told how much to invest into the ‘busiriess. ‘H_o’weve’r.:he”iias<\/p>\n
failed to produce any donilnmaentsll’-as exlii’i’oit;s.,..and\u00a7 <\/p>\n
evidence to that effect. Since, heffailed to materials
\nand also the evidence\ufb01i11_ S’1lp:\u00a7iOl’f”~.O’f..fk\u00a7$ claim, the court
\nbelow has disbelieved “rejected”his petition.<\/p>\n

\nherself has  __the appellant–complainant has
\nmisuseduxa-.._sumV’ofVA’Rs’..’\u00a7~.’5O.OO0\/– in addition to which he<\/p>\n
boritowed pa s.fur1i..of___pRs.75,000\/– from her husband. Since<\/p>\n
‘ shedid”ncst_repay, a complaint has been lodged against the<\/p>\n
R  these throw a light on the conduct of the<\/p>\n
In View of the crirninal cases filed against the<\/p>\n
 “appellant himself shows that he is indulged in<\/p>\n
frrr\ufb01sappropriation of the fund belongs to the corporation.<\/p>\n

11. It is also referred by the court below that two
\ncriminal cases were filed by the accused against the<\/p>\n
complainant in C.C.Nos.388\/1989 and 446\/2006′-thefile<\/p>\n
of the 11 Additional co. {Jr.Dn}, JMFC, Mangal_ote;’:D;K.:’. _1_”n_<\/p>\n
C.C.No.338\/1989, the Court by ape’ order–‘d-eaiea.:1*:4;.3l20o7’;\u00b0’~–<\/p>\n
has held the accused guilty for  offence’4poniS’hab1’e-grader<\/p>\n
Section 138 of N.I. Act. In.<3.-c.No.'4cl6';'2oo5',""%' <\/p>\n
its order dated 14.3.2007 has uallovvepd the  byvvfgconvicting
\nthe appellant for the   undet dection 138<\/p>\n
of N.I. Act.\n<\/p>\n

‘ yrebuttiedty  appellant has not placed any materials or<\/p>\n
H  deposited in the respondent–Corporation<\/p>\n
  claims that the amount was borrowed from the<\/p>\n
  “p’riyateV” parties and also from his father and they have not<\/p>\n
“been examined. In his cross examination he has stated in<\/p>\n
it “para 14 that “I do not know how many times how much<\/p>\n

amount was invested in the Corporation. As per the oral
\nagreement, he should be given a share in the profit”. This
\nevidence itself goes to show that he was not sure whether
\nany amount Was deposited in the responder1t\u00bbCorpo”ration.<\/p>\n
The Court below has referred the Hon’bie <\/p>\n
decision reported in 2005(5) so 547 in*f};’he:eeVe’ae’ee\u00bb<\/p>\n
