No. 3791 of 2007\n               ==========================\n                Dated this the 23rd day of January, 2008.\n\n                                 ORDER\n<\/pre>\n<p>      In this petition filed under Section 482 Cr.P.C., the petitioner,<\/p>\n<p>who is an advocate by profession seeks the 1st respondent, the Sub<\/p>\n<p>Inspector of Police, Ernakulam Town North Police Station to comply<\/p>\n<p>with the directions contained in Annexure A to C orders passed by the<\/p>\n<p>Judicial First Class Magistrate-I, Ernakulam directing him to conduct<\/p>\n<p>further investigation in the case.\n<\/p>\n<p>      2.    On the complaint lodged by the petitioner before the<\/p>\n<p>Ernakulam Town North Police Station an FIR was registered as Crime<\/p>\n<p>No. 165\/2005 for offences punishable under Sections 381, 406, 420,<\/p>\n<p>468 and 471 IPC. The petitioner&#8217;s case is that his former driver by<\/p>\n<p>name Jomon had betrayed the confidence reposed on him by misusing<\/p>\n<p>the cheque leaves from the cheque book entrusted to him by the<\/p>\n<p>petitioner.\n<\/p>\n<p>      3.   Even though the Sub Inspector charge sheeted the said<\/p>\n<p>Jomon, his accomplice one Girish was not charge sheeted and neither<\/p>\n<p>the money misappropriated by the driver nor the jewels and other<\/p>\n<p>movables purchased with this money so misappropriated, were seized<\/p>\n<p>by the Sub Inspector.      It was under these circumstances that the<\/p>\n<p><span class=\"hidden_text\">CRL. M.C. No. 3791\/2007            : 2:<\/span><\/p>\n<p>petitioner  prayed    for  further   investigation of   the   case  and<\/p>\n<p>notwithstanding the three orders passed by the learned Magistrate the<\/p>\n<p>1st respondent have been insensitive to the valid directions issued by<\/p>\n<p>the Magistrate. Hence, this petition.\n<\/p>\n<p>      4.   Having regard to the tardy nature of the investigation<\/p>\n<p>conducted by the 1st respondent who has demonstrated his lethargy in<\/p>\n<p>the matter, I am of the view that the investigation should be entrusted<\/p>\n<p>with a higher level officer. Accordingly, the investigation in crime No.<\/p>\n<p>165\/2005 of Town North Police Station, Ernakulam shall be taken over<\/p>\n<p>by the Circle Inspector of Police, Town North Police Station, Ernakulam<\/p>\n<p>forthwith. He shall commence the investigation without any further<\/p>\n<p>delay and complete the same expeditiously and at any rate within two<\/p>\n<p>months of commencement of the investigation.<\/p>\n<p>      This Crl.
