GOVERNMENT PLEADER for Respondent(s) :\n1, \nUNSERVED-REFUSED (N) for Respondent(s) : 2, \nMR DIPAK R DAVE\nfor Respondent(s) : 3, \nMR SAVAN N PANDYA for Respondent(s) :\n3, \n=========================================================\n\n\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE K.M.THAKER\n\t\t\n\t\n\n \n\nDate\n: 14\/07\/2008  \nORAL ORDER<\/pre>\n<p>\t\tThe<br \/>\npetitioner has preferred this petition against the  inaction on the<br \/>\npart of respondent No.1 and not executing the recovery certificate<br \/>\nissued way back in September 2003 for an amount of Rs. 51,330\/-.\n<\/p>\n<p>2.\t\tToday,<br \/>\nMr. Pandya, AGP appearing for respondent No.1 states that he has<br \/>\nreceived instructions, however reply affidavit on basis of<br \/>\ninstructions could not be prepared and finalised.  He also stated as<br \/>\nper information available to respondent No.1 that the respondent No.3<br \/>\nwas ready and willing to pay the amount in question.  It is clarified<br \/>\nand explained to Mr. Pandya, AGP appearing on behalf of respondent<br \/>\nNo.1 that the readiness on part of the respondent No.3 to pay the<br \/>\namount in question to the petitioner and\/or today&#8217;s order in present<br \/>\npetition shall not absolve the respondent No.1 or his office from<br \/>\nexplaining the inordinate delay caused and lethargy exhibited in not<br \/>\nexecuting the recovery certificate and the same shall have to be<br \/>\nexplained by way of affidavit.\n<\/p>\n<p>3.\t\tMr.\n<\/p>\n<p>Dave appears for respondent No.3.  Mr. Dave submitted that actually<br \/>\nthe workman was employed by respondent No.2 however subsequently the<br \/>\nrespondent No.3 has taken over the establishment and affairs of said<br \/>\nrespondent No.2 namely Techno Field Marketing Pvt.Ltd.  He further<br \/>\nsubmitted that the present petitioner has preferred Reference<br \/>\nproceedings against the respondent No.2 and has also impleaded<br \/>\npresent respondent No.3 herein in the said proceedings.<br \/>\nSimultaneously, this subject recovery proceedings were also initiated<br \/>\nby the present petitioner claiming diverse amounts in which the<br \/>\nsubject ex-parte order came to be passed and thereafter the recovery<br \/>\ncertificate in question was issued.   He has also submitted that the<br \/>\nReference proceedings also have culminated into an ex-parte award due<br \/>\nto non-appearance of respondent No.2, however, respondent No.3 has<br \/>\nnow preferred miscellaneous application under Rule 26-A for<br \/>\nrestoration of the said proceedings and the same is pending.   In<br \/>\nthis background, Mr. Dave, for respondent No.3, submitted that the<br \/>\nrespondent No.3 will not, in future, seek to reopen the said recovery<br \/>\napplication&#8217;s proceedings which have culminated into subject recovery<br \/>\ncertificate, and, the respondent No.3 shall make payment of the<br \/>\namount in question, i.e., Rs. 51,330\/- however this would be  without<br \/>\nprejudice to the rights and contentions of respondent No.3 in the<br \/>\nReference proceedings and the miscellaneous application  under Rule<br \/>\n26-A.  The offer and request of respondent No.3 appears to be<br \/>\nreasonable.   In that view of the matter, it appears that the<br \/>\nfollowing directions would meet the ends of justice;\n<\/p>\n<p>(1)\t\tThe<br \/>\nrespondent No.1 shall file affidavit explaining the inordinate delay<br \/>\nin respect of the recovery certificate issued in September 2003 since<br \/>\nall these 5 years the said certificate has not been executed;\n<\/p>\n<p>(2)\t\tThe<br \/>\nrespondent No.3 shall pay the said amount of Rs. 51,330\/- on or<br \/>\nbefore 25th July, 2008 to the petitioner herein by way of<br \/>\nan account payee cheque drawn in  name of  the petitioner;\n<\/p>\n<p>(3)\t\tIt<br \/>\nis clarified that the said payment by the respondent No.3 will not<br \/>\ncome in its way in prosecuting the miscellaneous application for<br \/>\nrestoration and\/or in defending the Reference proceedings if and when<br \/>\nthe same are restored by the Labour Court after examining the<br \/>\nmiscellaneous application on its merits.  It is also clarified that<br \/>\nthe restoration application as well as other proceedings will be<br \/>\ndecided by the Labour Court independently without being influenced by<br \/>\nthis order and\/or payment of the aforesaid amount and this order  or<br \/>\nsubmission of respondent No.3 are not to be construed to mean that<br \/>\nthe miscellaneous application for restoration is to be allowed.  The<br \/>\nsame shall be decided on its own merits.\n<\/p>\n<p>(4)\t\tIt<br \/>\nis also clarified that the aforesaid clarification shall not,<br \/>\nhowever,be used by the respondent No.3 for reopening the proceedings<br \/>\nconcerning the recovery certificate and\/or the recovery application<br \/>\nin which the order directing payment of Rs. 51,330\/- came to be<br \/>\npassed.  The said payment shall, for all purposes, close the<br \/>\nproceedings relating to the said demand.\n<\/p>\n<p>4.\t\tWith<br \/>\nthe aforesaid observations and directions, the petition is disposed<br \/>\nof.
