It is asserted that the\n\npetitioner is a Patwari in Irrigation Department and,\n\ntherefore,       only   the   authority         of    the   Irrigation\n\nDepartment could have suspended the petitioner.\n                                        2\n\n            The     respondents            in     reply        to     the    writ\n\npetition    stated       that     though         the        petitioner      is    a\n\nPatwari    in     Department      of       Irrigation,          however,         the\n\nincident of trap occurred on 30.10.2004 and on that\n\nday the petitioner was working in Revenue Department,\n\ntherefore, the Collector, Hanumangarh rightly passed\n\nthe order of suspension.\n\n\n\n            Heard counsel for the parties.\n\n\n\n            It is true that on 30.10.2004 the petitioner\n\nwas working as Patwari in Department of Revenue i.e.\n\nwithin    the     administrative           control      of     the    Collector\n\n(Land    Records),       Hanumangarh,            however,       by    an    order\n\ndated 15.12.2004 the services of the petitioner were\n\nplaced     at     the     disposal          of        the     Department         of\n\nIrrigation. The petitioner after 17.12.2004, for all\n\npurposes,       became    an    employee         of    the     Department        of\n\nIrrigation.        ON     27.12.2004             the        Collector       (Land\n\nRecords),       Hanumangarh      was       having       no     administrative\n\ncontrol or authority to take any disciplinary action\n\nagainst     the     petitioner         or        to     place        him    under\n\nsuspension while exercising powers under Rule 13 of\n\nthe Rajasthan Civil Services (Classification, Control\n\n&amp; Appeal) Rules, 1958. The order impugned, therefore,\n\nis apparently bad.\n\n\n\n            For     the        reasons       mentioned          above,       this\n\npetition for writ succeeds and, therefore, the same is\n                           3\n\nallowed.
