The relevant part of the<br \/>\ndiscussions reads as under:-\n<\/p>\n<p>&#8220;In the present<br \/>\ncase the suit house is more than 100 years old and in fact in the<br \/>\npresent case, the first and second floor actually has fallen down and<br \/>\nthe same was removed and the landlord became harmless, and was<br \/>\ncompelled to go in market to search for residence and shop. In the<br \/>\npresent case also the tenant never cared to search for any premises.<br \/>\nSo considering the evidence and the above case-law. I conclude that<br \/>\ngreater hardship will be caused if the landlord is refused to decree<br \/>\nof eviction and hence Issue No.5 is decided accordingly in favour of<br \/>\nthe plaintiff.\n<\/p>\n<p>13.\tIssue No.3:- This<br \/>\nissue pertains to non-user of the suit premises immediately prior to<br \/>\nthe date of filing the suit for six months or more without any<br \/>\nreasonable cause. Plaintiff has averred this ground in plaint and<br \/>\norally deposed about the non-user of the premises. It is the say of<br \/>\nthe plaintiff that the original tenant Maganbhai died on 29.5.1983<br \/>\nand before that since seven to eight months, Maganbhai has closed<br \/>\ndown his business in the suit premises. This is denied by the<br \/>\ndefendants. Except the bare words against one another, there is no<br \/>\nsufficient and independent evidence to come to a conclusion about the<br \/>\nclosure of the business was from a particular date. In the above<br \/>\ncircumstances, I hold that the plaintiff has failed to prove non-user<br \/>\nof the suit premises before the date of the filing of the suit and<br \/>\nthe issue is decided in negative.\n<\/p>\n<p>14. Issue No.6:- Issue<br \/>\nNo.4 of bonafide requirement and that of hardship is decided in<br \/>\nfavour of the plaintiff and against the defendants and that I have<br \/>\nalso held that the defendants are not the tenants as contemplated<br \/>\nunder Section 5(11)(c) hence the plaintiff is entitled to decree for<br \/>\npossession and issue is decided in the affirmative.&#8221;\n<\/p>\n<p>4.\t\tIn<br \/>\nview of the above, this Court is not inclined to interfere with the<br \/>\nfindings recorded by both the Courts below. At this stage, a<br \/>\nstatement is made by Mr. Majmudar, learned Advocate for the<br \/>\napplicants that applicants will vacate the premises in question<br \/>\nwithin a period of two  years.\n<\/p>\n<p>5.\t\tConsidering<br \/>\nthe overall aspects of the matter, two years time is granted to<br \/>\nvacate the premises i.e. upto 13th June, 2013. Usual<br \/>\nundertaking to that effect will be filed by the applicants within a<br \/>\nperiod of 4 weeks from today.\n<\/p>\n<p>6.\t\tThis<br \/>\norder is passed in absence of the other side only to avoid expenses<br \/>\nto be incurred by the other side before this Court.
