(ORAL)\n<\/pre>\n<p>                 A perusal of order dated 06.08.2009, indicates that<\/p>\n<p>by one consolidated order four applications have been decided i.e.,<\/p>\n<p>(i)        An application under Order 6 Rule 17 CPC;<\/p>\n<p>(ii)       An application under Order 1 Rule 10 CPC, for<\/p>\n<p>impleading vendees Manjit Kaur and Baljinder Kaur;<\/p>\n<p>(iii)      An application under Order 14 Rule 1 CPC, for framing<\/p>\n<p>additional issues; and<\/p>\n<p>(iv)       The application for production of additional evidence<\/p>\n<p>                               &#8230; 1<br \/>\n C.R.No.4715 of 2009<\/p>\n<p>under Section 151 CPC, to summon witnesses to lead additional<\/p>\n<p>evidence to prove that in a suit titled &#8216;Maghar Singh Vs. Bhagwan<\/p>\n<p>Kaur&#8217;, some other lady in place of Bhagwan Kaur was produced to<\/p>\n<p>obtain the alleged fake decree. The trial Court has dismissed the<\/p>\n<p>applications mentioned at Sr.Nos.(i), (ii), (iv), but allowed the<\/p>\n<p>application mentioned at Sr.No.(iii) above, for framing additional<\/p>\n<p>issue and framed additional Issue No.1A, to the effect whether the<\/p>\n<p>judgment and decree dated 05.12.1995, passed by Miss Mandeep<\/p>\n<p>Kaur Bhullar, Civil Judge (Jr.Divn.), Ludhiana, is liable to be set<\/p>\n<p>aside? OPP.\n<\/p>\n<p>                 The trial Court observed that since both the parties<\/p>\n<p>have already led their evidence very well knowing their pleadings<\/p>\n<p>and the case pertains to year 1997, therefore, there was no need to<\/p>\n<p>adjourn the case for giving opportunity to the parties to lead<\/p>\n<p>evidence on the additional issue.\n<\/p>\n<p>                 Learned Counsel for the petitioner has challenged<\/p>\n<p>the validity of the impugned order.\n<\/p>\n<p>                 After hearing counsel for the petitioner, I do not find<\/p>\n<p>any ground to interfere in the findings recorded by the trial Court<\/p>\n<p>while deciding applications mentioned at Sr.Nos.(i), (ii) &amp; (iii), but I<\/p>\n<p>am of the opinion that after framing of specific issue pertaining to the<\/p>\n<p>judgment and decree dated 05.12.1995, which is the root of<\/p>\n<p>controversy between the parties, the adjudication on issue No.1 A,<\/p>\n<p>will determine the main controversy between the parties. Besides<\/p>\n<p>this, a perusal of the impugned order indicates that vide order dated<\/p>\n<p>                                 &#8230; 2<br \/>\n C.R.No.4715 of 2009<\/p>\n<p>22.04.2009, while dismissing the application for additional evidence<\/p>\n<p>filed by the plaintiff-petitioner, it was observed that the plaintiff will be<\/p>\n<p>at liberty to file fresh application by giving detailed reasons for<\/p>\n<p>relevancy of documents\/evidence to be led by those witnesses in<\/p>\n<p>rebuttal evidence and to summon those witnesses along with record<\/p>\n<p>again for getting the thumb impressions of Smt. Bhagwan Kaur,<\/p>\n<p>examined through some Handwriting Expert. Since the right of the<\/p>\n<p>plaintiff-petitioner   to   produce   the   said   evidence     had    been<\/p>\n<p>safeguarded, the impugned order denying the said opportunity to the<\/p>\n<p>petitioner even after framing of additional issue seems to be<\/p>\n<p>improper and warrants interference by this Court exercising<\/p>\n<p>jurisdiction under Article 227 of the Constitution of India.<\/p>\n<p>                   Counsel for the petitioner has not been able to<\/p>\n<p>satisfy this Court as to how the re-examination of plaintiff is<\/p>\n<p>necessary when he has already made deposition in context to the<\/p>\n<p>judgment and decree dated 05.12.1995.\n<\/p>\n<p>                   The request to re-examine the plaintiff is declined.<\/p>\n<p>However, it appears necessary, in the interest of justice, to permit<\/p>\n<p>the plaintiff-petitioner to produce the Handwriting Expert to compare<\/p>\n<p>the established thumb impressions of Bhagwan Kaur with that on the<\/p>\n<p>written statement and power of attorney filed in Civil Suit No.247 of<\/p>\n<p>15.05.1995, titled &#8216;Maghar Singh Vs. Bhagwan Kaur&#8217;, which was<\/p>\n<p>decided on 05.12.1995. Petitioner can also summon the concerned<\/p>\n<p>Clerk of the Record Room along with file of case &#8216;Maghar Singh Vs.<\/p>\n<p>Bhagwan Kaur&#8217;,         in Civil Suit No.247 of 15.05.1995.        No other<\/p>\n<p>                                   &#8230; 3<br \/>\n C.R.No.4715 of 2009<\/p>\n<p>evidence will be permitted to be produced by the plaintiff. This<\/p>\n<p>opportunity will be given to the plaintiff subject to payment of a sum<\/p>\n<p>of Rs.5,000\/- as costs to the defendant-respondent. It is directed that<\/p>\n<p>plaintiff will produce the entire evidence within a period of 45 days<\/p>\n<p>w.e.f., 24.10.2009. It is made clear that it will be open to the<\/p>\n<p>defendant-respondent to produce any rebuttal evidence to the<\/p>\n<p>evidence produced by the plaintiff-petitioner on issue No.1A.<\/p>\n<p>                 The parties are directed to appear before the trial<\/p>\n<p>Court on 24.10.2009.
