Pathak, AGP for\nRespondent(s) : 1-2. \n======================================\n \n\t  \n\t \n\t  \n\t\t \n\t\t\t \n\nCORAM\n\t\t\t: \n\t\t\t\n\t\t\n\t\t \n\t\t\t \n\nHONOURABLE\n\t\t\tMR.JUSTICE RAJESH H.SHUKLA\n\t\t\n\t\n\n \n\n \n \n\n\n \n\nDate\n: 27\/08\/2008 \n\n \n\n \n \nORAL\nORDER<\/pre>\n<p>\t\tThe<br \/>\npresent petition has been filed by the petitioner challenging the<br \/>\norder dated 23rd April, 2008 at Annexure-A whereby the<br \/>\npunishment of deduction of an amount of Rs.500\/- per month from the<br \/>\npension of the petitioner for a period of two years is imposed.\n<\/p>\n<p>2.\t\tThe<br \/>\nfacts of the case briefly stated are that the petitioner was facing a<br \/>\ndepartmental inquiry as well as criminal case for misappropriation of<br \/>\nRs.3,939\/- while working as a Talati-cum-Mantri. It is averred that<br \/>\nthe criminal case has resulted in his acquittal, though some<br \/>\nproceedings are pending before the learned Sessions Judge. As<br \/>\nreflected in the impugned order, the departmental inquiry was also<br \/>\nconducted and on the basis of the report of the Inquiry Officer, the<br \/>\nimpugned decision has been taken.\n<\/p>\n<p>3.\t\tMr.\n<\/p>\n<p>Sikander Saiyed, learned Advocate for the petitioner, submitted that<br \/>\nno opportunity of personal hearing has been afforded to the<br \/>\npetitioner and the principles of natural justice have been violated<br \/>\nand therefore, the impugned order is bad and illegal. He has further<br \/>\ntried to emphasis that in the criminal case, the petitioner has been<br \/>\nacquitted and holding of the departmental inquiry was only with a<br \/>\nview to cause harassment and hardships to the petitioner. He,<br \/>\ntherefore, submitted that the impugned order may be quashed and set<br \/>\naside.\n<\/p>\n<p>4.\t\tAs<br \/>\nit transpires from the impugned order itself, the petitioner may have<br \/>\nbeen acquitted in the criminal case by the trial Court, but,<br \/>\nproceedings are pending before the learned Sessions Court. It also<br \/>\ntranspires from the impugned order itself that the departmental<br \/>\ninquiry was held and on the basis of the report of the Inquiry<br \/>\nOfficer, the impugned decision has been taken. It also appears that<br \/>\nbefore imposing the punishment upon the petitioner, a show cause<br \/>\nnotice dated 6th March, 2007 has also been given to the<br \/>\npetitioner and in pursuance thereof, the petitioner had also given<br \/>\nhis reply on 10th April, 2007.  Therefore, after<br \/>\nconsidering all these aspects, the impugned order has been passed and<br \/>\nthe submissions that no opportunity of hearing has been given to the<br \/>\npetitioner and the rules of principles of natural justice have been<br \/>\nviolated, are misconceived.\n<\/p>\n<p>5.\t\tIn<br \/>\nthat view of the matter, it is well settled that normally, the Court<br \/>\nshould not interfere in the quantum of punishment, as observed by the<br \/>\nHonourable Apex Court in a catena of decisions. The<br \/>\nHonourable Apex Court, in its judgement in the case of L&amp;<a href=\"\/doc\/1345098\/\">T<br \/>\nKomatsu Ltd. vs. N. Udayakumar,<\/a><br \/>\nreported in (2008) 1 SCC 224,<br \/>\nreferring to the earlier judgement in the case of <a href=\"\/doc\/109584\/\">M.P.<br \/>\nElectricity Board vs. Jagdish Chandra Sharma,<\/a><br \/>\nreported in (2005) 3 SCC 401,<br \/>\nhas observed thus:\n<\/p>\n<p> &#8230;..\n<\/p>\n<p>\tSimilarly, the High Court gets jurisdiction to interfere with the<br \/>\npunishment in exercise of its jurisdiction under Article 226 of the<br \/>\nConstitution only when it finds that the punishment imposed, is<br \/>\nshockingly disproportionate to the charge proved. &#8230;..\n<\/p>\n<p>\t\tIn<br \/>\nthis very judgement, the Honourable Apex Court has also observed as<br \/>\nunder:\n<\/p>\n<p> In<br \/>\nrecent times, there is an increasing evidence of this, perhaps<br \/>\nwell-meant but wholly unsustainable, tendency towards a denudation of<br \/>\nthe legitimacy of judicial reasoning and process. The reliefs granted<br \/>\nby the Courts must be seen to be logical and tenable within the<br \/>\nframework of the law and should not incur and justify the criticism<br \/>\nthat the jurisdiction of the courts tends to degenerate into<br \/>\nmisplaced sympathy, generosity and private benevolence. It is<br \/>\nessential to maintain the integrity of legal reasoning and the<br \/>\nlegitimacy of the conclusions. They must emanate logically from the<br \/>\nlegal findings and the judicial results must be seen to be principled<br \/>\nand supportable on those findings. Expansive judicial mood of<br \/>\nmistaken and misplaced compassion at the expense of the legitimacy of<br \/>\nthe process will eventually lead to mutually irreconcilable<br \/>\nsituations and denude the judicial process of its dignity, authority,<br \/>\npredictability and respectability. <a href=\"\/doc\/1279566\/\">(See Kerala Solvent Extractions<br \/>\nLtd. v. A. Unnikrishnan).<\/a>\n<\/p>\n<p>6.\t\tIn<br \/>\nview of the above, considering the aforesaid observations of the<br \/>\nHonourable Apex Court and the fact that the punishment of deduction<br \/>\nof Rs.500\/- from the monthly pension of the petitioner is inflicted<br \/>\nfor a period of two years only, it cannot be said to be<br \/>\ndisproportionate to the charges regarding misappropriation levelled<br \/>\nagainst the petitioner. Therefore, no interference is called for in<br \/>\nthe present petition and the petition requires to be dismissed.<br \/>\nAccordingly, it is dismissed in limine.\n<\/p>\n<p>[Rajesh<br \/>\nH.
