     Application for regular bail.           The petitioners are accused<\/p>\n
1 to 4. Altogether, there are four accused persons. They face<\/p>\n
allegations in a crime which was initially registered, inter alia,<\/p>\n
under Sec.302 of the IPC.          In the course of investigation, the<\/p>\n
Section of offence has been altered to Sec.304 of the IPC.<\/p>\n
Investigation is in progress.          Final report has not been filed<\/p>\n
yet.\n<\/p>\n
     2. The crux of the allegations against the petitioners is<\/p>\n
that they were proceeding on two motor-cycles on the evening<\/p>\n
of 31\/10\/07.   They allegedly picked up a quarrel with some<\/p>\n
others at a bus waiting shed near the place of occurrence in<\/p>\n
this case.   About that incident, another crime has later been<\/p>\n
registered. After the incident in that case, the four petitioners<\/p>\n
herein were moving away from the said scene of the crime in<\/p>\n
two motor-cycles. Allegedly on receiving information from the<\/p>\n
persons, who were involved in that incident at the bus waiting<\/p>\n

shed, the deceased in this case and others came on to the road<\/p>\n
and allegedly wanted to obstruct the escape of the accused<\/p>\n
persons.    There, it is alleged that the deceased was knocked<\/p>\n
down and attacked by the petitioners who were proceeding on<\/p>\n
two motor-cycles. The deceased and others with him suffered<\/p>\n
injuries. The deceased succumbed to his injuries. Accused No.2<\/p>\n
was arrested on 1\/11\/07. In fact, the Case Diary shows that he<\/p>\n
was intercepted and detained at the scene of the crime itself by<\/p>\n
others.    Accused No.3 was arrested on 2\/11\/07 and accused<\/p>\n
Nos.1 and 4 were arrested on 12\/11\/07.           They continue in<\/p>\n
custody from those dates.\n<\/p>\n
      3. The learned counsel for the petitioners submits that the<\/p>\n
petitioners are absolutely innocent.      After the incident in the<\/p>\n
earlier scene, they were going away from the scene. They were<\/p>\n
victims of aggression even in that first incident. While they were<\/p>\n
trying to go away from the scene, the deceased in this case and<\/p>\n
some others tried to obstruct them and attack them.      They, who<\/p>\n
were passing on the motor-cycles, were intercepted and the<\/p>\n
motor-cycles were pushed down leading to the fall of the<\/p>\n
petitioners. Apprehending danger to them, they took to their<\/p>\n
heels.   The deceased who had come to the scene of the<\/p>\n

occurrence with the intention of attacking them had fallen in the<\/p>\n
course of the incident and had suffered injuries. In any view of<\/p>\n
the matter, the petitioners cannot be said to be liable for any<\/p>\n
offence under Sec.302      or Sec.304 of the IPC, submits the<\/p>\n
learned counsel for the petitioners.    The petitioners, who have<\/p>\n
remained in custody from the dates referred above, may now be<\/p>\n
enlarged on bail, submits the learned counsel for the petitioners.<\/p>\n
      4. The learned Public Prosecutor opposes the application.<\/p>\n
The learned Public Prosecutor submits that the petitioners with<\/p>\n
the deliberate intention of attacking the victim and knocking him<\/p>\n
down had hit him with the motor-cycle and had indulged in the<\/p>\n
acts of violence against him.      The petitioners and the victim<\/p>\n
belong to two different political parties. A tense law and order<\/p>\n
situation prevails in the locality.   In these circumstances, the<\/p>\n
petitioners may not be released on bail at this stage of the<\/p>\n
investigation. If the courts were inclined to grant regular bail to<\/p>\n
the petitioners, some further time may be granted to the<\/p>\n
Investigator to complete the investigation. The presence of the<\/p>\n
petitioners at the scene of the crime may be excluded by<\/p>\n
appropriate directions in the interests of maintenance of law and<\/p>\n
order in the locality.\n<\/p>\n
 B.A. NO. 7564 of 2007         -: 4 :-<\/span><\/p>\n
      5. I have considered all the relevant inputs.       As the<\/p>\n
reasons which prompted the Investigating Officer to alter the<\/p>\n
Section from Sec.302 to Sec.304 of the IPC was not very clear to<\/p>\n
this Court, the learned Public Prosecutor was requested to place<\/p>\n
the Case Diary to make detailed submission.      I am yet to find<\/p>\n
satisfactory reasons for the Investigating Officer to reduce the<\/p>\n
Section of offence from Sec.302 to Sec.304 of the IPC at this<\/p>\n
stage of the investigation.        That subtle discretion should<\/p>\n
normally not be exercised by the Investigating Officer at this<\/p>\n
early stage of the investigation. Be that as it may, I take note of<\/p>\n
the totality of the circumstances in this case.  I am of opinion<\/p>\n
that subject to appropriate conditions which shall allay the<\/p>\n
apprehension aired by the learned Public Prosecutor            and<\/p>\n
safeguard the interests of a fair, efficient and expeditious<\/p>\n
investigation, the petitioners can be granted regular bail subject<\/p>\n
to conditions.\n<\/p>\n
      6.  In the result:\n<\/p>\n
      (a) This application is allowed.   The petitioners shall be<\/p>\n
released on bail on the following terms and conditions:<\/p>\n
      (i) The petitioners shall not be released from custody on<\/p>\n
 B.A. NO. 7564 of 2007          -: 5 :-<\/span><\/p>\n
the strength of this order prior to 27\/12\/2007.  The Investigator<\/p>\n
shall, in the meantime, make every endeavour to complete the<\/p>\n
investigation.\n<\/p>\n
      (ii) The petitioners shall execute bonds for Rs.1,00,000\/-<\/p>\n
(Rupees one lakh only) each with two solvent sureties each for<\/p>\n
the like sum to the satisfaction of the learned Magistrate.<\/p>\n
      (iii) The petitioners shall make themselves available for<\/p>\n
interrogation before the Investigating Officer on all Mondays and<\/p>\n
Fridays between 10 a.m. and 12 noon for a period of three<\/p>\n
months from the date of their release from custody and<\/p>\n
thereafter as and when directed by the Investigating Officer in<\/p>\n
writing to do so.\n<\/p>\n
      (iv) During the said period of three months, the petitioners<\/p>\n
shall not enter the jurisdiction of Chadayamangalam Police<\/p>\n
Station without the prior permission of the learned Magistrate,<\/p>\n
except for the purpose of complying with Condition No.(iii)<\/p>\n
above.\n<\/p>\n
      7. The learned counsel for the petitioners submits that<\/p>\n
accused No.4 wants to attend a meeting of the Nilamel Grama<\/p>\n
Panchayat for election of its President at 11 a.m. on 17\/12\/2007.<\/p>\n
He prays that appropriate directions may be issued to ensure<\/p>\n
 B.A. NO. 7564 of 2007           -: 6 :-<\/span><\/p>\n
that he is able to participate in the said meeting.<\/p>\n
     8.   There shall be a direction that the petitioner No.4\/<\/p>\n
accused No.4 shall be permitted to attend that meeting with<\/p>\n
necessary police escort.      Arrangement to that effect shall be<\/p>\n
made by the Superintendent of the Sub Jail, Kottarakkara.<\/p>\n
