No. 2983 of 2008\n            -------------------------------------------------\n          Dated this the 7th day of August, 2008\n\n                               ORDER\n<\/pre>\n<p>      The   petitioner faces indictment in a prosecution for<\/p>\n<p>offences punishable, inter alia, under Secs.326 and 308 read<\/p>\n<p>with Sec.34 IPC.     Investigation is complete.         Cognizance has<\/p>\n<p>already   been    taken.    Committal       proceedings      has been<\/p>\n<p>registered.   The petitioner was not arrested in the course of<\/p>\n<p>investigation.    He has not appeared before the learned<\/p>\n<p>Magistrate so far. The petitioner has received summons from<\/p>\n<p>the court, it is submitted.     The petitioner is willing to appear<\/p>\n<p>before the learned Magistrate and seek regular bail. But the<\/p>\n<p>petitioner apprehends that the offence being the one triable<\/p>\n<p>exclusively by a Court of Session, the learned Magistrate may<\/p>\n<p>not consider the petitioner&#8217;s application for regular bail on<\/p>\n<p>merits, in accordance with law and expeditiously. He therefore<\/p>\n<p><span class=\"hidden_text\"> Crl.M.C. No. 2983 of 2008 -: 2 :-<\/span><\/p>\n<p>prays that appropriate directions may be issued under Sec.482<\/p>\n<p>Cr.P.C.\n<\/p>\n<p>      2. I find the apprehension of the petitioner to be totally<\/p>\n<p>unjustified.    The learned Magistrate, it appears, has already<\/p>\n<p>exercised the discretion under Sec.204 Cr.P.C. to issue only a<\/p>\n<p>summons and not a warrant. I must assume that this discretion<\/p>\n<p>has been exercised by the learned Magistrate advisedly and after<\/p>\n<p>reference to all the circumstances.        It would be harsh and<\/p>\n<p>insensitive for any court to issue summons to a person to appear<\/p>\n<p>before it and thereafter remand him into custody even when he<\/p>\n<p>is willing to offer bail. Sufficient general directions have already<\/p>\n<p>been issued in the decisions reported in          <a href=\"\/doc\/1516775\/\">Alice George v.<\/p>\n<p>Deputy Superintendent of Police<\/a> (2003 (1) KLT 339) as also<\/p>\n<p><a href=\"\/doc\/1158859\/\">Sukumari v. State of Kerala<\/a> (2001 (1) KLT 22). I have no<\/p>\n<p>reason to assume that the learned Magistrate is not aware of the<\/p>\n<p>law and would not follow the law. In these circumstances, I am<\/p>\n<p>satisfied that no further, specific or special directions need be<\/p>\n<p>issued in this case.\n<\/p>\n<p>      3. In the result, this Crl.M.C. is dismissed. I may hasten to<\/p>\n<p>observe that if the petitioner surrenders before the learned<\/p>\n<p>Magistrate and seeks bail, after giving sufficient prior notice to<\/p>\n<p>the Prosecutor in charge of the case, the learned Magistrate<\/p>\n<p><span class=\"hidden_text\">Crl.M.C. No. 2983 of 2008 -: 3 :-<\/span><\/p>\n<p>must proceed to pass appropriate orders on merits and<\/p>\n<p>expeditiously &#8211; on the date of surrender itself. Such application<\/p>\n<p>must be considered in the light of the fact that the discretion has<\/p>\n<p>already been exercised to issue a summons and not a warrant as<\/p>\n<p>also in the light of the two binding precedents referred above.<\/p>\n<p>      4. Hand over a copy of this order to the learned counsel for<\/p>\n<p>the petitioner.\n<\/p>\n<\/p>\n<p>                                                    Sd\/-\n<\/p>\n<p>                                        (R.
