DAVE\n\t\t\n\t\n\n \n\nDate\n: 01\/03\/2011 \n\n \n\nORAL\nORDER<\/pre>\n<p>\t\tRULE.\n<\/p>\n<p>Learned APP, waives service of notice of rule on behalf of the<br \/>\nrespondent-State.\n<\/p>\n<p>1.\t\tPresent<br \/>\napplication has been filed by the applicant for grant of regular bail<br \/>\nunder Section 439 of Code of Criminal Procedure after the<br \/>\ncharge-sheet is filed, which is a successive bail application after<br \/>\nCriminal Misc. Application No.15567 of 2010 was withdrawn.\n<\/p>\n<p>2.\t\tThe<br \/>\napplicant accused is charged with having committed offence under<br \/>\nSections 397, 395, 332, 427, 323, 504 &amp; 506(2) of IPC and under<br \/>\nSection 3(1)(c) of Prevention of Damages to Public Property Act, 1984<br \/>\nand Sec. 135 of Bombay Police Act for which FIR being C.R. No.<br \/>\nI-41\/2010 has been registered with Bhanvad Police Station.\n<\/p>\n<p>3.\t\tLearned<br \/>\ncounsel for the applicant submitted that considering the nature of<br \/>\noffence and the manner in which it is alleged to have been committed,<br \/>\npresent application may be allowed as now the charge-sheet has been<br \/>\nfiled. He has also submitted that as stated in the FIR itself, there<br \/>\nwas some gambling and when victim police personnel went there, the<br \/>\nincident has occurred. He, therefore, submitted that present<br \/>\napplication may be allowed.\n<\/p>\n<p>4.\t\tLearned<br \/>\nAPP resisted the application and submitted that when the police<br \/>\npersonnel tried to prevent the gambling, the accused attacked.\n<\/p>\n<p>5.\t\tHaving<br \/>\nheard the learned Counsel for the parties and having considered the<br \/>\nnature of offence and the role attributed and also the fact that the<br \/>\ncharge-sheet has been filed, present application deserves to be<br \/>\nallowed subject to the conditions hereinafter.\n<\/p>\n<p>6.\t\tAccordingly, present<br \/>\napplication stands allowed. The applicant is ordered to be released<br \/>\non regular bail in connection with the F.I.R. being C.R.No.<br \/>\nI-41\/2010 registered with BHANVAD POLICE STATION,<br \/>\non his executing a bond of Rs.5,000\/- (Rupees Five Thousand) with one<br \/>\nsolvent surety of the like amount to the satisfaction of the lower<br \/>\nCourt and subject to the conditions that he shall:\n<\/p>\n<p>(a)\tnot take undue<br \/>\nadvantage of his liberty or abuse his liberty.\n<\/p>\n<p>(b)\tnot to try to tamper<br \/>\nor pressurize the prosecution witnesses or complainant in any manner.\n<\/p>\n<p>(c)\tnot act in any<br \/>\nmanner injurious to the interest of the prosecution.\n<\/p>\n<p>(d)\tmaintain law and<br \/>\norder and should cooperate with the investigating officers.\n<\/p>\n<p>(e)\tmark his presence<br \/>\nbefore concerned Police Station on 1st Monday of every<br \/>\nmonth of English calender between 11:00 AM to 2:00 PM till the trial<br \/>\ncommences;\n<\/p>\n<p>(f)\tfurnish the address<br \/>\nof his residence to the Investigating Officer and also to the Court<br \/>\nat the time of execution of the bond and shall not change his<br \/>\nresidence without prior permission of the Court.\n<\/p>\n<p>(g)\tsurrender his<br \/>\npassport, if any, to the lower Court, within a week.\n<\/p>\n<p>7.\tIf<br \/>\nbreach of any of the above conditions is committed, the concerned<br \/>\nSessions Judge will be  free to issue warrant or take appropriate<br \/>\naction in the matter.\n<\/p>\n<p>8.\tBail<br \/>\nbefore the lower Court having jurisdiction to try the case. It would<br \/>\nbe open to the trial Court concerned to give time to furnish the<br \/>\nsolvency certificate if prayed for.\n<\/p>\n<p>9.\tRule<br \/>\nis made absolute to the aforesaid   extent.
