Sood waives service of rule for respondent-Insurance<br \/>\nCompany.\n<\/p>\n<p>2.0\tThis<br \/>\napplication has been preferred by the applicants-original claimants<br \/>\nseeking orders for disbursement of amount which is deposited in the<br \/>\nname of the Nazir of the Tribunal at Ahmedabad.\n<\/p>\n<p>3.0\tIt<br \/>\nis stated by learned Advocate Mr. Nagesh Sood for the respondent-<br \/>\nInsurance company that the Insurance Company had already deposited<br \/>\nthe entire awarded amount of Rs.3,26,925\/- on 11.03.2010 as per the<br \/>\norder passed by this Court on 12.05.2010, which amount has been<br \/>\ninvested in Fixed Deposit with a nationalized bank in the name of the<br \/>\nNazir of the Tribunal for a period of six years.\n<\/p>\n<p>4.0\tIt<br \/>\nis required to be noted that when the order dated 12.05.2010 was<br \/>\npassed by this Court, the learned Advocate Mr. Shailesh C. Sharma<br \/>\nappearing for respondents no.1 and 2 &#8211; original claimants<br \/>\nremained absent.  Hence the entire awarded amount was directed to be<br \/>\ninvested in the name of Nazir of the Tribunal. However, it was<br \/>\nobserved in the aforesaid order that it would be open to the original<br \/>\nclaimants to move appropriate application for modification of the<br \/>\norder or for disbursement. The applicants-original claimants have<br \/>\ntherefore filed the present application for disbursement of the<br \/>\namount.\n<\/p>\n<p>5.0\tIt<br \/>\nis pertinent to note that in the main appeal being First Appeal<br \/>\nNo.580 of 2010, the present respondent-original appellant has<br \/>\nchallenged the amount of only Rs.76000\/-, meaning thereby, the<br \/>\nappellant has restricted their claim in appeal to the extent of<br \/>\nRs.76000\/-. Under these circumstances the Tribunal is directed to<br \/>\nreinvest the entire amount as under:\n<\/p>\n<p>Sum<br \/>\n\tof Rs.76000\/- with proportionate costs and interest shall be<br \/>\n\tinvested in a fixed deposit with any nationalized bank in the name<br \/>\n\tof the Nazir of the Tribunal initially for a period of five years<br \/>\n\twith cumulative effect, meaning thereby, the original claimants<br \/>\n\tshall not be permitted to withdraw the periodical interest on the<br \/>\n\tsame. The said deposit shall be renewed from time to time till the<br \/>\n\tdisposal of the appeal. There shall not be any loan and\/or advance<br \/>\n\ton the aforesaid fixed deposit, without prior permission of this<br \/>\n\tCourt and the Fixed Deposit Receipt shall be retained with the Nazir<br \/>\n\tof the Tribunal.\n<\/p>\n<p>The<br \/>\n\tTribunal is further directed to invest 75% of the remaining amount<br \/>\n\twith proportionate costs and interest in fixed deposit with any<br \/>\n\tnationalized bank in the joint names of Nazir of the Tribunal and<br \/>\n\toriginal claimants initially for a period of five years, which shall<br \/>\n\tbe renewed from time to time  till the disposal of the appeal. There<br \/>\n\tshall not be any loan and\/or advance on the aforesaid fixed deposit,<br \/>\n\twithout prior permission of this Court and the Fixed Deposit Receipt<br \/>\n\tshall be retained with the Nazir of the Tribunal. The original<br \/>\n\tclaimants shall be permitted to withdraw periodical interest on the<br \/>\n\tsaid deposit.\n<\/p>\n<p>The<br \/>\n\tremaining 25% of the amount shall be disbursed to the original<br \/>\n\tclaimants after following due procedure, by Account Payee cheque, in<br \/>\n\tthe name of the original claimants on proper verification by the<br \/>\n\tTribunal.\n<\/p>\n<p>6.0\tRule<br \/>\nis made absolute accordingly with no order as to costs.
