Ors\n                                Versus\n                       The State of Bihar &amp; Ors\n                               -----------\n<\/pre>\n<p>2.   18.10.2011         The petitioners have come to this Court for a<\/p>\n<p>                   direction to permit them to appear in the interview on the<\/p>\n<p>                   post of Pharmacist which is to commence from 24.10.2011.<\/p>\n<p>                   They claim age relaxation in view of the fact that as per the<\/p>\n<p>                   earlier order of this Court dated 21.7.1999 passed in<\/p>\n<p>                   C.W.J.C.No.4302 of 1998 it appears that appointment on<\/p>\n<p>                   the post of Pharmacist had not been made for a long period<\/p>\n<p>                   of time and stop-gap arrangements on ad-hoc basis were<\/p>\n<p>                   being continued and it is mentioned that advertisements<\/p>\n<p>                   were issued in the year 1992 in some of the surgencies;<\/p>\n<p>                   accordingly this Court directed the question of relaxation of<\/p>\n<p>                   age to be considered and the same was found mentioned in<\/p>\n<p>                   the advertisement dated 25.1.2000 published by the<\/p>\n<p>                   Directorate of Health Services, but yet no such decision<\/p>\n<p>                   regarding age relaxation has been given.<\/p>\n<p>                         Learned counsel for the petitioners relies upon two<\/p>\n<p>                   decisions of this Court in the case of Bishun Dutta Jha &amp;<br \/>\n<span class=\"hidden_text\">                          2<\/span><\/p>\n<p>        Ors vs. B.P.S.C. &amp; Ors. : 1999(2) PLJR 215 and<\/p>\n<p>        Dr.Rabindra Kumar Singh &amp; Ors. vs. State of Bihar &amp; Ors.<\/p>\n<p>        : 2000(3) PLJR 231 in which in similar circumstances<\/p>\n<p>        direction for relaxation of age has been given.<\/p>\n<p>               Learned counsel for the Bihar Staff Selection<\/p>\n<p>        Commission, however, points out that the interview will<\/p>\n<p>        continue till 8.12.2011 which gives sufficient time for the<\/p>\n<p>        purpose of decision being taken by the State Government in<\/p>\n<p>        the matter with respect to all the candidates and not merely<\/p>\n<p>        the petitioners before this Court.\n<\/p>\n<p>               It is, accordingly, directed that the State Government<\/p>\n<p>        shall take a decision in the matter of age relaxation in terms<\/p>\n<p>        of the directions of this Court by order dated 21.7.1999<\/p>\n<p>        within a period of two weeks from today and convey the<\/p>\n<p>        same to the Bihar Staff Selection Commission so that<\/p>\n<p>        further interview letters may be issued by the Commission<\/p>\n<p>        in terms of the decision of the State Government.<\/p>\n<p>               Put up on 3rd November, 2011 in the same position.<\/p>\n<p>                                   (Ramesh Kumar Datta,J)<\/p>\n<p>Spal\/\n <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Patna High Court &#8211;
