Sri Krishna Pandey, son of Late Ganga Pandey\n                         All are resident of village Laukariya, P.S. - Bairiya, District\n                         - West Champaran.\n                                                                       ------ Petitioners.\n                                                  Versus\n                   The State of Bihar                      -------Opposite Party\n                                                  --------\n<\/pre>\n<p>02.   26.08.2011                      Heard learned counsel for the petitioners and<\/p>\n<p>                        learned Additional Public Prosecutor for the State.<\/p>\n<p>                                      All the eight petitioners, apprehending their<\/p>\n<p>                        arrest   in    connection   with   Bairiya   P.S.    Case   No.<\/p>\n<p>                        187\/2010,        pending in the court of Chief Judicial<\/p>\n<p>                        Magistrate,     West   Champaran,     Bettiah,      are   named<\/p>\n<p>                        accused in this case relating to land dispute and<\/p>\n<p>                        inflicting injuries upon the informant and others.<\/p>\n<p>                                      After some arguments, learned counsel for the<\/p>\n<p>                        petitioners seeks permission to withdraw this application<\/p>\n<p>                        with respect to petitioner no. 4 namely, Nirbhay Kumar<\/p>\n<p>                        Pandey @ Nirbhay Pandey, with a liberty to surrender<\/p>\n<p>                        before the court below within a fortnight and seek regular<\/p>\n<p>                        bail.\n<\/p>\n<p>                                      Permission is granted. On such prayer, regular<\/p>\n<p>                        bail of the petitioner no. 4 may be considered by the court<\/p>\n<p>                        below on its own merit without being prejudice of instant<\/p>\n<p>                        withdrawal.\n<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>                        Accordingly, this application stands disposed<\/p>\n<p>          of as withdrawn with respect to petitioner no. 2 namely,<\/p>\n<p>          Nirbhay Kumar Pandey @ Nirbhay Pandey.<\/p>\n<p>                        So far as remaining seven petitioners are<\/p>\n<p>          concerned, though named, but nothing specific attributed<\/p>\n<p>          against them. There is counter version also by way of<\/p>\n<p>          Bariya P.S. Case No. 197\/2010.\n<\/p>\n<p>                        Considering the facts and circumstances of the<\/p>\n<p>          case, in the event of their arrest or surrender within a<\/p>\n<p>          period   of    four   weeks,    let   the   above-named    seven<\/p>\n<p>          petitioners     namely,    Jogrosan     Choubey    @   Jagrasan<\/p>\n<p>          Choubey, Dhuman Choubey, Abhay Pandey, Manoranjan<\/p>\n<p>          Choubey, Baliram Choubey, Mantosh Choubey and Sri<\/p>\n<p>          Krishna Pandey, be enlarged on bail on furnishing bail<\/p>\n<p>          bond of sum of Rs. 10,000\/- (ten thousand only) each<\/p>\n<p>          with two sureties of the like amount each to the<\/p>\n<p>          satisfaction     of   Chief     Judicial     Magistrate,   West<\/p>\n<p>          Champaran, Bettiah, in connection with Bairiya P.S.<\/p>\n<p>          Case No. 187\/2010, subject to condition under section<\/p>\n<p>          438(2) of the Code of Criminal Procedure, and additional<\/p>\n<p>          condition to attend the court regularly at least for two<\/p>\n<p>          years or till disposal of the case, whichever is earlier and<\/p>\n<p>          in the event of failure on two consecutive dates, without<\/p>\n<p>          any reasonable explanation, the privilege granted shall be<\/p>\n<p>          deemed to be cancelled.\n<\/p>\n<\/p>\n<pre>Rajeev\/                             ( Akhilesh Chandra, J.)\n <\/pre>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211; Orders Jogrosan Choubey @ Jagrasan &#8230; vs The State Of Bihar on 26 August, 2011 IN THE HIGH COURT OF JUDICATURE AT PATNA Criminal Miscellaneous No.25877 of 2011 1.
