S.J. MUKHOPADHAYA)<\/p>\n<p>\tThe<br \/>\npetitioner, who is one of the share-holder of Surendranagar Peoples<br \/>\nCo. Bank Limited, Surendranagar, and who has also certain deposits<br \/>\nwith the said Bank, has preferred the writ petition to direct the<br \/>\nrespondents to make sufficient arrangements for payment of deposits<br \/>\nof the petitioner and to initiate action against the defaulting<br \/>\noffice bearers of the said Bank.\n<\/p>\n<p>\tAs<br \/>\nit appears that there is an allegation of fraud levelled against the<br \/>\nofficers of the Cooperative Bank, and as the matter relates to<br \/>\npayment of deposits against the Cooperative Bank, we are not inclined<br \/>\nto issue writ on the Cooperative Bank, against which no writ petition<br \/>\nunder Article 226 of the Constitution is maintainable.  Further, we<br \/>\nfind no case is made out to refer the case to the Reserve Bank of<br \/>\nIndia.\n<\/p>\n<p>\tSo<br \/>\nfar as taking action against the office bearers of the Cooperative<br \/>\nBank is concerned, learned counsel for the petitioner submitted that<br \/>\nthe petitioner has already lodged F.I.R., and the matter is pending<br \/>\nconsideration before the<br \/>\nMagistrate.  In this view of the matter, no further order is required<br \/>\nto be passed with regard to said allegation, and the petitioner may<br \/>\npursue the matter before the Court below.
