This Court cannot grant any higher<br \/>\n\twages while deciding the application under Section 17-B of the<br \/>\n\tIndustrial Disputes Act, 1947. However, this Court can certainly<br \/>\n\tconsider it whether to grant higher wages or not but, this is not a<br \/>\n\tcase in this Court. In the letter dated 20.04.2009 from Rajasthan<br \/>\n\tHospital addressed to Bhavnaben B. Panchal, following averments are<br \/>\n\tmade :-\n<\/p>\n<p>As<br \/>\n\tper High Court decision in Special Civil Application No.9521 of<br \/>\n\t2008, in view of Sec. 17B of FDAct 1947, we are required to pay you<br \/>\n\tthe last salary drawn at the time of quitting service. According to<br \/>\n\twhich we had requested you vide our letter<br \/>\n\tNo.GRMI\/HC\/9521\/08\/115\/2009 dated 16\/04\/09 to collect the cheques<br \/>\n\tbeing payment of salary for the months of January, February &amp;<br \/>\n\tMarch 2009. You have, however, not collected the cheques so far. As<br \/>\n\tsuch the cheques of ICICI Bank Ltd., Shahibaugh, Ahmedabad as<br \/>\n\tdetailed below are sent herewith:\n<\/p>\n<p>(1)\tCheque<br \/>\n\tNo.395372 dated 31\/12\/08 December 08 Rs.1,550\/-\n<\/p>\n<p>(2)\tCheque<br \/>\n\tNo.396257 dated 06\/03\/09 Addition Rs.1,000\/-\n<\/p>\n<p>(3)\tCheque<br \/>\n\tNo.395986 dated 20\/02\/09 January 09 Rs.1,750\/-\n<\/p>\n<p>(4)\tCheque<br \/>\n\tNo.396391 dated 04\/03\/09 February 09 Rs.1,750\/-\n<\/p>\n<p>(5)\tCheque<br \/>\n\tNo.421442 dated 07\/04\/09 March 09 Rs.1,750\/-\n<\/p>\n<p>After<br \/>\n\treading aforesaid letter impression coming out is that cheque were<br \/>\n\tready for payment to the original petitioner, but, same is not<br \/>\n\tcollected by the petitioner. Therefore, it is directed to original<br \/>\n\tpetitioner to pay last drawn wages to present applicant from the<br \/>\n\tdate of award till 30.04.2010. After deducting whatever amount is<br \/>\n\tpaid, remaining amount is to be paid within a period of 1(One) month<br \/>\n\tfrom the date of receiving a copy of this order.\n<\/p>\n<p>In<br \/>\n\tview of aforesaid observations and directions, present application<br \/>\n\tis disposed of.\n<\/p>\n<p>After<br \/>\n\tthe above order is passed by this Court, Mr.Shailesh Sharma wants to<br \/>\n\twithdraw this Civil Application.
