/p>\n<p>attaining majority as per the existing instructions and practices and the name<\/p>\n<p>of the son of the petitioner was kept on the waiting register at Sr. No.31 on<\/p>\n<p>17.09.1998.\n<\/p>\n<p>              Learned counsel for the petitioner states that in the year 2003,<\/p>\n<p>Government of Haryana framed rules on compassionate appointment and<\/p>\n<p>also made a provision for grant of assistance to the tune of Rs.2.50 lakh in<\/p>\n<p>case the family of the deceased Government employee opts for the same or<\/p>\n<p>there is no vacancy to be offered to the dependents. Vide letter dated<\/p>\n<p>06.12.2005, she was informed that no financial assistance could be given to<\/p>\n<p>her under the 2003 Rules as the benefit of compassionate appointment or<br \/>\n<span class=\"hidden_text\"> CWP No.13407 of 2008                                        -2-<\/span><\/p>\n<p>financial assistance could only be given within three years and as three<\/p>\n<p>years had already passed so no benefit could be granted to the petitioner.<\/p>\n<p>             It is further stated that in the year 2005 Government again<\/p>\n<p>framed rules regarding appointment on compassionate ground. The lump<\/p>\n<p>sum amount of financial compensation was increased to Rs.5.00 lacs. As<\/p>\n<p>matters stand, neither she or her son was given a job nor the lump sum<\/p>\n<p>assistance, which has resulted in the filing of this writ petition.<\/p>\n<p>             Learned counsel for the petitioner has restricted his claim to the<\/p>\n<p>grant of assistance under the Haryana Compassionate Assistance to the<\/p>\n<p>Dependents of the Deceased Government Employees Rules, 2006 policy.<\/p>\n<p>Clauses 6 and 8 of which are reproduced herein below:-<\/p>\n<blockquote><p>                 &#8220;6. All pending cases of ex-gratia assistance shall be<\/p>\n<p>                 covered under the new rules. The calculation of the period<\/p>\n<p>                 and payment shall be made to such cases from the date of<\/p>\n<p>                 notification of these rules. However, the families will have<\/p>\n<p>                 the option to opt for the lump sum ex-gratia grant provided<\/p>\n<p>                 in the Rules, 2003 or 2005, as the case may be, in lieu of the<\/p>\n<p>                 monthly financial assistance provided under the Haryana<\/p>\n<p>                 Compassionate Assistance to the Dependents of the<\/p>\n<p>                 Deceased Government Employees Rules, 2006.<\/p>\n<\/blockquote>\n<blockquote><p>                 8.   The   Haryana     Compassionate      Assistance   to   the<\/p>\n<p>                 Dependents of Deceased Government Employees Rules,<\/p>\n<p>                 2005, which are in force immediately before the<\/p>\n<p>                 commencement of these rules are hereby repealed:<\/p>\n<\/blockquote>\n<blockquote><p>                        Provided that families will have the option to opt for<\/p>\n<p>                 the lump sum ex-gratia grant provided in the rules 2003 or<br \/>\n<span class=\"hidden_text\"> CWP No.13407 of 2008                                     -3-<\/span><\/p>\n<p>                2005, as the case may be, in lieu of the monthly financial<\/p>\n<p>                assistance provided under these rules:\n<\/p><\/blockquote>\n<blockquote><p>                       Provided further that in all pending cases where the<\/p>\n<p>                family exercises the option to receive the financial<\/p>\n<p>                assistance under these rules, the calculation of the period<\/p>\n<p>                and payment shall be made from the date of notification of<\/p>\n<p>                these rules.&#8221;<\/p><\/blockquote>\n<p>            In view of the above, learned counsel for the petitioner states<\/p>\n<p>that the petitioner would be satisfied if the assistance be granted to the<\/p>\n<p>petitioner in terms of Clauses 6 and 8 (supra).\n<\/p>\n<p>            Learned counsel for the petitioner has relied upon the case of<\/p>\n<p>Raj Kumari V. Uttar Haryana Bijli Vitran Nigam Ltd. and others<\/p>\n<p>reported as 2008(4) RSJ 765 wherein a Division Bench of this Court held as<\/p>\n<p>follows:-\n<\/p>\n<blockquote><p>                 &#8220;6.   All pending cases of ex-gratia assistance shall be<\/p>\n<p>                 covered under the new rules &#8211; The calculation of the period<\/p>\n<p>                 and payment shall be made to such cases from the date of<\/p>\n<p>                 notification of these rules. However, the families will have<\/p>\n<p>                 the option to opt for the lump sum ex-gratia grant provided.