Counsel for the applicant &#8211; appellant, Mr. Joshi,<br \/>\nLd. Counsel with Mr. Chhaya for respondent no. 1 and Mr. Mehul Shah,<br \/>\nLd. Counsel for respondent nos. 3 and 4. Respondent no. 2 is served,<br \/>\nbut none appeared on his behalf.\n<\/p>\n<p>3.\t\tThe appeal has<br \/>\nalready been admitted earlier vide order dated 1\/12\/2010. If the<br \/>\nsale-deed is allowed to be executed, it will create irreversible<br \/>\nsituation and hence the judgment and <\/p>\n<p>the decree of the<br \/>\ntrial Court to that extent deserves to be stayed. As such, by<br \/>\nad-interim order, it was stayed and, therefore, the said ad-interim<br \/>\norder deserves to be confirmed, subject to the modification as stated<br \/>\nhereinafter.\n<\/p>\n<p>4.\t\tHowever, matter<br \/>\ndoes not end there, reason being that status of the property, pending<br \/>\nthe appeal, would be required to be maintained. At the same time, it<br \/>\nfurther appears that to show the readiness and willingness, the<br \/>\nrespondent no. 1 &#8211; original plaintiff has already deposited the<br \/>\namount of Rs.87,98,999\/-, which has been deposited with the<br \/>\nnationalized bank, as contended by the learned counsel for both the<br \/>\nsides and, therefore, there may be the interest accrued thereon. If<br \/>\nby interim order, the execution of the sale-deed of the property in<br \/>\nquestion is stayed, there is no reason why the said amount should not<br \/>\nbe permitted to be withdrawn to the original plaintiff, but he should<br \/>\nfile an undertaking to this Court that as and when it is so directed,<br \/>\nthe said amount shall be re-deposited with the Court. In our view, on<br \/>\nthe aspect of equitable consideration, the modification to the<br \/>\nearlier ad-interim order is required to be made.\n<\/p>\n<p>5.\t\tHence, the<br \/>\nfollowing order :\n<\/p>\n<p>\t\tBy interim order,<br \/>\nit is directed that &#8211;\n<\/p>\n<p>[A]\t\tThere shall be<br \/>\nstay against execution of the judgment and decree of the trial \tCourt<br \/>\nfor execution of the sale-deed of the property in question on<br \/>\ncondition that the appellant as well as respondent nos. 2, 3 and 4<br \/>\nshall also maintain the status-quo qua title, possession and<br \/>\nconstruction of the property in question until final disposal of the<br \/>\npresent appeal.\n<\/p>\n<p>[B]\t\tIt is further<br \/>\nobserved that the respondent no. 1 &#8211; original plaintiff shall<br \/>\nbe at liberty to withdraw the amount of Rs.87,98,999\/- with the<br \/>\naccrued interest thereon out of the investment made by the Court,<br \/>\nupon filing the undertaking with this Court and copy whereof shall be<br \/>\nproduced before the trial Court, that he shall re-deposit the amount<br \/>\nwith interest, if it is so directed by this Court in the present<br \/>\nappeal, within period of one month from the date of direction which<br \/>\nmay be issued.\n<\/p>\n<p>\t\tThe application<br \/>\nstands disposed of accordingly.\n<\/p>\n<p>[<br \/>\nJAYANT PATEL, J. ]<\/p>\n<p>[<br \/>\nJ.C.
