This writ petition has been filed by the<\/p>\n<p>                     petitioner challenging order dated 09.12.2004 (Annexure-1)<\/p>\n<p>                     by which Sub-Divisional Officer, Katihar (respondent no.3)<\/p>\n<p>                     cancelled Fair Price Shop Licence No.28 of 1985 under the<\/p>\n<p>                     Public Distribution System.\n<\/p>\n<p>                                    3. It further transpires that when a proceeding<\/p>\n<p>                     was initiated licence of the petitioner was suspended under<\/p>\n<p>                     the provisions of the Bihar Trade Articles (Licences<\/p>\n<p>                     Unification) Order, 1984 by the said authority vide order<\/p>\n<p>                     dated 25.11.2002 (Anneuxre-4), whereafter an opportunity<\/p>\n<p>                     for filing show cause was given to the petitioner, who also<\/p>\n<p>                     filed his show-cause twice and finally vide order dated<\/p>\n<p>                     09.12.2004 (Annexure-1) the said authority cancelled the<\/p>\n<p>                     licence of the petitioner.\n<\/p>\n<p><span class=\"hidden_text\">                      -2-<\/span><\/p>\n<p>             4. From the impugned order it is quite apparent<\/p>\n<p>that the authority concerned had not considered the defence<\/p>\n<p>taken by the petitioner and the materials produced by him<\/p>\n<p>rather the said order was passed merely on the direction of the<\/p>\n<p>District Magistrate, Katihar which was sent to the Sub-<\/p>\n<p>Divisional Officer vide letter dated 04.12.2004 (Annexure-6)<\/p>\n<p>issued by the Supply Officer, Katihar. As a result, the licence<\/p>\n<p>of the petitioner had been cancelled in a cursory manner<\/p>\n<p>without giving any reason and without pointing out any<\/p>\n<p>lacuna in the conduct of the petitioner.\n<\/p>\n<p>             5. So far the District Magistrate is concerned, he<\/p>\n<p>is an appellate authority as per the aforesaid Bihar Trade<\/p>\n<p>Articles (Licences Unification ) Order, 1984 and he had no<\/p>\n<p>jurisdiction to send such directions to the Sub-Divisional<\/p>\n<p>Officers who according to the provisions of law had to apply<\/p>\n<p>their independent minds on the facts and circumstances of the<\/p>\n<p>case, pleadings of the parties and the materials available on<\/p>\n<p>record which in the instant case is absolutely absent.<\/p>\n<p>             6. In the aforesaid facts and circumstances this<\/p>\n<p>writ petition is allowed. Order of the Sub-Divisional Officer,<\/p>\n<p>Katihar dated 09.12.2004 (Annexure-1) is hereby quashed<\/p>\n<p>and the Sub-Divisional Officer, Katihar is directed to decide<\/p>\n<p>the matter afresh considering the pleadings of the parties, the<\/p>\n<p>materials and the provision of law applicable thereto without<\/p>\n<p>being influenced and without considering the aforesaid order<\/p>\n<p>or any other order in that regard passed by the District<br \/>\n<span class=\"hidden_text\">                               -3-<\/span><\/p>\n<p>         Magistrate. If the petitioner files an application along with a<\/p>\n<p>         copy of this order within four weeks from today, the Sub-<\/p>\n<p>         Divisional Officer, Katihar shall hear the parties and decide<\/p>\n<p>         the matter by a speaking order within three months from the<\/p>\n<p>         date of receipt\/production of a copy of this order.<\/p>\n<pre>Harish                                       (S.N.