<\/p>\n<p>                 In the Rules, 2003 or 2005, as the case may be, in lieu of<\/p>\n<p>                 the monthly financial assistance provided under the<\/p>\n<p>                 Haryana Compassionate Assistance to the Dependents of<\/p>\n<p>                 the Deceased Government Employees Rules, 2006.&#8221;<\/p>\n<\/blockquote>\n<blockquote><p>                       A perusal of the aforementioned rule shows that all<\/p>\n<p>                 pending cases of ex-gratia assistance are to be covered<\/p>\n<p>                 under the 2006 Rules and the payments is required to be<br \/>\n<span class=\"hidden_text\"> CWP No.13407 of 2008                                 -4-<\/span><\/p>\n<p>             made from the date of notification of these rules i.e.<\/p>\n<p>             1.8.2006 (P-9). An option has been given to the families to<\/p>\n<p>             opt for lump sum ex-gratia grant provided in the 2003<\/p>\n<p>             Rules or 2005 Rules in lieu of the monthly financial<\/p>\n<p>             assistance under the 2006 Rules.           Accordingly, the<\/p>\n<p>             petitioner has been rightly given the benefit of these rules<\/p>\n<p>             by passing order dated 13.03.2007 (P-5).\n<\/p><\/blockquote>\n<blockquote><p>             8.    The action of the respondents in withdrawing order<\/p>\n<p>             dated 13.03.2007 on account of subsequent amendment, on<\/p>\n<p>             that basis the amendment made by the State of Haryana on<\/p>\n<p>             9.8.2007 (R-1) is absolutely unwarranted and, therefore,<\/p>\n<p>             unsustainable in the eyes of law because the 2006 Rules<\/p>\n<p>             have been framed under Article 309 of the Constitution and<\/p>\n<p>             the letter dated 9.8.2007 (R-1) has been issued by the<\/p>\n<p>             Financial Commissioner and Principal Secretary to<\/p>\n<p>             Government of Haryana. It is well settled that an order<\/p>\n<p>             passed by the Financial Commissioner cannot have the<\/p>\n<p>             effect of wiping the rules framed under Article 309 of the<\/p>\n<p>             Constitution, which in the present case were framed on<\/p>\n<p>             1.8.2006 (P-9).     A perusal of the notification dated<\/p>\n<p>             1.8.2006 shows that the 2006 Rules have been framed<\/p>\n<p>             under Article 309 of the Constitution. It is trite to observe<\/p>\n<p>             that the rules framed under Article 309 of the Constitution<\/p>\n<p>             cannot be varied, substituted or amended even by issuing<\/p>\n<p>             executive   instructions   under    Article   162   of   the<\/p>\n<p>             Constitution. In that regard reliance may be placed on a<br \/>\n<span class=\"hidden_text\"> CWP No.13407 of 2008                                      -5-<\/span><\/p>\n<p>                 Constitution Bench judgment of Hon&#8217;ble the Supreme<\/p>\n<p>                 Court in the case of Sant Ram Sharma Vs. State of<\/p>\n<p>                 Rajasthan, AIR 1967 SC 1910, which has been repeatedly<\/p>\n<p>                 followed, relied and applied in a number of cases including<\/p>\n<p>                 Dhananjay Malik Vs. State of Uttaranchal, 2008(4) SCC<\/p>\n<p>                 171 and A. Manoharan vs. Union of India, 2008(3) SCC<\/p>\n<p>                 641, wherein it has been held that in any case such<\/p>\n<p>                 executive instructions cannot be given retrospective effect.<\/p>\n<p>                 In the present case, a letter issued by the Financial<\/p>\n<p>                 Commissioner, which can not even regarded as executive<\/p>\n<p>                 instructions under Article 162 of the Constitution, has been<\/p>\n<p>                 relied upon by the respondents to argue that the 2006 Rules<\/p>\n<p>                 framed under Article 309 of the Constitution (P-9) stand<\/p>\n<p>                 abrogated to adversely affect the rights of the petitioner.<\/p>\n<p>                 Such an argument apparently would not be acceptable.<\/p>\n<\/blockquote>\n<blockquote><p>                       The petition stands disposed of in the above terms.&#8221;<\/p><\/blockquote>\n<p>            Consequently, this writ petition is allowed and the relief now<\/p>\n<p>sought by the learned counsel for the petitioner is granted. The respondents<\/p>\n<p>are directed to accept option of the petitioner for assistance as per 2006<\/p>\n<p>policy.
