Justice M.SASIDHARAN NAMBIAR\n\n Dated :04\/11\/2009\n\n O R D E R\n              M.SASIDHARAN NAMBIAR,J.\n\n              ------------------------------------------\n               CRL.M.C.NO.3238 OF 2009\n              ------------------------------------------\n\n               Dated      4th November 2009\n\n\n                           O R D E R\n<\/pre>\n<p>            Petitioner        is     the      accused     and   second<\/p>\n<p>respondent, the de facto complainant in C.C.278\/2006<\/p>\n<p>on the file of Judicial First Class Magistrate-V,<\/p>\n<p>Kozhikode  taken   cognizance          for      the     offence  under<\/p>\n<p>Section 498 A of Indian Penal Code. This petition is<\/p>\n<p>filed under Section 482 of Code of Criminal Procedure<\/p>\n<p>to  quash  the   proceedings           contending        that   entire<\/p>\n<p>matrimonial disputes were settled between the parties<\/p>\n<p>and Annexure-3 agreement was entered into before the<\/p>\n<p>Lok Adalath and in such circumstances, it is not in<\/p>\n<p>the interest of justice to proceed with the case.<\/p>\n<p>         2.   Second       respondent          appeared     through  a<\/p>\n<p>counsel  and  filed       Crl.M.A.6083\/2009             jointly   with<\/p>\n<p>petitioner stating that following mediation efforts by<\/p>\n<p>this court and Lok Adalath, all disputes between<\/p>\n<p>petitioner and second respondent were finally settled<\/p>\n<p>under Annexures-1 and 2 and in view of the settlement<\/p>\n<p>the case is to be quashed.\n<\/p>\n<p>Crmc 3238\/09<br \/>\n<span class=\"hidden_text\">                              2<\/span><\/p>\n<p>            3.  Learned  counsel   appearing   for   the<\/p>\n<p>petitioner,    second  respondent  and  learned   Public<\/p>\n<p>Prosecutor were heard.\n<\/p>\n<p>            4.  When matrimonial disputes were settled<\/p>\n<p>between    the  parties,  as  evidenced  by  the   joint<\/p>\n<p>statement     filed by petitioner husband and second<\/p>\n<p>respondent    wife as  well  as  by  Annexures-1 and   2<\/p>\n<p>settlements arrived at by the parties ,it is not in the<\/p>\n<p>interest of justice to continue the prosecution as held<\/p>\n<p>by the Apex court in B.S.Joshi   and others  v.
