RAMACHANDRA MENON, J.\n              ........................................................................\n                    W.P.(C)No. 15835 OF 2009\n              .........................................................................\n                     Dated this the              23rd June, 2009\n\n                                  J U D G M E N T\n<\/pre>\n<p>      The case of the petitioner is that though he happened to be<\/p>\n<p>a defaulter in repaying the loan availed from the second<\/p>\n<p>respondent -Co-operative Bank, earnest efforts are being made<\/p>\n<p>to clear the liability by arranging funds from different sources.<\/p>\n<p>The coercive steps stated as now being pursued against him,<\/p>\n<p>invoking the relevant provisions under the SARFAESI Act                                   are<\/p>\n<p>sought to be intercepted by filing the present Writ Petition, also<\/p>\n<p>referring to the grievances projected in Ext . P3 representation<\/p>\n<p>already filed before the second respondent, seeking for scaling<\/p>\n<p>down the liability to the eligible extent and to have it settled<\/p>\n<p>under &#8216;OTS&#8217;.\n<\/p>\n<p>      2. The learned Counsel appearing for the respondent-Bank<\/p>\n<p>submits that the liability of the petitioner under the two different<\/p>\n<p>loans will be above Rs. Five lakhs, including interest and cost.<\/p>\n<p>The learned Counsel for the Bank                              also submits that if the<\/p>\n<p>petitioner proves his bonafides , the Bank will definitely consider<\/p>\n<p>W.P.(C)No. 15835 OF 2009<\/p>\n<p><span class=\"hidden_text\">                                 2<\/span><\/p>\n<p>Ext.P3 in accordance with law.\n<\/p>\n<p>      3. Considering the facts and circumstances, the petitioner<\/p>\n<p>is directed to pay a sum of Rs. One lakh within three weeks and<\/p>\n<p>on such an event, the second respondent shall consider Ext. P3<\/p>\n<p>representation preferred by the petitioner and pass appropriate<\/p>\n<p>orders thereon, after giving an opportunity of hearing to the<\/p>\n<p>petitioner. On conveying the outcome of Ext.P3, the petitioner<\/p>\n<p>shall clear the entire balance amount within one month there<\/p>\n<p>after.\n<\/p>\n<p>      The Writ Petition is disposed of as above, making it clear<\/p>\n<p>that   all coercive proceedings stated as now being pursued<\/p>\n<p>against the petitioner shall be kept in abeyance till such time.<\/p>\n<p>                                 P.R.
